Mr.D.Sasikumar\n\t\t    Government Advocate (Writs)\n\t\t    for M\/s.V.Rajasekaran\n\t\t    Government Advocate (T)\n:ORDER\n<\/pre>\n<p>\t\tHeard the learned counsel appearing for the petitioner and also<br \/>\nMr.D.Sasikumar, learned Government Advocate, who took notice on behalf of<br \/>\nMr.V.Rajasekaran, learned Government Advocate (T), for respondents.\n<\/p>\n<p>\t2. The learned counsel for the petitioner would submit that the respondent<br \/>\nwhile entertaining the appeal and granting stay, demanded the petitioner to<br \/>\nfurnish bank guarantee or immovable property security, which the petitioner<br \/>\ncould not furnish.  Hence, this writ petition.\n<\/p>\n<p>\t3. The learned counsel for the petitioner also would invite the attention<br \/>\nof this Court to the decision of this Court dated 31.07.2008 in W.P(MD)No.6803<br \/>\nof 2008 and pray for permitting him to execute personal bond.\n<\/p>\n<p>\t4. Heard the learned Government Advocate.\n<\/p>\n<p>\t5. In view of the decision of this Court cited supra, I would like to pass<br \/>\nthe following direction is issued:\n<\/p>\n<p>\tThe petitioner is permitted to execute a personal bond and accordingly the<br \/>\nstay order dated 28.08.2008 issued by the respondent shall stand modified.\n<\/p>\n<p>\t6. With the above direction, this writ petition is disposed of.
