Justice R.BASANT\n\n Dated :12\/03\/2008\n\n O R D E R\n                               R.BASANT, J\n                       ------------------------------------\n                        B.A.No.1514 of 2008\n                       -------------------------------------\n               Dated this the 12th day of March, 2008\n\n                                   ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioners are accused 1<\/p>\n<p>to 9.    Altogether there are 15 accused persons.                    All the<\/p>\n<p>petitioners are named in the F.I.R. They face allegations in a<\/p>\n<p>crime registered alleging offences punishable, inter alia, under<\/p>\n<p>Section 326 r\/w 149 I.P.C. On 17.02.08 at about 5.50 p.m on<\/p>\n<p>account of animosity which arose from an incident which had<\/p>\n<p>taken place a couple of days&#8217; earlier at a Thalappoli festival in the<\/p>\n<p>locality, accused persons armed with swords and iron rods<\/p>\n<p>allegedly attacked the defacto complainant resulting in grievous<\/p>\n<p>injuries including fracture of the left radius for the defacto<\/p>\n<p>complainant.      Investigation is in progress.               The petitioners<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<p>      2.   The learned counsel for the petitioners submits that<\/p>\n<p>the petitioners are absolutely innocent.                     They are falsely<\/p>\n<p>implicated. The alleged motive is too insufficient to justify the<\/p>\n<p>alleged overt acts committed by the petitioners.                    In these<\/p>\n<p>circumstances     anticipatory       bail      may        be granted to  the<\/p>\n<p>petitioners, it is prayed.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.1514 of 2008               2<\/span><\/p>\n<p>     3.    The    learned   Public   Prosecutor       opposes   the<\/p>\n<p>application. Sufficiency of a motive is too dangerous of a criteria<\/p>\n<p>in the adjudication of culpability in criminal cases.     Culpable<\/p>\n<p>responsibility cannot be assessed on the basis of the sufficiency<\/p>\n<p>of motive. The learned Public Prosecutor submits that the more<\/p>\n<p>unreasonable a person is the less the motive necessary to<\/p>\n<p>unleash an attack on the other.           In these circumstances<\/p>\n<p>arguments advanced on the basis of the sufficiency of motive<\/p>\n<p>may not weigh with the Court, submits the learned Public<\/p>\n<p>Prosecutor .\n<\/p>\n<p>     4.    I have considered all the relevant inputs.       I shall<\/p>\n<p>carefully avoid any detailed discussion about the acceptability of<\/p>\n<p>the allegations or the credibility of the data collected. I am not<\/p>\n<p>persuaded to agree that there are any features in this case which<\/p>\n<p>can justify the invocation of the extraordinary equitable discretion<\/p>\n<p>under Section 438 Cr.P.C. This, I agree with the learned Public<\/p>\n<p>Prosecutor, is a fit case where the petitioners must appear<\/p>\n<p>before the Investigating Officer or the learned Magistrate having<\/p>\n<p>jurisdiction and then seek regular bail.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.1514 of 2008                3<\/span><\/p>\n<p>     5.
