Mr.PR Abichandani learned APP      waives<br \/>\n     service of rule on behalf of respondent No.1.\n<\/p>\n<p>     2.Heard the   learned   counsel   for   the respective<br \/>\n     parties.\n<\/p>\n<p>     3.Leaned counsel for the petitioner has submitted<br \/>\n     that the petitioner is co-accused of           the    offence<br \/>\n     registered before the Adalaj Police Station vide CR No.53<br \/>\n     of 2003 under Sections 392, 114 of Indian Penal Code and<br \/>\n     under Sec.25(1)(C) of Arms act and under Sec.135 of<br \/>\n     Bombay Police Act and during the course of investigation,<br \/>\n     petitioner and other accused have been arrested and sent<br \/>\n     in judicial custody. Thereafter the petitioner preferred<br \/>\n     Criminal Misc.Application NO.58 of 2003 before            the<br \/>\n     Sessions Court, Gandhinagar which was assigned to the<br \/>\n     learned Additional Sessions Judge, Gandhinagar who after<br \/>\n     hearing   both   the    sides,    rejected the said bail<br \/>\n     application vide order dtd.4\/4\/2003.           Hence,    this<br \/>\n     petition.   He has further submitted that at the time of<br \/>\n     the alleged incident, he was serving as security guard.<br \/>\n     He has further submitted that the amount in question is<br \/>\n     meager and nothing has       been    recovered     from   the<br \/>\n     petitioner. Submitting accordingly, he prayed to release<br \/>\n     the petitioner on bail.\n<\/p>\n<p> 4.On the other hand learned APP has vehemently<br \/>\nargued that the petitioner is habitual offender and in<br \/>\npast also the petitioner was involved in the offence<br \/>\nunder Secs.302, 397, 212 etc.       of IPC     and  under<br \/>\nSec.25(1)(C) of Arms Act was registered against the<br \/>\npetitioner before the Sarkhej Police Station vide CR<br \/>\nNo.I-250 of 2002, but the said offence the trial court<br \/>\nhas released the petitioner on bail while passing order<br \/>\nin the Criminal Misc.Application NO.375 of 2003 vide<br \/>\norder dtd.2\/4\/2003 as the petitioner was not identified<br \/>\nby any witness in the said offence. In support of his<br \/>\narguments, learned APP has drawn my attention to para 8<br \/>\nof the said order. He has further submitted that in the<br \/>\npresent case, the petitioner is identified and recovery<br \/>\nis also made from the petitioner and on the date of<br \/>\nincident, the petitioner was not in service which is<br \/>\nclear from the certificate of employer and thus there is<br \/>\nprima facie case against the petitioner. He has further<br \/>\nsubmitted that if the petitioner is released on bail, he<br \/>\nwould indulge in similar activities and he would not be<br \/>\navailable at the time of trial. Submitting accordingly,<br \/>\nhe has submitted that considering the evidence on record,<br \/>\npast antecedent of the petitioner and serioness of the<br \/>\noffence, the present petition may be rejected.\n<\/p>\n<p>5.Having heard the learned      counsel   for   the<br \/>\nrespective parties and considering the evidence on record<br \/>\nit is clear that there is prima facie case against the<br \/>\npetitioner. Further, from the certificate issued by the<br \/>\nemployer of the petitioner, it is clear that on the day<br \/>\nof the incident, the petitioner was not serving as<br \/>\nSecurity Guard under his employer, the petitioner is<br \/>\nidentified by the witnesses in the Identification Parade<br \/>\nand in past also, petitioner was involved in similar<br \/>\nserious offence.   Hence, considering the evidence on<br \/>\nrecord, past antecedent of the petitioner and gravity of<br \/>\nthe offence, the present petition is required to be<br \/>\nrejected and same is accordingly rejected.
