DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>Learned<br \/>\n\tcounsel for the applicant submitted that the applicant is the shop<br \/>\n\towner, who is facing allegations of divesting essential commodities<br \/>\n\tallotted to him for distribution to holders of ration cards meant<br \/>\n\tfor below poverty line members and stock which is subject matter of<br \/>\n\tthe complaint is already seized by the authority and ration shop is<br \/>\n\talso sealed and the applicant is ready to  hand over the relevant<br \/>\n\tregisters, if needed.  It is further submitted that co-accused has<br \/>\n\tbeen granted anticipatory bail by this Court.  It is further<br \/>\n\tsubmitted that the applicant has roots in the society, will not flee<br \/>\n\tfrom justice and will cooperate with the investigation as and when<br \/>\n\tcalled for. It is further submitted that in view of the above, the<br \/>\n\tapplicant may be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tLearned APP for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences, without discussing the evidence<br \/>\n\tin detail, at this stage, I am inclined to grant anticipatory bail<br \/>\n\tto the applicant.    This Court has also taken into consideration<br \/>\n\tthe law laid down by the Apex Court in the case of <a href=\"\/doc\/1108032\/\">Siddharam<br \/>\n\tSatlingappa Mhetre v. State of Maharashtra &amp; Ors. Reported<\/a> in<br \/>\n\t[2011]1 SCC 694, wherein the Apex Court reiterated the law<br \/>\n\tlaid down by the Constitutional Bench in the case of Shri<br \/>\n\tGurubaksh Singh Sibbia &amp; Ors. Reported in [1980]2 SCC 565.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tCR No.II-87\/2011 with B Division Police Station, Godhra City, Dist.<br \/>\n\tPanchmahals, the applicant shall be released on bail on furnishing a<br \/>\n\tbond of Rs.10,000\/- (Rupees Ten Thousand only) with one surety of<br \/>\n\tlike amount on following conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make himself \tavailable \tfor<br \/>\n\tinterrogation whenever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at concerned Police Station on  29.7.2011 between<br \/>\n11:00 am to 2:00 pm:\n<\/p>\n<p>[c]\tshall not<br \/>\nhamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall at<br \/>\nthe time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e] \twill not<br \/>\nleave India without the permission of the Court and, if is holding a<br \/>\nPassport, shall surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>[f]\tIt would be<br \/>\nopen to the Investigating Officer to file an application for remand,<br \/>\nif he considers it just and proper and the concerned Magistrate would<br \/>\ndecide it on merits;\n<\/p>\n<p>[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicant. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the prima<br \/>\n\tfacie observations made by this Court while enlarging the applicant<br \/>\n\ton bail.\n<\/p>\n<p>\tRule<br \/>\nmade absolute. Application is disposed of accordingly.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>(ANANT<br \/>\nS.
