V reach Chitiadurga, near Madanayakanahally on N.H.4<\/p>\n
road, the driver of Toyota Car bearing registration No.
\nRJ27\/IC\/7082 came in a rash and negligent manner<\/p>\n
and dashed against his motor cycle. As <\/p>\n
Claimant fell down and stistairaed Injuries’.-._ Henee he <\/p>\n
filed a claim petition before tihlel ‘l\\z’I’A_C’I_’, -:<\/p>\n
seeking compensation of Rs.3,8l0.000\/\u00ab.  “i”rtbii11al’–..p<\/p>\n

\nCompensation awarded by the Tribunal is
\njiist and proper or does it call for<\/p>\n
A’ ‘   enhancement?\n<\/p>\n
 it After hearing the learned Counsel for the parties<\/p>\n
 and perusing the award of the Triburial. I am of the<\/p>\n
View that the Compensation awarded by the Tribunai is
\nnot just and proper, it is on the lower side and therefore<\/p>\n
it is deserved to be enhanced.\n<\/p>\n

\nnot estahlisherd producing document or<\/p>\n
examininguthendaileged contractor. In the absence of<\/p>\n
 proof  income, his income is assessed at Rs.3,000\/~<\/p>\n
 VAV.t;'N'ature of injuries suggest, he must have<\/p>\n
been  rest and treatment for three months.<\/p>\n
  Therefore. a sum of Rs.9,000\/– is awarded towards toss<\/p>\n
 during iaid up period.\n<\/p>\n<\/p>\n
12. Considering nature of injuries, disability stated by<\/p>\n
the doctor and an amount of ciiscornfor\ufb01epand<\/p>\n
unhappiness which he has to undergo for the <\/p>\n
life, Rs.2,000\/ — awarded by the Tribunal.pt_olw:ardls’~ll    <\/p>\n
Comforts is on the lower side arid it \u00abjs”\u00ab_de’ser:veVd__to_be<\/p>\n
enhaneed and 1 award Rs.l5,40OlO’\/~ to}infarrl’sA’ <\/p>\n
amenities and future tinhappiness.<\/p>\n
13. Claimant is    Multiplier
\napplicable to l1:i’s__age::’   is assessed
\nat Rs.3,0\u20ac{)U:ljl~.–._V    stated he has

\neapaeity riburral at 10% is just and<\/p>\n
