Petitioner(s)\n \n\nVersus\n \n\nNAIMISH\nCO OP HOUSING SOCIETY - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nMB GANDHI for\nPetitioner(s) : 1, \nMR VIJAY H PATEL for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/03\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tpetitioner has preferred the petition for challenging the order<br \/>\n\tpassed by the Board of Nominees, and its confirmation thereof by the<br \/>\n\ttribunal whereby it is held that the learned Board of Nominees has<br \/>\n\tno jurisdiction for examining the legality and validity of the<br \/>\n\tresolution of the society for expulsion under Section 36 of the<br \/>\n\tGujarat Cooperative Societies Act (hereinafter referred as to the<br \/>\n\t&#8216;Act&#8217;).\n<\/p>\n<p>Heard<br \/>\n\tMr. Gandhi learned Counsel for the petitioner, Mr. Vijay Patel<br \/>\n\tlearned Counsel for the respondent society.\n<\/p>\n<p>After<br \/>\n\tsome arguments, learned Counsel appearing for both the sides under<br \/>\n\tthe instruction of their clients are on agreement on the following<br \/>\n\taspects:\n<\/p>\n<p>1.<br \/>\n\tIf the petitioner pays the total amount of Rs. 75,000\/- towards<br \/>\n\toutstanding dues including penal interest, and the cost of the<br \/>\n\tlitigation to the respondent society within a period of three<br \/>\n\tmonths, in monthly installments of Rs. 25,000\/- of each, and the<br \/>\n\tfirst installment shall become due on 30.04.2008, the society is not<br \/>\n\tdesire to expel the petitioner as the member by implementation of<br \/>\n\tthe resolution, which is subject matter of the challenge in the suit<br \/>\n\tproceedings.\n<\/p>\n<p>2.<br \/>\n\tIt is also agreed that if the petitioner makes payment of Rs.<br \/>\n\t75,000\/- within the aforesaid three months by installments, after<br \/>\n\tfull payment is received, the society shall issue No Due Certificate<br \/>\n\tand shall also issue duplicate share certificate, if it is so<br \/>\n\tdesired by the petitioner, after payment of the cost for the<br \/>\n\tformality to be undertaken.\n<\/p>\n<p>3.<br \/>\n\tThe petitioner is also ready to file undertaking to this Court for<br \/>\n\tpayment of Rs. 75,000\/-.\n<\/p>\n<p>4.<br \/>\n\t After payment of Rs. 75,000\/- and after issuance of No Due<br \/>\n\tCertificate, whole dispute shall stand settled, which was subject<br \/>\n\tmatter of the Lavad Suit No. 3424 of 1989.\n<\/p>\n<p>Considering<br \/>\n\tthe above, as such it appears that in view of the decision of the<br \/>\n\tCourt in case of <a href=\"\/doc\/496611\/\">Gordhabhai N Vaghela v. Maruti Co-op. Housing<br \/>\n\tSociety and Ors.<\/a> reported at 2003 ((1) GLH page 117 the<br \/>\n\texpulsion is only by way of last resort and society should consider<br \/>\n\tthe aspect of recovery of the amount by giving opportunity of<br \/>\n\thearing to the person concerned to pay up the amount etc. Further,<br \/>\n\tas per the view taken by this Court in case of <a href=\"\/doc\/869262\/\">Arjunbhai K<br \/>\n\tVegda V. Tejvir Park Co-Op. Housing Society Ltd. and<\/a> ors reported at<br \/>\n\t2002 (4) GLR 3026, until<br \/>\n\tthere is valid resolution of 3\/4th majority, and the<br \/>\n\tproposal submitted to the Registrar for approval, it cannot be said<br \/>\n\tthe Board of Nominees has inherent lack of jurisdiction. No further<br \/>\n\tobservations are required to be made, since learned Counsel<br \/>\n\tappearing for both the sides have agreed to settle the dispute<br \/>\n\tbetween the members of the society and the society. Further, it also<br \/>\n\tappears that the member has shown willingness to pay outstanding<br \/>\n\tdues and the cost of the litigation  and the society has also<br \/>\n\tpositively responded to the same and the matter is amicably settled.<br \/>\n\tTherefore, it would be just and proper to permit the petitioner and<br \/>\n\tthe respondent society to settle the dispute by putting an end to<br \/>\n\tthe litigation and for also putting an end for action for expulsion<br \/>\n\tof the members.\n<\/p>\n<p>\tHence,<br \/>\n\tit is ordered as under:\n<\/p>\n<p>\ta)<br \/>\n\tThe petitioner shall pay the amount of Rs. 75,000\/- to the<br \/>\n\trespondent society toward all outstanding dues and the cost of<br \/>\n\tlitigation in three installments of Rs. 25,000\/-, each payable every<br \/>\n\tmonth and the first installment shall become due on 30.04.2008; the<br \/>\n\tsecond on 31.05.2008; and the third on 30.06.2008.\n<\/p>\n<p>\tb)<br \/>\n\tThe petitioner shall also file an undertaking to the Court for<br \/>\n\tpayment of the amount as per the declaration made before this Court<br \/>\n\tand such undertaking shall be filed within two weeks from today.\n<\/p>\n<p>\tc)<br \/>\n\tAfter the payment of the aforesaid amount of Rs. 75,000\/-, within<br \/>\n\tone week, the society issue No Due Certificate to the petitioner.\n<\/p>\n<p>\td)<br \/>\n\tUpon compliance to condition of the payment of the aforesaid amount<br \/>\n\tof Rs. 75,000\/-, the action for expulsion of the petitioner, which<br \/>\n\twas subject matter of the suit, would not survive and the dispute<br \/>\n\tshall stand concluded upon payment of Rs. 75,000\/-\n<\/p>\n<p>The<br \/>\n\tpetition is disposed of in terms of the aforesaid directions. Rule<br \/>\n\tmade absolute accordingly.
