Zubin Jayendrabhai Asra as well as the injured<br \/>\n\tperson viz. Kishorbhai Chhaganbhai Patel have filed affidavits<br \/>\n\tbefore this Court stating that because of intervention of senior<br \/>\n\tpersons and other officers of the University, the matter has been<br \/>\n\tcompromised and accordingly there is no ill-will or dispute between<br \/>\n\tthe parties. It is accordingly stated in the affidavit that the<br \/>\n\tcomplaint in question be quashed in the interest of justice.\n<\/p>\n<p>Ms.Shilpa<br \/>\n\tShah, learned Advocate for the petitioners has submitted that in<br \/>\n\tview of the fact that the parties have amicably settled the dispute<br \/>\n\tbetween them, continuation of investigation would amount an abuse of<br \/>\n\tthe process of Court.\n<\/p>\n<p>Mr.Ashish<br \/>\n\tDagli, learned Advocate for respondent No.2- original complainant<br \/>\n\thas reiterated what is stated by the learned Advocate for the<br \/>\n\tpetitioners. It is submitted that in view of the affidavit filed by<br \/>\n\tthe complainant and the injured person wherein it is categorically<br \/>\n\tstated that subsequent to the lodging of the First Information<br \/>\n\tReport in question, a compromise has been arrived at recently and<br \/>\n\tthere is no ill-will or dispute between the parties, the complaint<br \/>\n\tbe quashed in the interest of justice.\n<\/p>\n<p>It<br \/>\n\tis settled legal position as held by the Apex Court as well as this<br \/>\n\tCourt and other High Courts that this Court can, on the facts and<br \/>\n\tcircumstances of a case, if it so deems fit, quash the complaint<br \/>\n\teven if the offences are non-compoundable. Looking to the nature of<br \/>\n\tthe allegations made in the present complaint as well as looking to<br \/>\n\tthe fact that the parties have amicably settled the matter, in the<br \/>\n\topinion of this Court continuation of the proceedings would amount<br \/>\n\tto an abuse of the process of Court. Besides, in view of the<br \/>\n\tamicable settlement arrived at between the parties, chances of an<br \/>\n\tultimate conviction are also bleak. In the circumstances, the<br \/>\n\tinterest of justice would best be served if the complaint in<br \/>\n\tquestion is quashed. This is, therefore, a fit case for exercise of<br \/>\n\tinherent powers under Section 482 of the Code.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application succeeds and is, accordingly,<br \/>\n\tallowed.
