APPEAL NO.405\/97\n            (National Insurance Co. vs. Amba Bai &amp; Ors.)\n                   DATE OF ORDER : 6\/8\/2009\n\n            HON'BLE DR.JUSTICE VINEET KOTHARI\n\n\nMr.Sanjeev Johari, for the appellant.\n\n\n      This appeal has been filed by the Insurance Company\n\naggrieved by the award dated 29\/6\/1996 in MACT Case no.18\/93\n\n(Amba Bai w\/o Shanker Lal &amp; Ors.). The only point pressed by the\n\nlearned counsel for the appellant Insurance Company is that the\n\ncompensation in question is excessive and that deceased Shambhu\n\nSingh himself was negligent in driving his scooter and accident took\n\nplace in the middle of the road with the jeep in question.\n\n\n\n      Learned counsel for the appellant insurance company fairly\n\nsubmits that since they have not applied or taken permission under\n\nSection 170 of the Act from the learned Tribunal, the quantum of\n\ncompensation cannot be challenged by the appellant insurance\n\ncompany in view of the provisions of Section 149 of the Act.\n\nHowever, he submits that on the question of negligence of the scooter\n\nrider - deceased Shambhu Singh, the findings of the learned Tribunal\n\nare incorrect.\n                                    2\/3\n\n\n\n\n      Having heard learned counsel and upon perusal of the findings\n\nof learned Tribunal, this Court is satisfied that there is no force in the\n\npresent appeal of the Insurance company. Learned Tribunal has found\n\nthat the jeep no. RJ-3C-104 was being driven by the driver in rash\n\nand negligent manner and the witness P.W.3 - Mahendra has stated\n\nbefore the Tribunal that despite being told, the said driver while\n\novertaking another truck hit the scooter coming from opposite side\n\nand consequently the driver of the said scooter - deceased fell down\n\nand suffered injuries and ultimately died.\n\n\n\n      From the said findings and site map it does not appear that\n\nthere was any negligence on the part of scooter rider and\n\nconsequently the findings of the learned Tribunal cannot be said to be\n\nincorrect or perverse in any manner.\n\n\n\n      As far as quantum of compensation is concerned, firstly the\n\ninsurance company is not entitled to challenge the same in the\n\nabsence of prior leave granted by the learned Tribunal in this regard\n\nunder Section 170 of the Act and even otherwise the quantum of\n\ncompensation of Rs.3,50,000\/- on account of death of young person\n                                   3\/3\n\nof 34 years of age, who was employed at G.S.Industries cannot be\n\nsaid to be excessive and the learned Tribunal has considered the\n\nrelevant evidence while awarding said compensation in favour of\n\nclaimant.\n\n\n\n      In view of above, there is no ground in the present appeal to\n\ninterfere with the impugned award. The appeal being devoid of merit\n\nis accordingly dismissed.
