       Revision petitioner, the accused in C.C.No.643 of 1996 on<\/p>\n
the file of Judicial First Class Magistrate Court-I, Cherthala, was<\/p>\n
convicted and sentenced for the offence under Section 55 (a) of<\/p>\n
Abkari Act. Though petitioner challenged the conviction and<\/p>\n
sentence before Sessions Court, Alapuzha in Criminal Appeal<\/p>\n
No.100 of 2001, the learned Sessions Judge, on re-appreciation<\/p>\n
of   evidence, confirmed the conviction and sentence and<\/p>\n
dismissed the appeal. It is challenged in the revision.<\/p>\n
      2. When the revision was taken up, there was no<\/p>\n
representation for the counsel appearing for appellant.         The<\/p>\n
learned Public Prosecutor was heard.\n<\/p>\n
   3. Prosecution case is that PW5, the Sub Inspector of Police,<\/p>\n
while    on patrol duty, got information that illicit arrack is<\/p>\n
manufactured in the house of Solaman (the petitioner).          He<\/p>\n
along with PW4, the Head Constable, and police party reached<\/p>\n
House No.10\/353 of Thuravoor Panchayath where petitioner is<\/p>\n
residing with his family. Finding      the police party, petitioner<\/p>\n

ran away. When PW5 entered the house, it was found that on<\/p>\n
the north eastern corner of the house 750 ml of illicit liquor was<\/p>\n
kept for the purpose of sale. In the presence of PWs. 1 and 2, it<\/p>\n
was seized and Crime No. 115 of 1994 for offence under Section<\/p>\n
55(a) of Kerala Abkari Act was registered at 8.15 PM on 7.6.1994.<\/p>\n
PW5 sent MO1, the illicit arrack      seized along with Ext.P1, to<\/p>\n
Excise Office.        PW3, the then Excise Inspector, on receipt of<\/p>\n
Ext.P3, conducted investigation and prepared a crime occurrence<\/p>\n
report and thereafter laid the charge before the learned<\/p>\n
Magistrate which was taken cognizance.\n<\/p>\n
      4. Petitioner pleaded not guilty. Prosecution examined PWs.<\/p>\n
1 to 5 and marked Exts. P1 to P3 and identified MO1. The learned<\/p>\n
Magistrate on the evidence found the petitioner guilty. He was<\/p>\n
convicted and sentenced to simple imprisonment for 6 months<\/p>\n
and a fine of Rs.5,000\/- and in default, simple imprisonment for 6<\/p>\n
months for offence under Section 55(a)        of Abkari Act.   The<\/p>\n
learned Sessions Judge, in criminal appeal, on re-appreciation of<\/p>\n
evidence,       accepted the evidence of PWs. 1 and 2 with the<\/p>\n
evidence of PWs. 4 and 5 and held that MO1 was seized from the<\/p>\n
house of petitioner and finding PW5 and police party, petitioner<\/p>\n
ran away and, therefore, could not be arrested. Based on the<\/p>\n

evidence of PWs. 4 and 5 that on smelling and tasting the liquid<\/p>\n
they were satisfied that it is illicit arrack and based on Ext.P2<\/p>\n
report of the chemical analysis, it was held that it is illicit arrack.<\/p>\n
Petitioner was convicted.\n<\/p>\n
        5. The evidence of PW5 only shows that he seized a 750 ml<\/p>\n
bottle from house No.10 of 353 of Thuravoor Panchayath and<\/p>\n
also prepared Ext.P1 mahazar and on return back to the police<\/p>\n
station under Ext.P3 FIR, registered the case and on the next day,<\/p>\n
FIR along with the seized bottle was sent to the Excise Office.<\/p>\n
PW5 did not produce MO1 before the court. In cross examination,<\/p>\n
PW5 deposed that he had sent the seized bottle of illicit arrack<\/p>\n
to the Excise Office. PW3, the Excise Inspector, deposed that he<\/p>\n
registered a crime and sent an occurrence report, which is not<\/p>\n
seen marked, and thereafter investigated the case. PW3 has no<\/p>\n
case that he produced the seized article before the court. In<\/p>\n
cross examination, PW3 was questioned who produced MO1<\/p>\n
before the court. He said he cannot say. Thereafter, he added<\/p>\n
that it was produced by PW5, the Sub Inspector. The evidence of<\/p>\n
PW5 contradicted with evidence of PW3. Whatever it be, there<\/p>\n
is no evidence as to when MO1 was produced in court and who<\/p>\n
produced MO1. A property list is seen among records which does<\/p>\n

not show the date of production and when it was produced and<\/p>\n
when it was prepared or when it was submitted before the court.<\/p>\n
Though there is court seal, that also did not show the date.<\/p>\n
Therefore, based on that property list also, it is not possible to<\/p>\n
find when exactly MO1 reached the court.        From the records it<\/p>\n
can be seen that a requisition form signed by PW5 was produced<\/p>\n
before the court to send the sample to the Chemical Laboratory<\/p>\n
for chemical analysis. Column No.4 therein is the list of articles<\/p>\n
forwarded. The entry is “one sealed bottle containing 180 ml of<\/p>\n
sample of ID in crime No. 87 of 1994 of Kuthiyathode range”.<\/p>\n
What is produced as per the property list is 750 ml of illicit arrack<\/p>\n
in one bottle. The requisition forum does not contain any request<\/p>\n
to the court to prepare sample. The property list contains entry<\/p>\n
indicating that as per the order of the Junior Superintendent that<\/p>\n
the property is entered as TR 85 \/96. If that be so, it can only be<\/p>\n
found that MO1 reached the court in 1996 though it was seized<\/p>\n
on 7.6.1994.\n<\/p>\n
        6. Ext.P1 seizure mahazar does not show that the bottle<\/p>\n
was sealed at the time of seizure. The evidence of PW5 also does<\/p>\n
not show that PW5 sealed the bottle when it was seized under<\/p>\n
Ext.P1, or immediately thereafter.        Therefore, even if the<\/p>\n

evidence of PW5 is accepted as such, it would only show that a<\/p>\n
7.50 ml bottle was seized from house No.10\/353 and he sent it to<\/p>\n
the Excise Department on 8.6.1994. Though the property list is<\/p>\n
signed by PW1 indicating that he produced the seized bottle<\/p>\n
before the court, evidence of PW3 is that he did not produce it.<\/p>\n
There is no evidence as to who was in custody of the article from<\/p>\n
8.6.1994 till it was produced in 1996. In such circumstances,<\/p>\n
when there is no evidence that the bottle was sealed and there is<\/p>\n
no evidence as to         who had taken the sample which was<\/p>\n
examined in laboratory to forward Ext.P2 report, based on Ext.P2<\/p>\n
report, it cannot be found that MO1 contains illicit arrack. Though<\/p>\n
PWs. 4 and 5 deposed by tasting and smelling that it was illicit<\/p>\n
arrack, based on that evidence alone, it is not possible to hold<\/p>\n
that it was illicit arrack. If that be so, conviction of the petitioner<\/p>\n
can only be set aside finding that prosecution did not establish<\/p>\n
the petitioner committed an offence under Section 55(a) of Abkari<\/p>\n
Act. Even if it is accepted, the offence will not come under Section<\/p>\n
55(a) in view of the decisions of the Division Bench of this Court<\/p>\n
in Surendran V. Excise Inspector<\/a> (2004 (1) KLT 404) and<\/p>\n
Mohanan V. State of Kerala<\/a> (2004 (1) KLT 845). In such<\/p>\n
circumstances, conviction is to be set aside. Revision is allowed.<\/p>\n

Conviction and sentence of the petitioner in CC.No.643 of 1986<\/p>\n
by Judicial First Class Magistrate-I, Cherthala is set aside. He is<\/p>\n
found not guilty of the offence. He is acquitted.<\/p>\n
