I.D. No. Nil Dated 18-06-<br \/>\n2007. (Appeal No. 301 dated 16-08-2007) Sheri Harish Kumar vs. PIO DC (City Zone).<br \/>\nThat give the information about the work of central burs Pilli Kothi to Pull Mithai chowk.<br \/>\nGive the attested photocopy of the document No. EE-II\/TC-II\/2005-06\/04, dt. 19-05-2005.&amp;<br \/>\nEE-II\/TC-II\/2005-06\/502, dt. 13-03-2006. Dindayal Center Prices&#8217; has not been started our<br \/>\nwork with respect to their commitment. Pl do the particular describe that how and when will<br \/>\nbe done work started.\n<\/p>\n<p>The Appellant did not receive any reply from the PIO, hence he filed a first appeal. The First<br \/>\nappellate authority Mr. H.B. Sharma Add. Comm. (Gen. and CSD) recognized that<br \/>\ninformation had not been provided and passed strictures in his order of 16\/08\/2007. He<br \/>\ndirected the PIO to supply the information within 15 days to avoid further complication like<br \/>\npenalty and disciplinary action under Section 19 of RTI Act.<br \/>\nYet the PIO took no action hence the second appeal.<br \/>\nRelevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. Harish Kumar<br \/>\nRespondent: Mr. Anil Wasan and Mr. KR.P.Kohli Ex. Engr. Woks, representing the<br \/>\n               PIO Mr. Vijay Singh<br \/>\n The respondents were asked why the information was not provided in the 30 day period. It<br \/>\nwas further pointed out to them that even after the First appellate Authority&#8217;s order, the PIO<br \/>\nhad not obeyed his senior officer&#8217;s orders. There is no explanation for this dereliction of duty.<br \/>\nThe appellant informs us that he received the information on 12\/02\/2008.<br \/>\nDecision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>The information has already been provided and therefore the matter before us is of<br \/>\nimposing penalty.\n<\/p>\n<p>From the evidence before us it appears that the PIO did not provide any reply to the RTI<br \/>\napplication of the appellant. Further he refused to follow the orders of the First appellate<br \/>\nauthority. The PIO Mr. Vijay Singh appears to have violated the provisions of the RTI act.<br \/>\nIt is apparent from the facts before us that Mr. Vijay Singh, PIO has violated the law by not<br \/>\nfurnishing the complete information and has disregarded the orders of the First Appellate<br \/>\nAuthority,-who is also an officer senior to him in the Public authority.<br \/>\nFrom the facts before the Commission it is apparent that the PIO, Mr. Vijay Singh is guilty of<br \/>\nnot furnishing information within the time mandated under the RTI act. He has further<br \/>\nrefused to obey the orders of his superior officer, which raises a reasonable doubt that the<br \/>\ndenial of information may also be malafide. The First Appellate Authority has clearly ordered<br \/>\nthe information to be given.\n<\/p>\n<p>It appears that the PIO Mr. Vijay Singh&#8217;s actions attract the penal provisions of Section 20<br \/>\n(1) .\n<\/p>\n<p>A showcause notice is being issued to him, and he is directed to present himself before the<br \/>\nCommission to show cause why penalty should not be levied on him.
