Jain<\/p>\n<p> Respondents : Central Excise, Bangalore-III<\/p>\n<p>      This matter was heard partly through videoconferencing (VC) on<br \/>\n23.02.2010 in the presence of both parties. Appellant was present in<br \/>\nperson at CIC&#8217;s New Delhi office. Respondents \u23af represented by<br \/>\nShri K. Kesavan, Additional Commissioner of Central Excise \u23af were<br \/>\npresent at NIC VC facility at Bangalore. Commission conducted the<br \/>\nhearing from its New Delhi office.\n<\/p>\n<p>2.     Through his RTI-application dated 07\/19.09.209, appellant<br \/>\nrequested CPIO, Shri B. Kumar, for information relating to receipt and<br \/>\ndisposal of RTI-applications, pendency of the RTI-applications as on<br \/>\ndate, response to the applications \u23af fully or partly along with details of<br \/>\nthe applicants, their addresses, dates, brief subject; monthly and yearly<br \/>\nstatements and statistics of these applications submitted by the public<br \/>\nauthority to their higher authorities and an inspection of records and<br \/>\nfiles thereto.\n<\/p>\n<p>3.    CPIO, through his reply dated 25.09.2009 and the Appellate<br \/>\nAuthority, through his order dated 10.11.2009, declined to disclose this<br \/>\ninformation mainly on the ground that its disclosure was unlikely to<br \/>\nserve any public interest if it were provided in the form in which it was<br \/>\nsought. Apart from this, the disclosure was likely to disproportionately<br \/>\ndivert the resources of the public authority. Appellate Authority&#8217;s<br \/>\norder also spoke about appellant being allowed to inspect the records<br \/>\nheld by the public authority to cull from it such information as he<br \/>\nwished to have.\n<\/p>\n<p>4.    Appellant made the point that he was not obliged to explain to<br \/>\nthe respondents why he wanted the above information. He stated that<br \/>\nthe respondents have no more than 70-odd files from which the<br \/>\nrequested information could be provided not by generating an<br \/>\ninformation, but through the simple process of giving to him copies of<br \/>\nthe various applicants&#8217; RTI-applications in these files, the CPIO&#8217;s<br \/>\ncommunications to these applications, the first-appeals as filed before<br \/>\nAT-26022010-07.doc<br \/>\n<span class=\"hidden_text\">                                                               Page 1 of 2<\/span><br \/>\n the Appellate Authority by these parties and the orders of the Appellate<br \/>\nAuthority thereto. These are clearly identifiable documents and<br \/>\nphotocopying these for provision to the appellant could not be<br \/>\nexaggerated as an enormous task which would divert the resources of<br \/>\nthe public authority.\n<\/p>\n<p>5.    Appellant further pointed out that he wished to receive<br \/>\ninformation pertaining to the processing of RTI-applications by the<br \/>\npublic authorities \u23af both the primary and the first-appellate levels \u23af<br \/>\nbecause he had noticed certain divergence between the information<br \/>\nfurnished by such public authorities to their Ministries and head offices<br \/>\nfrom where it was transmitted to the CIC, and the actual facts about<br \/>\nthese RTI-proceedings at the public authority levels.\n<\/p>\n<p>6.     I am not persuaded by the CPIO&#8217;s argument about diversion of<br \/>\nresources if this information were to be provided to the appellant. As<br \/>\nrightly pointed out by the appellant, the numbers of the files were not<br \/>\nextraordinarily large. Asking the officers to take out copies of select<br \/>\ndocuments from these 70-odd files could not amount to asking too<br \/>\nmuch.\n<\/p>\n<p>7.    When the matter was put to the CPIO during hearing, he agreed<br \/>\nthat the requested documents could be provided to the appellant on his<br \/>\nagreeing to pay the requisite fees under RTI Rules.\n<\/p>\n<p>8.    It is accordingly directed that within three weeks of the receipt<br \/>\nof this order, CPIO should provide to the appellant copies of the<br \/>\ndocuments mentioned in paragraph 4 above on receipt of the requisite<br \/>\nfee from the appellant.\n<\/p>\n<p>9.     Appeal allowed.\n<\/p>\n<p>10.    Copy of this direction be sent to the parties.\n<\/p>\n<p>                                                         ( A.N.
