The matter requires<br \/>\nconsideration.\n<\/p>\n<p>2.\t RULE.\n<\/p>\n<p> Mr.Harin P.Raval, learned Assistant Solicitor General of India,<br \/>\nwaives service of Rule on behalf of respondent No.1.  Learned<br \/>\nadvocate Mr.Nair waives service of Rule on behalf of respondent No.2<br \/>\n?  Bank of Baroda.\n<\/p>\n<p>3.\tThe petitioner,<br \/>\ninitially, challenged the action of issuing sale proclamation issued<br \/>\nby the Recovery Officer-II, Debts Recovery Officer-II, Ahmedabad.<br \/>\nThereafter, a draft amendment was moved and order passed by the<br \/>\nRecovery Officer-I, Debts Recovery Tribunal-II, Ahmedabad below<br \/>\nExh.T\/66 is also challenged.\n<\/p>\n<p>4.\tThe short question<br \/>\ninvolved in the matter is as to whether the immovable properties of<br \/>\nthe guarantor, which were not mortgaged, could have been included in<br \/>\nthe sale proclamation.  The subsequent question which arises for<br \/>\nconsideration is as to whether the immovable properties, which are in<br \/>\nthe name of the family members of the guarantor, could be the subject<br \/>\nmatter of sale proclamation.\n<\/p>\n<p>5.\tMr.Nair, learned<br \/>\nadvocate for respondent No.3 ?  Bank vehemently submitted that the<br \/>\nrevenue entries do not decide ownership of the property.\n<\/p>\n<p>\tTaking it as an<br \/>\nabstract proposition of law, there cannot be any dispute about it,<br \/>\nbut then, in the present case, the facts and the law is required to<br \/>\nbe examined by the authority while passing order on Exh.T\/66.\n<\/p>\n<p>6.\tWithout prejudice<br \/>\nto the rights and contentions of both the sites, order dated<br \/>\n22.02.2008 passed below Exh.T\/66 in R.P.No.156 is quashed and set<br \/>\naside.  The authority is directed to decide the same afresh after<br \/>\ngiving full opportunity to both the sides to present their case,<br \/>\nsupporting the same with the decisions of the Hon&#8217;ble the Apex Court.\n<\/p>\n<p>\tLooking to the age of<br \/>\nthe matter, it is directed that the parties shall appear before the<br \/>\nauthority initially on 11.08.2008.  The authority will then fixed its<br \/>\nown time table for hearing of the matter, giving due priority to<br \/>\ndecide the same as expeditiously as possible, preferably within 3<br \/>\nmonths from the date of the first date of hearing.\n<\/p>\n<p>7.\tWith these<br \/>\ndirections, the petitions are disposed of.
