accident, negligence and liabilityigof  <\/p>\n
offending vehicle the only ‘point’-that  <\/p>\n
consideration is:\n<\/p>\n

5. After” Counsel appearing for<\/p>\n
the parties’anhci-perusing judgment and award of the<\/p>\n
  amfofv-….the View that the compensation<\/p>\n
Tribunal is not just and reasonable, it<\/p>\n
is.onl”%the_l side and therefore it is deserved to be<\/p>\n
i V enhanced;\n<\/p>\n
if  ‘ The claimant has sustained fracture of left hip<\/p>\n
..ifl’.’e2″fposing torn muscles and fracture of left femur at<\/p>\n
fatmipper third and four others simple injuries. Injuries<\/p>\n

\nP 7, disability certificate Ex. P 8 , OP Card Ex P 9, case<\/p>\n
sheet Ex. P 54, X–rays Ex. P 55 & P 56 and supported<\/p>\n
by order evidence of the claimant and the<\/p>\n
examined as PWs 1 and 2 respectively.   it<\/p>\n
Sudarshan Bhandary has stated’ that he  <\/p>\n
claimant by way of wound debridement <\/p>\n
done on 10.12.2004 and intefriocldvng._Vn’aciling.]of left
\nfemur with skin grafting  Vsdone~._pon l3.1″2.2004.
\nAccording to him after 3   again
\nwent to their examination
\nhe found there”Ti’syishoifteiairig-P of 1 cm of the affected<\/p>\n
limb, movements”are.lrestricted to 100 decree of \ufb02exion<\/p>\n
 and. ‘to pain femur and thigh the claimant is<\/p>\n
unable  walk properly and to sit with crossed<\/p>\n
legs.'”Thereffisipennanent functional impairment of left<\/p>\n
 lower limb to the extent of 15%.\n<\/p>\n
 *=._AConsidering the nature of injuries, $10,000\/–<\/p>\n
awarded by the Tribunal towards pain and suffering is<\/p>\n
if  the lower side and it is deserved to be enhanced by<\/p>\n

another sum of $20,000\/– and I award ?.30,000\/-<\/p>\n
under this head.\n<\/p>\n
8. The claimant has produced medical bills Ex.  53<\/p>\n
amounting to ?’.48,759\/–. Therefore the Tribuna,’ixi_s-\u00ab\u00abn’st<\/p>\n
justified in awarding only 348,000\/– towards  *<\/p>\n
expenses and hence I award,~?..5C),C\u00a7_ClC)d[%’::.7; ‘A2<\/p>\n
medical and hospital expenses. 2<\/p>\n
9. The claimant was in-p_:atientA”‘in   ” ‘<\/p>\n
Mangaiore for about  days”; :\ufb02:Co’nsidering..the same<\/p>\n
?.18,000\/- awarded th_e  incidental<\/p>\n
expenses ._sucl”i~.’*as* _co1_iVey’aince, nourishment and<\/p>\n
attendant”rc_ha.rgVes   the lower side and 1 award<\/p>\n
 _ ?.23,QClO’;’– underdithispihead.<\/p>\n
 .10; The, -claimant claims to have been earning<\/p>\n
 mason work, but the same is not<\/p>\n
–V estahlished’4′.Vby producing any document. In the<\/p>\n
 ‘2..f*a.bsenceV”of proof of income the Tribunal has rightly<\/p>\n
 assessed his income at \u20ac3,000\/– pm. He was treated<\/p>\n
 as inpatient in the hospital for 18 days. Considering<\/p>\n

the same he must have been under treatment and rest<\/p>\n
for four months and I award 1″. 12,000\/– towards loss of<\/p>\n
income during laid up period as against<\/p>\n
awarded by the Tribunal.\n<\/p>\n
11. Considering the nature of  the” <\/p>\n
stated by the doctor and anV._ap”rr;ount”   and
\nunhappiness he has  to  .hi’s’:vfL1ture life
\n?.10,000\/~ awarded  \ufb02towards loss of
\namenities is onthe lower   ?.20,000\/-\n<\/p>\n
under this       i <\/p>\n
12. The  is.H”aged.’ about 19 years. The<\/p>\n
multiplier ~applieable..Vto.4liis\u00e9age group is 18. The doctor<\/p>\n
_ has assessed permanent functional impairment of left<\/p>\n
  loiwerj\u00e9vxlimb at 15%. Therefore the Tribunal has<\/p>\n
rightly  functional disability at 10% and<\/p>\n
