In this group of petitions, the<br \/>\n\tpetitioners have challenged the notice dated 04.01.2010 (Page &#8211;\n<\/p>\n<p>\t14) issued by the Special Recovery Officer, the Gujarat State<br \/>\n\tCo-operative Housing Finance Corporation Limited, Ahmedabad for<br \/>\n\tattaching and auctioning the property of the petitioners mentioned<br \/>\n\tthereunder, which is said to be outstanding dues and remained unpaid<br \/>\n\tsince long.\n<\/p>\n<p>The<br \/>\n\tpetitioners, who happened to be members of one Laxmi Apartment<br \/>\n\tCo-operative Housing Society Limited had taken respective loan and<br \/>\n\tthe loan remained unpaid. Appropriate proceedings before competent<br \/>\n\tCourts were taken. The petitioners have submitted that the society<br \/>\n\twas ordered to be wound-up under Section 107 of the Gujarat<br \/>\n\tCo-operative Societies Act, 1961 and the winding-up orders were made<br \/>\n\tlong-back and the proceedings of the winding-up were to be treated<br \/>\n\tto have been concluded within seven years. As per the statutory<br \/>\n\tprovisions, Authority could not have issued notices for recovering<br \/>\n\tthe dues under the notice, which is impugned. This Court (Coram:<br \/>\n\tSmt.Abhilasha Kumari, J.) on 12.05.2010, issued notice relied upon<br \/>\n\tthe decision of Hon&#8217;ble Apex Court in case of Nayanaben<br \/>\n\tJashvantsinh Vihol Vs. State of Gujarat and Others reported in<br \/>\n\t2010(1) GLH Page No.538 as<br \/>\n\tthe Liquidator in question was appointed way-back in 05.11.1998 and<br \/>\n\ttherefore, the period of seven years have already been passed and<br \/>\n\texpired on 31.12.2006 and impugned notice came to be issued on<br \/>\n\t04.01.2010. Therefore, notice was issued and interim relief was<br \/>\n\tgranted, staying operation and implementation of the said notice.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioner submitted that the dues were admittedly<br \/>\n\ttime barred as on date the judgment of this Court in case of<br \/>\n\tNayanaben Jashvantsinh Vihol Vs. State of Gujarat and<br \/>\n\tOthers reported in 2010(1)<br \/>\n\tGLH Page No.538 though has been<br \/>\n\tstayed, is not overruled and<br \/>\n\tin this view of the matter, the petitions deserve to be allowed. The<br \/>\n\tlearned advocate for the petitioners submitted that petitions are<br \/>\n\trequired to be allowed and no other submission have been canvassed<br \/>\n\tin support of the prayer made in the petitions.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for respondent No.2 has taken this Court through the<br \/>\n\taffidavit-in-reply and annexures thereunder. Learned advocate for<br \/>\n\trespondent No.2 drew this Court&#8217;s attention to the fact that<br \/>\n\tpetitioners, who are members of the Laxmi Apartment Co-operative<br \/>\n\tHousing Society Limited i.e. society-in-liquidation approached this<br \/>\n\tCourt by way of Special Civil Application No.2138 of 1991 with<br \/>\n\talmost identical prayers as mentioned in affidavit-in-reply filed on<br \/>\n\tbehalf of respondent No.2 and in the said proceedings, the<br \/>\n\tpetitioners were required to file undertaking, which is also placed<br \/>\n\ton record. In this proceedings, the filing of the earlier petition<br \/>\n\tand undertaking thereunder and the disposal of the said petition has<br \/>\n\tnot been disclosed by the petitioners. Thus, petitioners have<br \/>\n\tsuppressed the material facts and obtained the interim orders in the<br \/>\n\tpresent group of petitions. Learned advocate for the respondent<br \/>\n\tfurther submitted that the earlier petition being Special Civil<br \/>\n\tApplication No.2138 of 1991 contained petitioner No.1 as heirs of<br \/>\n\tdeceased Shri Chandulal Maganlal Modi, whereas in this group of<br \/>\n\tpetitions in in Special Civil Application<br \/>\n\tNo.5998 of 2010, the name of petitioner is shown as Shri Chandulal<br \/>\n\tMaganlal and not shown as deceased nor heirs of deceased are brought<br \/>\n\ton record. It shows that petition is filed by or on behalf of<br \/>\n\tChandulal Maganlal i.e. a dead person. This should weigh against the<br \/>\n\tpetitioner under article 226 of the Constitution of India. Learned<br \/>\n\tadvocate for respondent No.2 thereafter invited this Court&#8217;s<br \/>\n\tattention to the order made by the Liquidation Officer on 22.01.2001<br \/>\n\tand submitted that based upon this order requisite certificate is<br \/>\n\tissued, which has the effect of empowering respondent No.2 for<br \/>\n\trecovering dues mentioned in the order dated 22.01.2001 as arrears<br \/>\n\tof the land revenue. Learned advocate for respondent No.2 invited<br \/>\n\tthis Court&#8217;s attention to the Gujarat Co-operative Societies Act,<br \/>\n\t1961 and contended that the debt in question, which is subject<br \/>\n\tmatter of notice impugned cannot be said to be time barred as to<br \/>\n\tallow the petitions.\n<\/p>\n<p>This<br \/>\n\tCourt has heard learned advocate for the parties and perused the<br \/>\n\tannexures and reply. The facts remained to be noticed are that the<br \/>\n\tpetitioners, members of the society had challenged the debt and<br \/>\n\ttheir liability and sought relief by way of Special Civil<br \/>\n\tApplication No.2138 of 1991. The petitioners had filed  undertaking<br \/>\n\tthat they will regularly pay installment of loan every month, which<br \/>\n\tshould not have been ignored by the petitioners. The order<br \/>\n\tdated 22.01.2001 passed by the Liquidator is enforceable as the<br \/>\n\tdecree. It was certified by the competent Authority under Section<br \/>\n\t103 of the Gujarat Co-operative Societies Act, 1961 that the order<br \/>\n\tof the Liquidator dated 22.01.2001 is sought to be implemented vide<br \/>\n\timpugned notice. Therefore, it cannot be said that it is time barred<br \/>\n\tfrom any angle and in any manner. The respondents are justified in<br \/>\n\tcontending that these petitions do not deserve to be entertained,<br \/>\n\teven on account of suppression of fact, which actually deals a<br \/>\n\tserious blow to the credibility of the petitioners. The petitioners<br \/>\n\tought to have taken sufficient care to see to it that the facts are<br \/>\n\tplaced on record and thereafter attempted to make out their case,<br \/>\n\tinstead of other way, as could be seen from the record. As mentioned<br \/>\n\tabove, petitioners have suppressed the fact of filing of earlier<br \/>\n\tpetition being Special Civil Application No.2138 of 1991 and dead<br \/>\n\tperson is shown to have filed petition, which is not proper. Suffice<br \/>\n\tit to say that Court do not entertain such petitions, when facts are<br \/>\n\tsuppressed. Therefore also judgment of  Nayanaben<br \/>\n\tJashvantsinh Vihol Vs. State of Gujarat and Others<br \/>\n\treported in 2010(1) GLH Page No.538 is<br \/>\n\tof no avail. That apart, the provision of Section 103 of the Gujarat<br \/>\n\tCo-operative Societies Act, 1961 is absolutely clear in respect of<br \/>\n\tRecovery Officer\/ Authority&#8217;s competence for recovering dues for<br \/>\n\tcertificate in question. I<br \/>\n\tam of the view that the petitions are bereft of merits and deserve<br \/>\n\tto be dismissed. Hence, dismissed. Notice is discharged in each<br \/>\n\tpetition.\n<\/p>\n<p>\tInterim<br \/>\nrelief, if any, stands vacated.
