\n\tthe case of petitioner and grant the benefit of first higher grade
\n\tscale (Rs.1,400-2,600) with effect from 3-7-1992 i.e. the date on
\n\twhich the petitioner completed 9 year services on the post of senior
\n\tclerk instead of 29-3-1997 and grant all the consequential and
\n\tidentical benefits including the second higher pay scale <\/p>\n
and\/or<\/p>\n
further
\nbe pleased to quash and set aside the impugned order dated 24-3-2008
\npassed by the respondent no.2 (Annexure-E) by which the
\nrepresentation of the petitioner is rejected.\n<\/p>\n
8(C)\tpending
\nadmission, hearing and final disposal of this petition, be pleased to
\ndirect the respondents to reconsider the case of petitioner for grant
\nof first higher pay scale (Rs.1,400-2,600) with effect from 3-7-1992
\ni.e. the date on which the petitioner completed 9 year services on
\nthe post of senior clerk instead of 29-3-1997 and grant all the
\nconsequential and identical benefits including the second higher pay
\nscale in light of judicial pronouncements at Annexure-A, B, C and D.”\n<\/p>\n
3.\tThe
\nrepresentation which has been made by petitioner dated 30\/03\/2010 is
\nnot decided so far by respondent no.2.  Learned advocate Mr. Raval
\nrelied upon one order which has been passed by this Court on
\n29\/12\/2010 in case having identical facts and circumstances i.e. in
\nSpecial Civil Application No.16794 of 2010.  The said order is quoted
\nas under:\n<\/p>\n
“1.\tThis
\npetition under Article 226 of the Constitution of India has been
\nfiled, with the following prayers :\n<\/p>\n
“A)\tDirecting
\nthe Respondents to apply the judgment dt.6.8.1999 passed in Special
\nCivil Application No.8181 of 1998 and judgment dt.18.2.2010 passed in
\nSpecial Civil Application No.324 of 2010 in the case of the
\npetitioner and grant 1st higher grade scale to the
\npetitioner from 12.1.1990 i.e. after completion of 9 years of service
\nfrom the date of appointment instead of 28.2.1995 and grant her
\nconsequential benefits an further revise her retirement benefits
\naccordingly.\n<\/p>\n
B)\tDuring
\nthe pendency and final disposal of this petition, the Respondents may
\nbe directed to reconsider the case of the petitioner for grant of
\nhigher grade scale w.e.f. 12.1.1990 in light of the judgment
\ndt.18.2.2010 passed in Special Civil Application No.324 of 2010 and
\njudgment dt.6.8.1999 passed in Special Civil Application No.8181 of
\n1998.\n<\/p>\n
C)\tTo
\ngrant such and further relief as may b e deemed fit and proper.”\n<\/p>\n
2.\tHeard
\nMr.A.S.Supehia, learned counsel for the petitioner. It is submitted
\nby him that the petitioner has become entitled to the first higher
\ngrade scale from 12.1.1990, after completion of nine years of service
\nas Mukhya Sevika. By order dated 9.2.2005 passed by respondent No.1,
\nthe petitioner has been granted the higher grade scale from
\n28.2.1995, that is, from the date of passing the departmental
\nexamination, instead of granting it with effect from 12.1.1990. It is
\nfurther contended by the learned counsel for the petitioner that in
\nsimilar situations, similarly situated persons filed Special Civil
\nApplication No.8181\/1998, which was allowed by judgment dated
\n6.8.1999. The said judgment was subject matter of challenge in
\nLetters Patent Appeal No.663\/2000 and the appeal filed by the
\nrespondent department was rejected by order dated 28.1.2010 of the
\nDivision Bench. It is further urged that the other similarly situated
\npersons have also filed Special Civil Application No.324\/2010 and
\nallied matters, which have been allowed by judgment dated 18.2.2010
\nof the learned Single Judge. The respondents have complied with the
\njudgment of the learned Single Judge dated 18.2.2010 by passing order
\ndated 30.10.2010. Hence, as the
\ncase of the petitioner is similar, the same treatment ought to be
\nmeted out to him.\n<\/p>\n
3.\tAt
\nthis stage, the learned counsel for the petitioner states that
\nthe interest of justice would be met, if the petitioner is permitted
\nto make a representation to respondent No.1, within a period of two
\nweeks from today and the said respondent may be directed to consider
\nand decide the same, in the light of the judgments of this Court and
\nthe orders, passed in the case of similarly situated persons.\n<\/p>\n
4.\tUpon
\nthe above statement being made by the learned counsel for the
\npetitioner, the following order is passed :\n<\/p>\n
\tThe
\npetitioner shall make a representation to respondent No.1, within a
\nperiod of two weeks from today. In the
\nevent that the representation is made within the stipulated period of
\ntime, respondent No.2 shall consider and decide the same, in the
\nlight of the judgments of this Court in the cases of similarly
\nsituated persons, as also order dated 30.10.2010 passed in the case
\nof persons, whose cases are stated to be similar to that of the
\npetitioner. Respondent No.1 shall take a decision, in accordance with
\nlaw, as expeditiously as possible, and preferably within a period of
\none month from
\nthe date of receipt of a copy of this order.\n<\/p>\n
\tThe
\npetition is disposed of, in the above terms.”\n<\/p>\n
4.\tIn
\nview of above observations made by this Court, it is directed to
\nrespondent no.2 to consider representation made by petitioner and
\nalso consider decision which has been refereed above and other
\ndecisions on identical issue decided by this Court on 29\/7\/2003 in
\nSpecial Civil Application No.10772 of 2003 and in group of Special
\nCivil Application Nos.324 of 2010 and others dated 18\/2\/2010 and in
\nSpecial Civil Application No.8181 of 1991 dated 6\/8\/1999 and other
\nrelevant decisions in respect to the same matters passed by Division
\nBench of this Court in Letters Patent Appeal No.663 of 2000 to 665 of
\n2000 dated 28\/1\/2010 and then reconsider and reexamine the case of
\npetitioner considering aforesaid decisions which has been referred by
\nthis Court and then pass appropriate reasoned order in accordance
\nwith law within a period of three months from receiving copy of
\npresent order and communicate decision immediately to petitioner.\n<\/p>\n
5.\tIn
\nview of above observations and directions, present petition is
\ndisposed of by this Court without expressing any opinion on merits.
\nDirect service is permitted.\n<\/p>\n
