Bawa, Advocate for the petitioner.\n\n                                  ORDER\n<\/pre>\n<p>Surya Kant, J. &#8211; (Oral):\n<\/p>\n<p>            Notice of motion.\n<\/p>\n<p>            On the asking of the court, Shri G.S. Attariwala, learned<\/p>\n<p>Additional Advocate General, Punjab, accepts notice on behalf of the<\/p>\n<p>respondents.\n<\/p>\n<p>            In view of the nature of order which I propose to pass, there is<\/p>\n<p>no necessity to seek counter affidavit from the respondents.<\/p>\n<p>            The petitioner seeks quashing of the order dated 23.10.2008<\/p>\n<p>passed by the State Transport Appellate Tribunal, whereby the Tribunal,<\/p>\n<p>while rejecting the petitioner&#8217;s appeal, has refused to take into consideration<\/p>\n<p>various documents which the petitioner had placed on record of the appeal.<\/p>\n<p>            Suffice it to note here that the petitioner applied for renewal of<br \/>\n regular stage carriage permit for running his bus on Malerkotla &#8211; Amritsar<\/p>\n<p>route with one return trip also.     Under section 81(4)(b) of the Motor<\/p>\n<p>Vehicles Act, 1988, the petitioner was required to supply the following<\/p>\n<p>documents along with his application:-\n<\/p>\n<blockquote><p>                 1. No objection certificate from the concerned officer.<\/p>\n<\/blockquote>\n<blockquote><p>                 2. A certificate, as envisaged under Section 81(4)(b) of the<\/p>\n<p>                   Act from the concerned District Transport Officer.<\/p>\n<\/blockquote>\n<blockquote><p>                 3. A certificate of fitness of the vehicle, duly verified by<\/p>\n<p>                   the Motor Vehicles Inspector.\n<\/p><\/blockquote>\n<blockquote><p>                 4. Upto date Tax Clearance Certificate from the concerned<\/p>\n<p>                   District Transport Officer.<\/p><\/blockquote>\n<p>            The petitioner failed to attach these documents and his<\/p>\n<p>application for renewal of the permit was accordingly rejected by the<\/p>\n<p>competent authority. Aggrieved, the petitioner preferred an appeal before<\/p>\n<p>the Tribunal. Along with the appeal, the petitioner appended the requisite<\/p>\n<p>documents but the Tribunal has refused to look into the same on the premise<\/p>\n<p>that these documents same ought to have been appended with the<\/p>\n<p>application for renewal of the permit.\n<\/p>\n<p>            Having heard Learned Counsel for the parties and on perusal of<\/p>\n<p>the impugned order passed by the appellate Tribunal, I am of the considered<\/p>\n<p>view that the same cannot sustain in law. The documents attached along<\/p>\n<p>with the appeal, at the best, could be taken as a prayer to lead additional<\/p>\n<p>evidence.   The Tribunal     could also remand the case to the Regional<\/p>\n<p>Transport Authority for fresh adjudication.\n<\/p>\n<p>            For the reasons afore-stated, the orders passed by the appellate<\/p>\n<p>Tribunal as well as the RTA are set aside with liberty to the petitioner to<\/p>\n<p>move a fresh application before the RTA along with requisite documents. If<br \/>\n any such application is moved by the petitioner, the RTA shall consider and<\/p>\n<p>dispose of the same on merits and in accordance with law.<\/p>\n<pre>\n\n\n\n\nMarch 10, 2009.
