LTD. - Appellant(s)\n \n\nVersus\n \n\nAYSHABEN\nABDUL GANCHI &amp; 1 - Defendant(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nADIL MIRZA for MR RR MARSHALL for\nAppellant(s) : 1, \nNOTICE SERVED for Defendant(s) : 1, \nNone for\nDefendant(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n\t  \nDate : 28\/07\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.0.\t\tThis<br \/>\nappeal is directed against the judgment and award dated 31.07.1991<br \/>\npassed by the learned Civil Judge (SD) and Ex-Officio Commissioner<br \/>\nfor Workmen Compensation, Amreli in Workmen&#8217;s Compensation<br \/>\nApplication No. 3 of 1991, whereby the respondents-original<br \/>\napplicants were directed to recover an amount of Rs.67,773\/- from the<br \/>\nappellant-original opponent no.1 by way of compensation together with<br \/>\n6% simple interest per annum from the date of  application till its<br \/>\nrealization.\n<\/p>\n<p>2.0.\t\tThe<br \/>\nfacts of the case in brief are :-\n<\/p>\n<p>2.1.\t\tThe<br \/>\nrespondent herein is the widow of deceased Abdul Jamal. The deceased<br \/>\nwas working as cleaner cum driver with the respondent no. 2-original<br \/>\nopponent no. 1. On 13.05.1989, while the deceased was on duty, truck<br \/>\nbearing registration no. RNY 5313 came from the opposite direction<br \/>\nand dashed with the truck of the deceased.  The deceased received<br \/>\nserious injuries and succumbed to it. Hence, the widow of the<br \/>\ndeceased had filed an application for compensation.\n<\/p>\n<p>2.1.\t\tThe<br \/>\nlearned trial Judge, after hearing the parties and after considering<br \/>\nthe evidence on record, allowed the application and directed the<br \/>\nappellant to pay compensation of Rs.67,773\/- with 6% simple interest<br \/>\nper annum from the date of the application till realization.\n<\/p>\n<p>2.2.\t\tAgainst<br \/>\nthe said order, the appellant has approached this Court by way of<br \/>\nthis appeal.\n<\/p>\n<p>3.0.\t\tHeard<br \/>\nlearned counsel for the parties.  From the perusal of the record, it<br \/>\ntranspires that the vehicle in question was insured with the<br \/>\nappellant and, therefore, it is the statutory liability of the<br \/>\nappellant to pay interest, since he had committed breach of Section<br \/>\n4-A of the Workmen Compensation Act. The deceased was in the<br \/>\nemployment of the respondent no. 2 since last two years and,<br \/>\ntherefore, there was relation of employer and employee between the<br \/>\nrespondent no. 2 and the deceased. Hence, the appellant is liable to<br \/>\npay compensation along with interest under the contract.\n<\/p>\n<p>4.0\t\tIn<br \/>\nview of the above, in my opinion,<br \/>\nthe impugned award passed by the learned trial Judge is just and<br \/>\nproper and no interference is required by this Court. Hence, the<br \/>\nappeal is dismissed with no order as to costs.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[K.S.
