This order shall dispose of a bunch of four petitions2<\/p>\n<p>because common question of law and facts are involved therein. In<\/p>\n<p>these petitions challenge is made for quashing notification dated<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 8782 of 2007                                            2<\/span><\/p>\n<p>21.6.2006, issued under Section 4 of the Land Acquisition Act, 1894<\/p>\n<p>(for brevity, &#8216;the Act&#8217;) and declaration dated 22.2.2007, issued under<\/p>\n<p>Section 6 of the Act as also the award dated 4.5.2007, whereby the<\/p>\n<p>Government has acquired land for public purpose, namely, for Sector<\/p>\n<p>dividing road between Sector 24 and 25 Rohtak.          It is conceded<\/p>\n<p>position that all these petitions have been filed after announcement of<\/p>\n<p>award by the Land Acquisition Collector, Urban Estate, Hisar, which<\/p>\n<p>was passed on 4.5.2007. The principal ground of challenge is that<\/p>\n<p>prior permission of the Government before announcing the award is<\/p>\n<p>necessary, which according to the petitioners has not been obtained in<\/p>\n<p>the present acquisition.\n<\/p>\n<p>2.           After hearing learned counsel for the parties at a<\/p>\n<p>considerable length we find that there is no merit in these petitions<\/p>\n<p>which are liable to be dismissed. The argument raised by the learned<\/p>\n<p>counsel for the petitioners is without any substance because such an<\/p>\n<p>irregularity would not vitiate the acquisition proceedings nor the<\/p>\n<p>award.   In that regard reliance may be placed on a judgment of<\/p>\n<p>Hon&#8217;ble the Supreme Court in the case of <a href=\"\/doc\/1770418\/\">Collector, Ongole v.<\/p>\n<p>Narra Venkateswarlu,<\/a> (1996) 7 SCC 150.                Moreover, it is<\/p>\n<p>undisputed and admitted position that the petitioners have approached<\/p>\n<p>this Court by filing these petitions after announcement of award by<\/p>\n<p>the Land Acquisition Collector. It is well settled that no writ petition<\/p>\n<p>would be competent after passing of award because possession of<\/p>\n<p>land was taken and it is deemed to be vested in the State Government.<\/p>\n<p>In that regard reliance may be placed on the judgments of Hon&#8217;ble the<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 8782 of 2007                                         3<\/span><\/p>\n<p>Supreme Court rendered in the cases of <a href=\"\/doc\/1619781\/\">Star Wire (India) Ltd. v.<\/p>\n<p>State of Haryana,<\/a> (1996) 11 SCC 698; <a href=\"\/doc\/688536\/\">Municipal Council<\/p>\n<p>Ahmednagar v. Shah Hyder Beig,<\/a> (2000) 2 SCC 48; <a href=\"\/doc\/1381780\/\">C. Padma v.<\/p>\n<p>Dy. Secretary<\/a> to the Government of Tamil Nadu, (1997) 2 SCC<\/p>\n<p>627; and <a href=\"\/doc\/527480\/\">M\/s Swaika Properties Pvt. Ltd. v. State of Rajasthan,<\/p>\n<p>JT<\/a> 2008 (2) SC 280. There is thus, no ground to interfere.<\/p>\n<p>3.
