{"id":177693,"date":"2011-10-12T00:00:00","date_gmt":"2011-10-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/pradeep-yadav-vs-the-state-of-bihar-on-12-october-2011"},"modified":"2016-09-20T09:53:51","modified_gmt":"2016-09-20T04:23:51","slug":"pradeep-yadav-vs-the-state-of-bihar-on-12-october-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/pradeep-yadav-vs-the-state-of-bihar-on-12-october-2011","title":{"rendered":"Pradeep Yadav vs The State Of Bihar on 12 October, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Pradeep Yadav vs The State Of Bihar on 12 October, 2011<\/div>\n<pre>                     IN THE HIGH COURT OF JUDICATURE AT PATNA\n                          Criminal Miscellaneous No.32917 of 2011\n                             Pradeep Yadav, son of Rajo Yadav\n                                              Versus\n                                     The State Of Bihar\n                                  ----------------------------------\n<\/pre>\n<p>2.   12.10.2011               Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                                The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Sections 341, 323 and 308 of the Indian<\/p>\n<p>                  Penal Code.\n<\/p>\n<p>                            Considering that the deceased died 18 days after<\/p>\n<p>                  the occurrence and in the post mortem examination report the<\/p>\n<p>                  Doctor has found the death due to intracranial haemorrhage,<\/p>\n<p>                  let the petitioner above named, be released on bail on<\/p>\n<p>                  furnishing bail bond of Rs. 5,000\/- (Five thousand) with two<\/p>\n<p>                  sureties of the like amount each or any other surety to be fixed<\/p>\n<p>                  by the court concerned to the satisfaction of Chief Judicial<\/p>\n<p>                  Magistrate, Biharsharif, Nalanda, in connection with Manpur<\/p>\n<p>                  P.S. Case No. 9 of 2011, subject to the following conditions: (i)<\/p>\n<p>                  That one of the bailors will be a close relative of the petitioner<\/p>\n<p>                  who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                  related with the petitioner. The bailor will also undertake to<\/p>\n<p>                  inform the Court if there is any change in the address of the<\/p>\n<p>                  petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>                  petitioner is not an accused in any other case and if he is he<\/p>\n<p>                  shall not be released on bail. (iii) That the bailor shall also<\/p>\n<p>                  state on affidavit that he will inform the court concerned if the<\/p>\n<p>                  petitioner is implicated in any other case of similar nature after<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>        bail on the ground of misuse.
