JUSTICE R.M.DOSHIT)<\/p>\n<p>\t   Learned<br \/>\nadvocate Mr. Medipally has filed sick note.\n<\/p>\n<p>\t This Appeal<br \/>\nis pending admission hearing since the month of January, 2008. By<br \/>\norder dated 25th September, 2008 [Coram : D.A<br \/>\nMehta &amp; Bankim N. Mehta, JJ.], the Court recorded<br \/>\ncontinuous absence of the learned advocate Mr. Medipally &#8211; on the<br \/>\nbasis of either a leave note or a sick note. The registry was,<br \/>\ntherefore, directed to issue notice to the appellant with the copy of<br \/>\nthat order so as to enable the appellant to make alternate<br \/>\narrangement.\n<\/p>\n<p>\t  We are<br \/>\ninformed that the appellant has been served. Nevertheless, the<br \/>\nappellant has not entered appearance. We, therefore, proceed in<br \/>\nabsence of the appellant.\n<\/p>\n<p>\t  This<br \/>\nAppeal arises from the order dated 28th December, 2007<br \/>\nmade by the learned Company Judge in Company Application No. 586 of<br \/>\n2007. In the said Application No. 586 of 2007, the appellant-workman<br \/>\nhad sought permission to implead the Official Liquidator in Misc.<br \/>\nApplication No. 228 of 2004 in Reference [LCA] No.883 of 1994 pending<br \/>\nbefore the Labour Court, Ahmedabad. It appears that the appellant had<br \/>\nraised industrial dispute in respect of termination of his service on<br \/>\n1st December, 1993.  Reference [LCA] No. 883 of 1994 made<br \/>\nto the Labour Court, Ahmedabad in respect of the said dispute came to<br \/>\nbe dismissed for default on 9th September, 2004. Pending<br \/>\nthe said Reference, on 27th December, 2001, the company<br \/>\nwas ordered to be wound up. Therefore, the application to implead the<br \/>\nOfficial Liquidator.\n<\/p>\n<p>\tThe<br \/>\nApplication made in the year 2007 has been rejected by the learned<br \/>\nCompany Judge on the ground  of gross delay on the part of the<br \/>\nappellant.\n<\/p>\n<p>\tWe see no<br \/>\nmerit in the challenge to the above referred Order dated 28th<br \/>\nDecember, 2007.
