     First and second petitioners are working as<\/p>\n
Assistant Engineer and IIIrd Grade Overseer respectively,<\/p>\n
in the Water Resources Department. They are aggrieved<\/p>\n
by Ext.P8 order passed by the Government suspending<\/p>\n
them from service, pending enquiry.               The order of<\/p>\n
suspension has been passed by the Government taking<\/p>\n
note of the recommendations made by the enquiry<\/p>\n
committee, constituted to enquire           into the incident at<\/p>\n
Padinjarethara in        the         Banasura Sagar Project.<\/p>\n
Apparently, there was a landslide mishap which occurred<\/p>\n
at the site of the said project on 26.1.2008. Taking note of<\/p>\n
the gravity of the situation, a committee was appointed to<\/p>\n
look into the same.          First petitioner, the Assistant<\/p>\n
Engineer, was posted in the present place at               BSP<\/p>\n
(Banasura Sagar Project) Section 3\/1 at Padinjarethara in<\/p>\n
Wayanad District, on 1.12.2007. He assumed charge in<\/p>\n
the said office on 1.12.2007. According to him, the work<\/p>\n
of “BSP – Pandinjarethara Branch Canal – construction of<\/p>\n

covered and open Flume from CH 2100 to 2690″ was a<\/p>\n
work     being executed under BSP Section 1\/1 since<\/p>\n
February 2007 onwards. But after the first petitioner<\/p>\n
took charge as     Assistant Engineer in BSP Section 3\/1,<\/p>\n
through an order dated 28.12.2007,         the Executive<\/p>\n
Engineer transferred the said work from BSP Section 1\/1<\/p>\n
to BSP Section 3\/1. Specific case of the petitioner is that<\/p>\n
in spite of the said order, Ext.P1, Assistant Engineer,<\/p>\n
who was in charge of BSP Section 1\/1, did not hand over<\/p>\n
any records pertaining to the said work, to the first<\/p>\n
petitioner.     By Ext.P2   dated 8.1.2008, the second<\/p>\n
respondent issued a note to the first petitioner pointing<\/p>\n
out that the contractor is not executing the work as per<\/p>\n
the approved profile. First petitioner replied vide Ext.P3<\/p>\n
and the same reads as follows:-\n<\/p>\n<\/p>\n
        “As per the reference 1st cited,     it is<\/p>\n
        ordered that the above work has been<\/p>\n
        transferred      from     section      1\/1<\/p>\n
        Padinjarethara      to    Section      3\/1<\/p>\n
        Padinjarethara.     But   the   connected<\/p>\n

\n                              3<\/span><\/p>\n
        records such as files, drawings, M.Books,<\/p>\n
        work     memorandum etc, are not handed<\/p>\n
        over to me by the Assistant Engineer<\/p>\n
        Section 1\/1 Padinjarethara till date. So I<\/p>\n
        cannot follow up the direction issued by<\/p>\n
        the Assistant Executive Engineer BSP Sub<\/p>\n
        division Padinjarethara. This is for your<\/p>\n
        information and necessary action.”<\/p>\n<\/blockquote>\n
2.    It therefore, seems to be the specific case of the<\/p>\n
first petitioner that though a direction was issued vide<\/p>\n
Ext.P1, to see that the charge of the project is handed<\/p>\n
over to the first      petitioner namely the Assistant<\/p>\n
Engineer in Section 3\/1, the same was not implemented.<\/p>\n
Reference is made to Ext.P4 by which the Assistant<\/p>\n
Executive Engineer issued a specific communication to<\/p>\n
the Assistant Engineer, Section 1\/1, wherein he was<\/p>\n
directed to transfer the file and all connected documents<\/p>\n
regarding the subject work to the Assistant Engineer,<\/p>\n
Section 3\/1, Padinjarethara. Ext.P4 would prima facie<\/p>\n
indicate that Ext.P1 had not really been given effect to,<\/p>\n
in the sense that the first petitioner did not get charge<\/p>\n

of the work in question at any point of time prior to<\/p>\n
26.1.2008. First petitioner is aggrieved that in spite of<\/p>\n
the same, he has been put under suspension, as if there<\/p>\n
was a lapse on his part in relation to the landslide mishap<\/p>\n
which occurred on 26.1.2008. The order of suspension<\/p>\n
is therefore, challenged on the ground that the first<\/p>\n
petitioner has no connection at all to the incident in<\/p>\n
question and therefore, the Government had committed<\/p>\n
an error in not ascertaining the concerned incumbents,<\/p>\n
who were in charge of the work in question on the date<\/p>\n
of mishap or during the relevant time.<\/p>\n
3.     Learned      senior       Government         Pleader<\/p>\n
Mr.Nandakumar had made available a copy of the<\/p>\n
enquiry report submitted before the Government. I have<\/p>\n
gone through the same. Paragraph 33 of the said report,<\/p>\n
no doubt, affirms that the        Assistant Engineer and<\/p>\n
Overseer were responsible for the work in question and<\/p>\n
it is therefore, that recommendation was made to place<\/p>\n
both the Assistant Engineer and Overseer under<\/p>\n

\n                              5<\/span><\/p>\n
suspension.       It seems   that the Government had<\/p>\n
proceeded to place the first petitioner under suspension<\/p>\n
on the premise that Ext.P1 had taken effect and the first<\/p>\n
petitioner was in charge well before 26.1.2008. I do not<\/p>\n
find any material to clearly indicate      whether the<\/p>\n
Government had really gone into the question before<\/p>\n
passing the order of suspension. In my view, this is an<\/p>\n
aspect which has to be engaged the serious attention<\/p>\n
of the Government.\n<\/p>\n<\/p>\n
4.    In so far the second petitioner is concerned, he<\/p>\n
also has a contention that though he was an Overseer,<\/p>\n
Section 1\/1, he was in the administrative Office and was<\/p>\n
not in charge of the site as such. In my view, that is a<\/p>\n
matter which has to be considered by the appropriate<\/p>\n
authority, if the second respondent files an application<\/p>\n
under Rule 10(6) of the           Kerala Civil Services<\/p>\n
(Classification, Control and Appeals)    Rules.   In the<\/p>\n
result,    writ petition is disposed of in the following<\/p>\n
terms:-\n<\/p>\n

\n                                6<\/span><\/p>\n
         (i).   Government        shall    specifically<\/p>\n
         consider the case of the first petitioner<\/p>\n
         that Ext.P1 had not been give effect to<\/p>\n
         and therefore,     the first petitioner had<\/p>\n
         never been put in charge of any operation<\/p>\n
         of    the    work    dealing     with   BSP,<\/p>\n
         Padinjarethara      Branch      Canal    and<\/p>\n
         construction of covered and open Flume<\/p>\n
         from CH 2100 meters to 2690 meters.\n<\/p>\n<\/p>\n
         (ii). If the first petitioner’s contention on<\/p>\n
         the basis of Exts.P1, P3 and P4 are found<\/p>\n
         to be correct, then the suspension of the<\/p>\n
         first petitioner is liable to be revoked and<\/p>\n
         necessary orders shall be passed by the<\/p>\n
         Government in that regard. To enable the<\/p>\n
         Government to do so, first petitioner may<\/p>\n
         file a representation pointing out these<\/p>\n
         aspects and also produce the relevant<\/p>\n
         materials in support of the contention.<\/p>\n
         This shall be done within a period of one<\/p>\n
         week from the date of receipt of a copy of<\/p>\n
         this judgment and the Government shall<\/p>\n
         pass orders on the same within a period of<\/p>\n
         four weeks from the date of receipt of<\/p>\n

\n                              7<\/span><\/p>\n
         such representation.       Ext.P8 order of<\/p>\n
         suspension shall not be given effect to in<\/p>\n
         so far as the first petitioner is concerned,<\/p>\n
         till such fresh orders are passed by the<\/p>\n
         Government.\n<\/p>\n<\/p>\n
         (iii). If the second petitioner files an<\/p>\n
         application for revocation of suspension in<\/p>\n
         so far as he is concerned, in terms of Rule<\/p>\n
         10(6) of the        Kerala Civil Services<\/p>\n
         (Classification,  Control    and    Appeals)<\/p>\n
         Rules,    it  shall  be    considered   and<\/p>\n
         appropriate decision taken thereon, within<\/p>\n
         a period of four weeks from the date of<\/p>\n
         receipt of such application, along with the<\/p>\n
         copy of the judgment. Both the petitioners<\/p>\n
         shall be heard, if there is a proposal to<\/p>\n
         pass an order adverse to them.\n<\/p>\n<\/p>\n
