He also submitted that the ingredients of the<br \/>\nalleged sections are not attracted the present applicants. He also<br \/>\nsubmitted that the applicants have given fist blows to one Daudbhai<br \/>\nYusufbhai Badarpura, when the scuffle took place and due to fist<br \/>\nblows, the deceased fell down and died. As per the P.M. Report, the<br \/>\ncause of death of the deceased is acute myocardial infuriation. He<br \/>\nalso submitted that charge-sheet is also filed and investigation is<br \/>\nover. Therefore, he prayed to enlarge the applicants by imposing<br \/>\nsuitable conditions.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP Mr. Maulik Nanavati for the State strongly opposed the bail<br \/>\napplication of the applicants. He submitted that the applicants are<br \/>\ninvolved in the serious offence punishable under Sections 302, 332,<br \/>\n337, 186, 143, 147, 148, 149, 504, 506(2), 323 and 353 of the of the<br \/>\nIndian Penal Code and Sections 3 and 5 of the Damages to the Public<br \/>\nProperty Act and therefore, discretion may not be exercised in favour<br \/>\nof the applicants.\n<\/p>\n<p>4.\tHaving<br \/>\nconsidered the rival submissions and on perusal of the role<br \/>\nattributed to the applicants as reflected in the FIR, police papers,<br \/>\nprovisions of Sections 302, 332, 337, 186, 143, 147, 148, 149, 504,<br \/>\n506(2), 323 and 353 of the of the Indian Penal Code and Sections 3<br \/>\nand 5 of the Damages to the Public Property Act, quantum of<br \/>\npunishment, P.M. report etc., I am of the view that the applicants<br \/>\ndeserve to be enlarged on bail.  At the stage of bail, this Court is<br \/>\nnot going into merit of the case.\n<\/p>\n<p>5.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be enlarged on bail in connection<br \/>\nwith CR No. I &#8211; 43 of 2011 registered at Chhapi Police Station,<br \/>\nDistrict : Banaskatha on their executing  bond of Rs.10,000\/- each<br \/>\n[Rupees ten thousand only] with one surety of the like amount to the<br \/>\nsatisfaction of the Trial Court and subject to the conditions that<br \/>\nthey shall:\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge.\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of their residence to the I.O. and also to the Court at<br \/>\nthe time of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week.\n<\/p>\n<p>6.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>7.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>8.\tRule<br \/>\nis made absolute to the aforesaid extent.
