Radhakrishnan, J.\n        ==================================\n              W.P.(C)No.19819 of 2008\n        ==================================\n        Dated this the 1st day of July, 2008.\n\n\n                     JUDGMENT\n<\/pre>\n<p>    After arguing the matter for quite sometime,<\/p>\n<p>learned counsel for the petitioner confines his<\/p>\n<p>submission to a request that the petitioner may be<\/p>\n<p>permitted to exclude SARFAESI Act proceedings in<\/p>\n<p>view of the pendency of proceedings before the<\/p>\n<p>Debts  Recovery  Tribunal   and  different   courts.<\/p>\n<p>Learned counsel for the bank however states that<\/p>\n<p>the  proceedings  before   the   DRT  is  the  only<\/p>\n<p>proceeding to which the bank is a legitimate party<\/p>\n<p>and that the different suits have really no bearing<\/p>\n<p>on the rights of the bank in relation to the loan<\/p>\n<p>transaction.\n<\/p>\n<\/p>\n<p>    2.  Having heard the learned counsel for the<\/p>\n<p>petitioner quite in extenso, the controversies are<\/p>\n<p>essentially in the realm of creation of power of<\/p>\n<p> WPC19819\/2008<\/p>\n<p><span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>attorneys,    the  scope    of   power  of  attorney<\/p>\n<p>documents, the actions of the power holder in<\/p>\n<p>entering    into  transactions    and  also  parting<\/p>\n<p>consideration.     The  materials    also appear  to<\/p>\n<p>disclose that the petitioner has also received<\/p>\n<p>amounts    under   demand    drafts.     Under  such<\/p>\n<p>circumstances, I do not deem it appropriate to tie<\/p>\n<p>down the bank to any proceedings in the civil<\/p>\n<p>court, particularly when, the proceedings initiated<\/p>\n<p>under   the    SARFAESI  Act    stand   outside  the<\/p>\n<p>jurisdiction and reach of the civil court and the<\/p>\n<p>proceedings cannot be interfered with by the civil<\/p>\n<p>court.    But it has also to be ensured that any<\/p>\n<p>legitimate right of the petitioner qua the power<\/p>\n<p>holder and any party other than the bank could also<\/p>\n<p>be worked out reasonably.\n<\/p>\n<\/p>\n<p>    3.   In the aforesaid circumstances, while I<\/p>\n<p>find no jurisdictional error or legal infirmity in<\/p>\n<p>the impugned proceedings, this writ petition is<\/p>\n<p> WPC19819\/2008<\/p>\n<p><span class=\"hidden_text\">                         -:3:-<\/span><\/p>\n<p>ordered directing that if the petitioner remits the<\/p>\n<p>entire amounts due to the bank as covered by the<\/p>\n<p>SARFAESI Act notice within an outer limit of two<\/p>\n<p>weeks from now, such payments shall be provisional<\/p>\n<p>and subject to the decision of the proceedings<\/p>\n<p>pending before the DRT.    It is also clarified that<\/p>\n<p>the other proceedings, if any, pending before the<\/p>\n<p>different courts will not have any impact between<\/p>\n<p>the bank and   the petitioner which essentially have<\/p>\n<p>to be worked out before the DRT.
