Justice ANTONY DOMINIC\n\n Dated :14\/10\/2008\n\n O R D E R\n                            ANTONY DOMINIC, J.\n                          ===============\n                     W.P.(C) NO. 28872 OF 2008 (K)\n                     ====================\n\n                 Dated this the 14th day of October, 2008\n\n                                J U D G M E N T\n<\/pre>\n<p>       Ext.P1 is the staff fixation order in respect of the school of which the<\/p>\n<p>3rd respondent is the Headmaster. Following verification by Super Check<\/p>\n<p>Cell of the DPI, Ext.P2 show cause notice was issued proposing to abolish<\/p>\n<p>7 posts, and the Headmaster by Ext.P3 replied to the same. It is stated<\/p>\n<p>that though hearing in pursuance to Ext.P2 was scheduled as per Ext.P4<\/p>\n<p>that was adjourned and the matter was remaining undecided.<\/p>\n<p>       2.      In the meantime, though as per Ext.P5 verification report<\/p>\n<p>pertaining to the year 2008-09 the school is eligible for 96 divisions, staff<\/p>\n<p>fixation order has not been issued so far.        It is at that stage the writ<\/p>\n<p>petition is filed praying for expediting the staff fixation order on the ground<\/p>\n<p>that the teachers are denied salary since July, 2008.<\/p>\n<p>       3.      Learned Government Pleader on instructions submits that<\/p>\n<p>hearing in pursuance to Exts. P2 and P4 have been conducted on<\/p>\n<p>13\/10\/2008 and that orders following the hearing will be issued by the 4th<\/p>\n<p>respondent immediately. This submission is recorded and it is directed<\/p>\n<p>that within 8 weeks of production of a copy of this judgment, proceedings<\/p>\n<p>pursuant to Exts. P2 and P4 shall be issued.\n<\/p>\n<p>WPC 28872\/08<br \/>\n<span class=\"hidden_text\">                                     :2 :<\/span><\/p>\n<p>     4.     It is also directed that staff fixation order pertaining to 2008-<\/p>\n<p>09 should also be issued by the 2nd respondent as expeditiously as<\/p>\n<p>possible, at any rate within 4 weeks of production of a copy of this<\/p>\n<p>judgment and on that basis, claim for payment of salary shall also be<\/p>\n<p>processed.\n<\/p>\n<p>     Writ petition is disposed of as above.\n<\/p>\n<p>     Petitioners are directed to produce a copy of this judgment before<\/p>\n<p>respondents 1 and 2 for compliance.\n<\/p>\n<\/p>\n<p>                                               ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rameshan.P.K.
