(J)\n\nCITATION:\n 1996 AIR  709\t\t  1996 SCC  (1)\t 88\n JT 1995 (8)   328\t  1995 SCALE  (6)506\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>      SPECIAL LEAVE PETITION (CIVIL) NO.24584 OF 1995.<br \/>\n\t\t\t O R D E R<br \/>\n     Sri  Mehta,   learned   counsel   appearing   for\t the<br \/>\npetitioners contends that Notification under Section 4(1) of<br \/>\nLand Acquisition  Act,\t1894  [for  short,  `the  Act&#8217;]\t was<br \/>\npublished on  3.10.1969 and  the award\tunder Section 11 was<br \/>\nmade  in   the\tcase  of  his  clients\ton  August  2,\t1972<br \/>\ndetermining compensation  under Section 23(1) at Rs.1.25 per<br \/>\nsq.  mt.   for\tplot   No.23  admeasuring   24721  sq.\tmts.<br \/>\nSubsequently, successive  awards for  other  lands  acquired<br \/>\nunder the  same notification  were made,  on June 4, 1985 at<br \/>\nRs. 5\/-\t per sq.  mt., on October 14, 1985 at Rs.9\/- per sq.<br \/>\nmt. and\t another judgment  and decree  on August 31, 1987 by<br \/>\nthe High  Court in  Appeal  No.11\/86  uniformly\t fixing\t the<br \/>\ncompensation at\t Rs.5\/- per  sq. mt.  Yet another  reference<br \/>\nunder Section  18 was  decided\ton  July  27,  1989  by\t the<br \/>\nReference Court\t at Rs.5\/-  per sq.  mt. Though he filed the<br \/>\napplication on\t13.5.1987, in  view of\tthe decision of this<br \/>\nCourt in  Union of  India &amp;  Anr. Vs. Pradeep Kumari &amp; Ors.,<br \/>\n[(1995) 2 SCC 736], any one of the awards or each successive<br \/>\naward including\t the judgment  and decree  of the High Court<br \/>\nwould give  right and  cause of\t action to  the\t petitioner-<br \/>\nclaimant to  make application  under Section  28-A.  So,  it<br \/>\ncannot be dismissed on the ground of delay. The views of the<br \/>\nLand Acquisition Officer and the High Court wrong in law.\n<\/p>\n<p>     Section 28-A  says that  where in\tan award  under this<br \/>\npart, the Court allowed the application under Section 18 and<br \/>\nawarded\t higher\t  compensation,\t notwithstanding   that\t the<br \/>\nclaimant had  not made\tan application\tunder Section 18, he<br \/>\ncan make  an application  &#8220;within three months from the date<br \/>\nof the\taward of  the court&#8221;  [emphasis supplied]  requiring<br \/>\nthat the  amount of  compensation payable  to  them  may  be<br \/>\nredetermined on\t the basis  of the  amount  of\tcompensation<br \/>\nawarded by  the Court.\tThe proviso  prescribes the  mode of<br \/>\ncomputation of period of three months which says that:-\n<\/p>\n<blockquote><p>     &#8220;the period of three months within which<br \/>\n     an application to the Collector shall be<br \/>\n     made under\t this sub-section, the day on<br \/>\n     which the\taward was  pronounced and the<br \/>\n     time requisite  for obtaining  a copy of<br \/>\n     the award shall be excluded.&#8221;<\/p><\/blockquote>\n<p>     The contention  of the  learned counsel is that any one<br \/>\nof the\tsuccessive awards  including the Judgment and decree<br \/>\nof the\tHigh Court  would give\tright and cause of action to<br \/>\nthe Petitioner\tto make\t an application\t under Section 28-A.<br \/>\nTherefore, there  is no\t bar of\t limitation. A\tBench of two<br \/>\nJudges of  this Court in Babua Ram vs. State of UP [(1995) 2<br \/>\nSCC 689],  has held  that the period of limitation begins to<br \/>\nrun when the award on a reference under Section 18 was first<br \/>\nmade by\t the Reference\tCourt and  the limitation  of  three<br \/>\nmonths requires\t to be\tcomputed from  the date of the first<br \/>\naward and successive awards do not save the limitation if it<br \/>\nhas already  expired by\t efflux of  time. The  same view was<br \/>\nreiterated in another judgment in <a href=\"\/doc\/166471636\/\">Union of India vs. Karnail<br \/>\nSingh<\/a>  [(1995)\t2  SCC\t728].  This  view  was\tsubsequently<br \/>\noverruled by a Bench of three judges.\n<\/p>\n<p>     In view  of the  contention raised\t by Shri  Mehta, the<br \/>\nfollowing questions are required to be considered :\n<\/p>\n<p>1.   Whether the  award of the Court, i.e., Civil Court made<br \/>\nunder Section  26 on  reference under  Section 18 would also<br \/>\ninclude judgment  and decree  of the  Appellate Court  under<br \/>\nSection 54?*\n<\/p>\n<p>2.   Whether each  successive awards  or judgment and decree<br \/>\n(if answer on question No.1 is positive) would give cause of<br \/>\naction\tto  file  application  under  Section  28-A;  if  so<br \/>\nconstrued, does not such a construction violate the language<br \/>\nused in\t Section 28-A  when the Parliament advisedly did not<br \/>\nuse such expressions?\n<\/p>\n<p>     These questions  require examination  by a larger Bench<br \/>\nof five Judges as the interpretation of Section<br \/>\n____________________________________________________________<br \/>\n     *\t   <a href=\"\/doc\/24214\/\">Union  of India  v. Raghubir Singh<\/a><br \/>\n     [(1989) 2\tSCC 754]; C.A. No.1697\/95 [V.\n<\/p>\n<p>     Krishnamurti &amp;  Ors. v. State of Orissa]<br \/>\n     decided on\t January 19,  1995  and\t C.A.\n<\/p>\n<p>     No.3521\/95 [<a href=\"\/doc\/1556184\/\">State\tof Punjab v. Raghubir<br \/>\n     Singh &amp;  Ors.<\/a>] decided  on February  28,<br \/>\n     1995, are relevant for the point.\n<\/p>\n<p>28-A on\t the limitation of three months often arises in many<br \/>\na case throughout the country.\n<\/p>\n<p>     Issue notice  to the  respondents\treturnable  in\tfour<br \/>\nweeks.
