The Applicant filed an RTI application dt.4.8.08 with the PIO, ICFRE.      He<br \/>\n      requested for the following information:\n<\/p>\n<p>      i)     Copies of the ACR dossiers from Part I to Part V from May 2003 to<br \/>\n             March 2008\n<\/p>\n<p>      ii)    What is the criteria adopted for awarding the marks on the basis of<br \/>\n             assessment made by Reporting Officer, remarks of Reviewing Officer<br \/>\n             and remarks of Accepting Authority from May 2003 to March 2008\n<\/p>\n<p>      iii)   How many marks she has received from May 2003 to March 2008\n<\/p>\n<p>      iv)    What are the guidelines for Reviewing Officer to make appropriate<br \/>\n             remarks on the basis of assessment of the Reporting Officer.<br \/>\n      The PIO replied on 17.9.08 providing the criteria for overall grading such as<br \/>\n      Poor &#8211; 0 Marks, Average &#8211; 4 marks, Good &#8211; 6 marks, Very Good &#8211; 8 marks,<br \/>\n      Outstanding &#8211; 10 marks. He denied copies of ACR and marks received based<br \/>\n      on the CIC decision which states ACRs of officers and employees need not be<br \/>\n      disclosed because it does not contribute to any public interest. The Applicant<br \/>\n      filed an appeal dt.13.10.08 with the Appellate Authority.     On not receiving<br \/>\n      any reply, the Applicant filed an appeal dt.25.11.08 before CIC.\n<\/p>\n<p>2.    The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the<br \/>\n      hearing on February 18, 2009.\n<\/p>\n<p>3.    Dr. Savita M. Jain, R.A. Grade I and Mr. S.S. Chauhan. Office Supdt.\n<\/p>\n<p>      represented the Public Authority.\n<\/p>\n<p>4.    The Applicant was not present during the hearing.<br \/>\n Decision<\/p>\n<p>5.    The Commission took note of the fact that the criterion for awarding marks<br \/>\n      on the basis of assessment made by the Reporting Officer to the remarks of<br \/>\n      the Reviewing Officer and the Accepting Authority were conveyed by the CPIO<br \/>\n      to the Appellant vide his letter dated 17th September, 2008. However, the<br \/>\n      Appellant&#8217;s contention in the first appeal was that the information provided to<br \/>\n      her is not what she is seeking since the CPIO did not mention how the marks<br \/>\n      have been given on the assessment made by the reporting officer. (ACR Part<br \/>\n      III: 3.1).   She also stated in the appeal that no adverse remarks were<br \/>\n      communicated to her on her performance and therefore, she needed to know<br \/>\n      why she has not been promoted continuously for two years on the basis of<br \/>\n      her ACRs, since she believes that her performance was excellent.\n<\/p>\n<p>6.    The Commission observed that the issue in this case is why the Appellant<br \/>\n      has been denied promotion continuously for two years even after no adverse<br \/>\n      remarks have been communicated to her on her performance. In this<br \/>\n      connection it would be pertinent to refer to the Full Bench Decision passed<br \/>\n      vide order dated 19.02.2009 in Appeal No. CIC\/WB\/A\/2007\/00422 concerning<br \/>\n      disclosure of ACRs referring to the Supreme Court decision addressing the<br \/>\n      same issue. The CIC decision reads as hereunder:\n<\/p>\n<blockquote><p>             The Hon&#8217;ble Supreme Court of India in Dev Dutt&#8217;s case supra<br \/>\n             has clearly laid down that they are developing the principles of<br \/>\n             natural justice by holding that fairness and transparency in<br \/>\n             public administration requires that all entries (whether poor,<br \/>\n             fair, average, good or very good) in the ACR of a public servant,<br \/>\n             whether in civil, judicial, police or any other State service<br \/>\n             (except the Military) , must be communicated to him within a<br \/>\n             reasonable period so that he can make a representation for its<br \/>\n             upgradation. The Hon&#8217;ble Court has further declared that these<br \/>\n             directions will not apply to Military Officers but they will apply<br \/>\n             to    employees     of   statutory     authorities,    public    sector<br \/>\n             corporations and other instrumentalities of the State (in<br \/>\n             addition to Government servants).\n<\/p><\/blockquote>\n<p> The    aforesaid   Supreme      Court     decision   relates     to<br \/>\ncommunication of entries made in the ACRs, more particularly,<br \/>\nthe grade assigned to an employee (whether poor, fair,<br \/>\naverage, good or very good). This still leaves the issue as to<br \/>\nwhether copies of the ACRs (whether photostat or certified)<br \/>\ncould be issued to an employee under the Right to Information<br \/>\nAct. The Hon&#8217;ble Apex Court has stated that the communication<br \/>\nof the entries to a public servant must enable him to make a<br \/>\nrepresentation against the entry to the concerned authority.<br \/>\nMere communication of an assigned grade will naturally not<br \/>\nenable him to exercise his right of making a representation in<br \/>\nan effective manner. The Hon&#8217;ble Court has further held that<br \/>\n&#8220;all this would be conducive to fairness and transparency in<br \/>\npublic administration and would result in fairness to public<br \/>\nservants.&#8221;\n<\/p>\n<p>The objective of the Right to Information Act is also to bring<br \/>\ntransparency and accountability in the working of all Public<br \/>\nAuthorities. The disclosure of ACRs to the concerned employee<br \/>\ncannot, therefore, be denied in the light of decision\/directives<br \/>\nof the Hon&#8217;ble Apex Court, in which in developing the principle<br \/>\nof natural justice the Hon&#8217;ble Court has ruled that &#8220;the concept<br \/>\nof natural justice has undergone a great deal of change in<br \/>\nrecent years. In the past it was thought that it included just<br \/>\ntwo rules, namely(1) no one shall be a judge in his own cause<br \/>\n(Nemo debet csse judexe propria causa) and (2) no decision<br \/>\nshall be given against a party without affording him a<br \/>\nreasonable   hearing   (audi    alteram   partem).   Very      soon<br \/>\nthereafter a third rule was envisaged and that is that quasi-<br \/>\njudicial enquiries must be held in good faith, without bias and<br \/>\nnot arbitrarily or unreasonably. But in the course of years many<br \/>\nmore subsidiary rules came to be added to the rules of natural<br \/>\njustice.&#8221; This does not, however, imply that it will necessarily<br \/>\nbe desirable to provide either a photocopy or a certified copy of<br \/>\nthe ACRs to a public servant.\n<\/p>\n<p> 7.    In view of the latest decision of the Full Bench of CIC as mentioned<br \/>\n      hereinabove and the Supreme Court decision in <a href=\"\/doc\/801705\/\">Dev Dutt vs. Union of India &amp;<br \/>\n      Ors.<\/a> [(2008)8 SCC 725] it is decided that the complete information as sought<br \/>\n      by the Appellant in the instant case, including all the information in the<br \/>\n      ACRs     may be duly communicated to her within 15 days of receipt of this<br \/>\n      order.\n<\/p>\n<p>8.
