No.10054 of 2011\n                                     SAJJAD ASGHER\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>2.   25.03.2011.            Heard     learned         counsels for                      the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p>                              The    petitioner            is    apprehending           his<\/p>\n<p>                   arrest in complaint case in which cognizance<\/p>\n<p>                   has been taken under Sections 120 and 420 of<\/p>\n<p>                   the Indian Penal Code.\n<\/p>\n<p>                              It is alleged that the mother of the<\/p>\n<p>                   complainant executed a power of attorney in<\/p>\n<p>                   favour of the petitioner with regard to the<\/p>\n<p>                   property in question.\n<\/p>\n<p>                              It     is    submitted             by    the        learned<\/p>\n<p>                   counsel for the petitioner that after death<\/p>\n<p>                   of the mother of the complainant, accused<\/p>\n<p>                   no.1 executed rent agreement with regard to<\/p>\n<p>                   the    property        on   02.05.2009             in    favour       of<\/p>\n<p>                   accused no.2.\n<\/p>\n<p>                              On bare perusal of the averments of<\/p>\n<p>                   the    complaint       itself,          it    appears         that    no<\/p>\n<p>                   case     is     made    out        since      after          death    of<\/p>\n<p>                   original      landholder           the   power          of    attorney<\/p>\n<p>                   became    ineffective.             It    is    also          submitted<\/p>\n<p>                   that     title     suit       is     pending        between          the<\/p>\n<p>                   parties.\n<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><\/p>\n<p>                    Considering the aforesaid facts, let<\/p>\n<p>        the petitioner, above named, be released on<\/p>\n<p>        bail   in     the      event   of   arrest   or   surrender<\/p>\n<p>        before      the     learned     court    below    within       a<\/p>\n<p>        period      of      twelve     weeks     from     today    in<\/p>\n<p>        connection with complaint case no. 825(C )<\/p>\n<p>        of     2010       on       furnishing    bail     bond     of<\/p>\n<p>        Rs.10,000\/-(Ten Thousand) with two sureties<\/p>\n<p>        of the like amount each to the satisfaction<\/p>\n<p>        of the learned C.J.M. Jamui, subject to the<\/p>\n<p>        conditions as laid down under Section 438(2)<\/p>\n<p>        of the Code of Criminal Procedure.<\/p>\n<pre>U. K.
