Civil Application came to be filed by Smt. Archnaben<br \/>\nNiravbhai Bhatt seeking transfer of the proceedings of Hindu Marriage<br \/>\nPetition No. 55 of 2009 from the Court of learned Principal Civil<br \/>\nJudge, Junagadh to the Court of learned Additional and Chief Judicial<br \/>\nMagistrate, Morbi.\n<\/p>\n<p>\tConsidering<br \/>\nthe nature of differences between the parties the Court considered it<br \/>\nappropriate to explore the possibility of settlement through High<br \/>\nCourt Mediation Centre. Thereafter in view of the agreement between<br \/>\nthe parties and with consent of the parties, the Court, by order<br \/>\ndated 25th January 2010 referred the matter for settlement<br \/>\nthrough High Court Mediation Centre. The matter was placed before the<br \/>\n High Court Mediation Centre.\n<\/p>\n<p>\tUpon<br \/>\nconclusion of the mediation proceedings, learned Mediator has, by his<br \/>\nreport dated 13th April 2010, reported that the mediation<br \/>\nprocess is successful in view of the settlement arrived at between<br \/>\nthe parties. The learned Mediator under his report dated 13th<br \/>\nApril 2010 has also forwarded copy of the settlement duly signed by<br \/>\nthe parties and their witnesses and the learned advocates. The<br \/>\nsettlement contains the terms and<br \/>\ncondition which have been agreed upon by and between the parties,<br \/>\nwhich, inter alia, provide that by way of permanent alimony Mr.<br \/>\nBhatt, the husband shall pay Rs. 5,55,000\/- to the applicant-wife and<br \/>\nboth the parties will co-operate for decree of divorce with consent<br \/>\nand the wife Smt. Archanaben Niravbhai Bhatt, as part of the<br \/>\nagreement between the parties, shall withdraw the Misc. Civil<br \/>\nApplication No. 2392 of 2010<\/p>\n<p>\tToday<br \/>\nduring the hearing of present application learned advocates have<br \/>\nstated that a sum of Rs. 5,55,000\/- has already been paid by the<br \/>\nhusband to wife by Demand Draft No. 374850 dated 10th<br \/>\nApril 2010. Learned advocate<br \/>\nrepresenting the applicant-wife has confirmed the said fact.\n<\/p>\n<p>\tThe<br \/>\nlearned advocates representing the applicant-wife and the<br \/>\nopponent-husband have identified the signatures of their respective<br \/>\nclients and have also admitted and acknowledged and confirmed that<br \/>\nthe settlement has been arrived at by and between the parties with<br \/>\nconsent and without any type of influence or pressure. They have also<br \/>\naverred that the parties have agreed and they undertake to abide by<br \/>\nthe terms and conditions of the settlement.\n<\/p>\n<p>\tIn<br \/>\nview of the said settlement arrived at during the mediation<br \/>\nproceedings, the learned advocate for the applicant-wife has<br \/>\nsubmitted that present application has lost its purpose and<br \/>\nsignificance and that therefore the applicant seeks permission to<br \/>\nwithdraw the application. He has also submitted that the parties will<br \/>\njointly tender the said settlement  before the learned Court where<br \/>\nthe Hindu Marriage Petition No. 55 of 2009 is pending and the parties<br \/>\nwill jointly request to the learned Court to pass appropriate order<br \/>\nin terms of and in light of the settlement between the parties.\n<\/p>\n<p>\tAfter<br \/>\nthe aforesaid settlement is placed on record<br \/>\nof the proceeding pertaining to the Hindu Marriage Petition No. 55 of<br \/>\n2009, the learned Court shall make appropriate orders on the basis of<br \/>\nthe settlement.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicant has also submitted that the applicant<br \/>\nshall place a copy of the settlement on record of the Misc. Criminal<br \/>\nApplication No. 329 of 2009 and on the basis of the consent terms the<br \/>\nappellant-wife shall request the learned Court for permitting<br \/>\nwithdrawal of the said Misc. Criminal Application No. 329 of 2009.<br \/>\nThe learned advocate for the opponent-husband has submitted that<br \/>\nsince the amount required to be paid by the husband has already been<br \/>\npaid and by placing the settlement on record of Hindu Marriage<br \/>\nPetition No. 55 of 2009 joint request to pass appropriate orders in<br \/>\nlight of the settlement shall be made. The applicant&#8217;s learned<br \/>\nadvocate has assured all co-operation and making joint request for<br \/>\nearly decree of divorce by consent.\n<\/p>\n<p>\tIn<br \/>\nview of the above mentioned settlement and report of the learned<br \/>\nMediator the application is not required to be prosecuted further and<br \/>\nthat therefore the applicant is permitted to withdraw the<br \/>\napplication.\n<\/p>\n<p>\tThe<br \/>\napplication stands disposed of as withdrawn.
