DAVE, J.)<\/p>\n<p>1.\t\tThe<br \/>\nappellants were the accused before Sessions Court, Rajkot, at Gondal,<br \/>\nin Sessions Case No.42  of 2003.  Appellant No.1, Narendra Palabhai<br \/>\nMakwana, happened be the husband of Ramaben and appellant No.2,<br \/>\nKunverben, is his mother.  They both were charged for offences<br \/>\npunishable under Sections 306 and 498A read with Section 114 of the<br \/>\nIndian Penal Code.  Appellant 1 came to be convicted for the offence<br \/>\npunishable under Section 306 read with Section 114 of the I. P. C.<br \/>\nand was sentenced to undergo rigorous imprisonment for ten years and<br \/>\nto pay a fine of Rs.1,000\/-, in default, to undergo simple<br \/>\nimprisonment for three months.  He was also convicted for the offence<br \/>\npunishable under Section 498A read with Section 114 of the I. P. C.<br \/>\nand sentenced to rigorous imprisonment for three years and to pay a<br \/>\nfine of Rs.500\/-, in default, to undergo simple imprisonment for 15<br \/>\ndays.  Accused No.2, Kunverben, was convicted for the offence<br \/>\npunishable under Section 306 read with section 114 of the I. P. C.<br \/>\nand sentenced to undergo rigorous imprisonment for two years and to<br \/>\npay a fine of Rs.500\/-, in default, to undergo simple imprisonment<br \/>\nfor  three months.  She was also convicted for the offence punishable<br \/>\nunder Section 498A read with Section 114 of the I. P. C. and<br \/>\nsentenced to undergo rigorous imprisonment for two years and to pay a<br \/>\nfine of Rs.500\/-, in default, to undergo simple imprisonment for<br \/>\nthree months.  All the sentences were ordered to run concurrently.<br \/>\nThe judgment was delivered on 30th December, 2004 by 4th<br \/>\nFast Track Court, Gondal.\n<\/p>\n<p>2.\t\tThe<br \/>\nfacts of the case, in brief, are that on 12th January,<br \/>\n2003, Ramaben, deceased wife of appellant No.1-Narendra suffered<br \/>\nburns injuries at her home and succumbed thereto.  She was taken to<br \/>\nhospital at Upleta, where she gave a history that she had suffered<br \/>\nburns while she was heating milk.  She lodged an F. I. R. (Exhibit\n<\/p>\n<p>51) before Police and, in that F. I. R. also, she gave the history<br \/>\nthat while she was heating milk for her son, Umesh, on Primus, she<br \/>\naccidentally suffered burns injuries.  She was then taken to Junagadh<br \/>\nHospital, where also she gave the history of accidental burns in the<br \/>\nsame manner.  Her dying declaration was recorded by Executive<br \/>\nMagistrate (Exhibit 58) and, in that dying declaration also, she gave<br \/>\nthe history that while she was heating milk on Primus, she suffered<br \/>\naccidental burns as her sari caught fire.  Later on, when her parents<br \/>\narrived, they disclosed to the police of the burns being homicidal<br \/>\nand, at that time, she was alive and, therefore, it was indicated<br \/>\nthat an offence punishable under Section 307 is  constituted.  Later<br \/>\non, when she died, it would of course amount to an offence punishable<br \/>\nunder Section 302 of the Indian Penal Code.  However, the police<br \/>\nafter investigation filed charge sheet in the Court of learned<br \/>\nJudicial Magistrate, First Class, Upleta, for the offences punishable<br \/>\nunder Sections 498A, 306 and 114 of the Indian Penal Code.\n<\/p>\n<p>2.1\t\tThe<br \/>\ncase was committed to the Court of Sessions and charge was framed<br \/>\nagainst the accused persons at Exhibit 1, to which they pleaded not<br \/>\nguilty and came to be tried.\n<\/p>\n<p>2.2\t\tConsidering<br \/>\nthe evidence, the Trial Court found that the charges levelled against<br \/>\nthe accused persons were proved and, therefore, recorded conviction<br \/>\nand passed sentences, as stated hereinabove.\n<\/p>\n<p>3.\t\tWe<br \/>\nhave heard learned Advocate, Mr. Purohit, for the appellant and<br \/>\nlearned Additional Public Prosecutor, Mr. Bhatt, for the<br \/>\nrespondent-State.  We have also examined the record and proceedings.\n<\/p>\n<p>4.\t\tWe<br \/>\nnotice from the evidence that the marriage span between the<br \/>\naccused-appellant No.1 and the deceased was of more than seven years<br \/>\nand, therefore, the presumption clause will not come into play.  We<br \/>\ndo not propose to discuss the bulk evidence, which is recorded by the<br \/>\nprosecution in detail since we find that this is a gross case of<br \/>\nmiscarriage of justice.\n<\/p>\n<p>5.\t\tUndisputedly,<br \/>\nthe victim, deceased-Ramaben, in her initial versions before hospital<br \/>\nat Dhoraji, hospital at Junagadh, F.I.R. before police and dying<br \/>\ndeclaration before Executive Magistrate, was consistent that she had<br \/>\nsuffered accidental burns.\n<\/p>\n<p>5.1\t\tLater<br \/>\non, the parents  and relatives of the deceased have tried to project<br \/>\nthe case as if it was a case of attempted murder or murder.\n<\/p>\n<p>5.2\t\tLater<br \/>\non, during the course of investigation, the Investigating Agency has<br \/>\nfound that the allegation of attempted murder or murder is not true<br \/>\nnor is the version given by the deceased is true and, therefore,<br \/>\nfiled a charge sheet for offences punishable under Sections 306 and<br \/>\n498A  read with Section 114 of the I.P.C.  Now, if the evidence of<br \/>\nthe Investigating Officer is seen, his deposition is at Exhibit 59.<br \/>\nHe is Somabhai Mohanbhai Patel, who has investigated the case.  In<br \/>\nhis cross-examination, he states that he had not received any<br \/>\nmaterial during the investigation to show that Ramaben had committed<br \/>\nsuicide.  He also admits that he had not received any material during<br \/>\nthe course of investigation that  any physical or mental harassment<br \/>\nwas caused to the deceased by her husband, Narendra, or<br \/>\nmother-in-law, Kunverben.\n<\/p>\n<p>5.3\t\tIf<br \/>\nabove is the situation, we are at loss to understand how the<br \/>\nInvestigating Officer has filed charge sheet for offences punishable<br \/>\nunder Section 306 and 498A read with Section 114 of the I. P. C.<br \/>\nagainst the accused-appellants.\n<\/p>\n<p>6.\t\tThe<br \/>\npicture that emerges, therefore, is that, according to the deceased,<br \/>\nshe suffered accidental burns.  According to her parents, it was a<br \/>\ncase of murder and that she was set ablaze by pouring kerosene by the<br \/>\naccused persons.  Both these versions are not accepted by the<br \/>\nInvestigating Officer and the Investigating Officer files charge<br \/>\nsheet for offences punishable under Sections 306  and 498A read with<br \/>\nSection 114 of the I. P. C. and he admits that he got no evidence to<br \/>\nconclude that the deceased was meted out with any physical or mental<br \/>\ntorture or harassment or that she committed suicide.  In light of the<br \/>\nabove situation, we are of the view that it is highly risky to<br \/>\nconfirm the confirmation recorded by the Trial Court and it deserves<br \/>\nto be set aside.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, the appeal is allowed.  The judgment and order of<br \/>\nconviction and sentence recorded by the Trial Court is hereby set<br \/>\naside.  Appellant No.1 be set at liberty forthwith, if not required<br \/>\nin any other case.  Appellant No.2 is on bail and her bail bond shall<br \/>\nstand cancelled.
