Petitioners are accused 1<\/p>\n<p>and   2   in   a   crime   registered   under   Sections   307   and   353   I.P.C.<\/p>\n<p>The crux of the allegations is that enraged by the conduct of the<\/p>\n<p>de facto complainant, who in his capacity as village officer, was<\/p>\n<p>attempting   to   interpose   the   commission   of   an   offence   &#8211;     illicit<\/p>\n<p>transportation   of   sand,     the   petitioners   obstructed   him   in   the<\/p>\n<p>discharge   of   his   duties   and   pushed   him   into   the   river   where<\/p>\n<p>strong current was flowing, with an intention to cause his death.<\/p>\n<p>The   alleged   incident   took place   on  26\/6\/2007.    Crime   has  been<\/p>\n<p>registered.     Investigation   is   in   progress.     The   petitioners<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<\/p>\n<p>      2.     The   learned   counsel   for   the   petitioners   submits   that<\/p>\n<p>the   petitioners   are   absolutely   innocent.     Totally   false   and<\/p>\n<p>vexatious allegations are being raised.   There  was an  exchange<\/p>\n<p>of   words   and   the   official,   who   had   questionable   motives   in   his<\/p>\n<p>attempt to seize a boat, had accidentally fallen into the water, it<\/p>\n<p>is submitted.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.4374\/07                           2<\/span><\/p>\n<p>       3.    The   learned   Public   Prosecutor   opposes   the<\/p>\n<p>application.     The   available   indications   point   to   the   guilt   of   the<\/p>\n<p>accused.     There   is   absolutely   no   justification   to   invoke   the<\/p>\n<p>equitable discretion under Section 438 Cr.P.C now, submits the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<\/p>\n<p>       4.    Having considered all the relevant inputs, I am of the<\/p>\n<p>opinion   that   there   is   merit   in   the   opposition   by   the   learned<\/p>\n<p>Public Prosecutor.         I   do   not   find   any   circumstances   which<\/p>\n<p>would justify invocation of the extraordinary equitable discretion<\/p>\n<p>under   Section   438   Cr.P.C.     This   is   a   fit   case   where   the<\/p>\n<p>petitioners   must   appear   before   the   learned   Magistrate   or   the<\/p>\n<p>investigating   officer   and   seek   regular   bail   in   the   normal   and<\/p>\n<p>ordinary course.\n<\/p>\n<\/p>\n<p>       5.    In   the   result,   this   petition   is   dismissed.
