Justice K.T.SANKARAN\n\n Dated :22\/12\/2009\n\n O R D E R\n                        K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.7542 of 2009\n                  ---------------------------------------------\n            Dated this the 22nd day of December, 2009\n\n\n\n                               ORDER\n<\/pre>\n<p>      This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure.                        The petitioner is<\/p>\n<p>accused No.3 in Sessions Case No.502 of 2007 on the file of the<\/p>\n<p>court of the Additional Sessions Judge, (Fast Track Court No.III),<\/p>\n<p>Palakkad District.\n<\/p>\n<p>      2.   The offence alleged against the accused is under<\/p>\n<p>Section 307 read with Section 176 of the Indian Penal Code.<\/p>\n<p>      3.   It is submitted by the learned counsel for the<\/p>\n<p>petitioner that going by the charge sheet, the allegation levelled<\/p>\n<p>against accused Nos.2 to 5 is that they committed the offence<\/p>\n<p>under Section 176 of the Indian Penal Code.<\/p>\n<p>      4.   It is stated that the petitioner was arrested and he<\/p>\n<p>was released on bail during the stage of investigation. During<\/p>\n<p>committal proceedings also, the petitioner states, he appeared<\/p>\n<p>before court.    After committal, the case was numbered as<\/p>\n<p>S.C.No.502 of 2007 on the file of the court of the Additional<\/p>\n<p><span class=\"hidden_text\">BA No.7542\/2009                   2<\/span><\/p>\n<p>Sessions Judge (Fast Track Court No.III), Palakkad. The<\/p>\n<p>petitioner was released on bail by the Additional Sessions Court.<\/p>\n<p>It is stated that later the petitioner went abroad on 25.3.2007.<\/p>\n<p>The bail bonds were cancelled and non bailable warrant was<\/p>\n<p>issued against the petitioner, since the petitioner failed to<\/p>\n<p>appear before court.      The petitioner apprehends arrest in<\/p>\n<p>execution of the non bailable warrant. Therefore, he has filed<\/p>\n<p>the application for anticipatory bail.\n<\/p>\n<p>      5.    In Vineeth Somarajan @ <a href=\"\/doc\/991205\/\">Ambady vs. State of<\/p>\n<p>Kerala<\/a> (2009(3) KHC 471), it was held that in cases where<\/p>\n<p>non bailable warrant is issued by the court on account of non<\/p>\n<p>appearance of the accused, normally, the person against whom<\/p>\n<p>the warrant is issued has to approach the court which issued the<\/p>\n<p>warrant for re-calling the warrant and for the grant of bail. He<\/p>\n<p>cannot, normally, straight away approach the High Court<\/p>\n<p>invoking Section 438 of the Code of Criminal Procedure.
