Desai seeking direction from<br \/>\n\tthis Court to the respondent Corporation to make available certified<br \/>\n\tcopy of all relevant documents and information which the petitioner<br \/>\n\thas asked in relation to change in policy in connection with gas<br \/>\n\tconnection.\n<\/p>\n<p>\tThis Court has issued<br \/>\n\tnotice on 27.7.2004. Thereafter, rule was issued on 16.9.2005 and<br \/>\n\tmatter was ordered to be expedited.\n<\/p>\n<p>\tIt is the case of the<br \/>\n\tpetitioner that Baroda Municipal Corporation supplies gas line for<br \/>\n\tnatural gas connection for domestic fuel consumption. The petitioner<br \/>\n\tvide his application dated 27.2.2004 requested the Corporation to<br \/>\n\tsupply certain documents relating to new policy for gas connection,<br \/>\n\tas per which a new meter is required to be installed by the consumer<br \/>\n\thaving gas connection. Since the documents were not supplied<br \/>\n\treminder was sent on 10.5.2004.  The Corporation vide its letter<br \/>\n\tdated 23.6.2004 refused to make available documents relating to new<br \/>\n\tpolicy and hence the petitioner has filed the present petition.\n<\/p>\n<p>\tAfter the petition was<br \/>\n\tadmitted in September, 2005 it appears that the petitioner has not<br \/>\n\tbothered for outcome of this petition. In February, 2010 fresh<br \/>\n\tnotice was issued to the petitioner for final hearing, as the<br \/>\n\tpetitioner is appearing as party in person. The said notice came<br \/>\n\tback unserved as the petitioner is not residing at the address given<br \/>\n\tin the cause title of the petition. Once the petition is admitted<br \/>\n\tand once it has come up for final hearing it is obligatory on the<br \/>\n\tpart of the petitioner to remain in touch with the matter and to<br \/>\n\tremain present. It is not the duty of this Court to issue fresh<br \/>\n\tnotice again and again.\n<\/p>\n<p>\tBe that as it may, on<br \/>\n\tbehalf of the respondent an affidavit-in-reply is filed. On behalf<br \/>\n\tof the respondent it is stated therein that for meters the<br \/>\n\tCorporation had invited bids and the meters of the bidders were sent<br \/>\n\tfor testing by Fluid Control Research Institute, Ministry of Heavy<br \/>\n\tIndustries at Kerala, which is the only testing organization in the<br \/>\n\tcountry. There are only two places in the whole India which<br \/>\n\tmanufacture such type of meters and out of the said two parties, one<br \/>\n\tof the party&#8217;s test report was received and approved. So far as the<br \/>\n\tsecond party is concerned the test report is approved, but the party<br \/>\n\tis yet to restart the process of selling the meters. There is no<br \/>\n\tcompulsion for consumer to take gas supplies from the respondent<br \/>\n\tCorporation. So far as reference is made to the pamphlet relating to<br \/>\n\tthe important notice to the gas consumers, it is also available and<br \/>\n\thence it cannot be said that the same has not been supplied. Even<br \/>\n\twith regard to the Resolution of the General Board the same is<br \/>\n\tattached alongwith the affidavit-in-reply.  The Resolution was<br \/>\n\tpassed by the Gas Committee of the respondent Corporation dated<br \/>\n\t7.3.2001.  Even the Resolution passed by the General Board of the<br \/>\n\trespondent Corporation dated 16.4.2001 is also placed on record. It<br \/>\n\twas specifically denied that the Corporation has given any monopoly<br \/>\n\tfor the supply of meters.  Alongwith the affidavit-in-reply even the<br \/>\n\tnew policy for grant of gas supply has been formulated.  It is also<br \/>\n\tclarified that the issue comes within the policy matter of the<br \/>\n\trespondent Corporation. It is also provided that for those consumers<br \/>\n\twho have chosen to take gas connection and install the meters on<br \/>\n\ttheir own, meter rent is not recovered. While applying for gas<br \/>\n\tconnection no contractual terms existed between the Corporation and<br \/>\n\tthe petitioner.\n<\/p>\n<p>\tIn view of above<br \/>\n\taffidavit-in-reply and also in view of affidavit-in-sur-rejoinder it<br \/>\n\tappears that nothing further is required to be made in the present<br \/>\n\tpetition. The petition is accordingly disposed off. Rule is<br \/>\n\tdischarged without any order as to costs.\n<\/p>\n<p>    (K. A.
