No.7979 of 2010\n\nSmt. Angoori Bai and another                   Leeladhar and another\n\n\n30.6.2010\n\n\n      Shri R.K. Nanhoria, Counsel for the petitioners.\n      This petition is directed against an order dated\n5.5.2010 by the District Judge, Hoshangabad in Civil Suit\nNo.6-A\/2008 by which the petitioners who were defendants\nhave been directed to put proper valuation of the counter\nclaim and to make payment of deficit court fees on it.\n      Learned     counsel      appearing     for   the   petitioners\nsubmitted that the petitioners want to withdraw the counter\nclaim with liberty to file fresh suit against the respondent but<\/pre>\n<p>is apprehending that such application may be rejected by the<br \/>\ntrial Court in view of the order dated 5.5.2010 so the some<br \/>\ndirections may be issued to the trial Court.\n<\/p>\n<p>      The apprehension of the petitioners is misconceived.<br \/>\nWhen the petitioners have filed counter claim on which the<br \/>\ntrial Court has directed for putting proper valuation and<br \/>\npayment of court fees, if the petitioners want to withdraw the<br \/>\naforesaid counter claim, petitioners are always free to it.<br \/>\nEven if the petitioners fails to put the valuation of the counter<br \/>\nclaim and make payment of the deficit court fees, the<br \/>\nconsequences which would follow will be in accordance with<br \/>\nthe provisions as contained under Order 7 Rule 11 C.P.C. i.e.<br \/>\nRejection of the counter claim.      However Order 7 Rule 13<br \/>\nCPC takes care of such situation and in case of dismissal of<br \/>\nthe counter claim because of non-payment of the court fees,<br \/>\nthe petitioners are not precluded from filing a fresh suit<br \/>\nagainst the plaintiff.\n<\/p>\n<p>      In view of the specific provisions as contained under<br \/>\nOrder 7 Rule 13 C.P.C., the apprehension of the petitioners is<br \/>\nmisconceived. Petitioners may file an application before the<br \/>\n                       W.P. No.7979 of 2010<\/p>\n<p>Smt. Angoori Bai and another                 Leeladhar and another<\/p>\n<p>30.6.2010<\/p>\n<p>trial Court for withdrawal of the counter claim which shall be<br \/>\nconsidered by the trial Court in accordance with the aforesaid<br \/>\nprovisions.\n<\/p>\n<p>      With the aforesaid liberty, this petition is disposed of<br \/>\nfinally with no order as to costs.<\/p>\n<pre>\n\n\n\n\n (Krishn Kumar Lahoti)                       (J.K.
