AG and Senior Counsel with Ms.Sangeeta Vishen with\nMr.Harsh Jani - for Opponent \/ Respondent\nNo.16 \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/10\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p> ON SPEAKING TO MINUTES<\/p>\n<p>[1]\tThis<br \/>\nspeaking to minutes note has been filed by  Ms.Sangeeta<br \/>\nVishen, learned counsel for the respondent No.12 for clarification as<br \/>\nstated in the speaking to minutes in paragraph No.3.\n<\/p>\n<p>[2]\tLearned<br \/>\nAdvocate General Shri Kamal Trivedi,  appearing with learned counsel<br \/>\nMs.Sangeeta Vishen, has submitted and emphasized that the note has<br \/>\nbeen filed for clarification with regard to the fact that the<br \/>\nconstruction has already been completed which was also opposed when<br \/>\nthe matter was argued and for which he referred to the chronology of<br \/>\nthe events.\n<\/p>\n<p>[3]\tLearned<br \/>\nsenior counsel  Shri B. B. Naik appearing for the applicant &#8211;<br \/>\nappellant in Civil Application No.7446\/2011 in Appeal from Order<br \/>\nNo.255\/2011 and learned counsel Shri P. S. Champaneri appearing for<br \/>\nthe applicant in Civil Application No.7547\/2011 in Appeal from Order<br \/>\nNo.258\/2011 have raised the objection with regard to the<br \/>\nmaintainability of the speaking to minutes. Shri B. B. Naik, learned<br \/>\nsenior counsel  and learned counsel Shri P. S. Champaneri submitted<br \/>\nthat such speaking to minutes is not maintainable and any such<br \/>\nclarification and substitution is beyond the scope. They, therefore,<br \/>\nsubmitted that no order may be passed.\n<\/p>\n<p>[4]<br \/>\nLearned Advocate General Shri Kamal Trivedi  appearing with learned<br \/>\ncounsel Ms.Sangeeta Vishen has referred to and relied upon the<br \/>\nGujarat High Court Rules more particularly Rules 137, 138 and 138(iv)<br \/>\nand submitted that the clarification of correction after the text is<br \/>\nreceived, such note for speaking to minutes can be filed. He has<br \/>\nsubmitted that he does not want addition or alteration in the texture<br \/>\nof order, the condition also remained the same.\n<\/p>\n<p>[5]\tIn<br \/>\nview of this, the contentions have been raised by the learned senior<br \/>\ncounsel Shri B. B. Naik as well as learned counsel Shri P. S.<br \/>\nChampaneri  that the speaking to minutes is not maintainable as it is<br \/>\nnot clarification but substitution which is not permissible. They<br \/>\nhave referred to the speaking to minutes and submitted that as quoted<br \/>\nin the speaking to minutes itself the order is clear and still<br \/>\nclarification is sought to focus about the use of the property.\n<\/p>\n<p>[6]\tThough<br \/>\nthe submissions have been made, it is evident that the order is clear<br \/>\nand it is regarding both construction as well as development of the<br \/>\nproperty. What has been requested by way of clarification is that a<br \/>\ndepositing the amount of Rs.50 Lakhs, if further development which<br \/>\nwould also include use and occupation thereof after the completion of<br \/>\nthe construction no right could be claimed. In other words, when the<br \/>\nCourt has used the word construction as well as development, that<br \/>\nitself indicate the stage after completion of the construction which<br \/>\nis sought to be clarified. Therefore, in fact the word &#8220;development&#8221;<br \/>\nhas been covering both the use and occupation and further development<br \/>\nafter the construction of the premises. Therefore, there is no need<br \/>\nfor any clarification.\n<\/p>\n<p>[7]\tWith<br \/>\nthe aforesaid observations, this speaking to minutes stands disposed<br \/>\nof.\n<\/p>\n<p>[<br \/>\nRAJESH H.
