DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/11\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered at<br \/>\n\tC.R.No.I &#8211; 70 of 2010 with Dhanera Police Station, for the<br \/>\n\toffences punishable under Sections 302, 498(A) and 114 etc. of the<br \/>\n\tIndian Penal Code.\n<\/p>\n<p>Mr.Chaudhary,<br \/>\n\tlearned counsel appearing for the applicants submits that the<br \/>\n\tapplicant is a victim of harassment by in-laws and initially, for a<br \/>\n\tnatural death which has caused due to serious ailments, the<br \/>\n\tapplicant was implicated for the offence punishable under Section<br \/>\n\t302 of the Indian Penal Code which after thorough investigation came<br \/>\n\tto be deleted. Not only that but on bare perusal of the FIR would be<br \/>\n\tthat there are general allegations about the harassment by the<br \/>\n\tapplicant and in marriage life of about ten years no grievance was<br \/>\n\tmade about any kind of harassment by the applicant. It is further<br \/>\n\tsubmitted that the charge-sheet is filed and considering overall<br \/>\n\tfacts and circumstances of the case by imposing suitable conditions,<br \/>\n\tthe applicant be enlarged on bail.\n<\/p>\n<p>Mrs.Krina<br \/>\n\tCalla learned APP for the respondent &#8211; State and learned<br \/>\n\tadvocate appearing for the complainant have opposed this application<br \/>\n\ton the ground that the deceased was illtreated by the applicant and<br \/>\n\tin-laws and in such kind of serious offences no bail can be granted.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and considering the papers of<br \/>\n\tcharge-sheet including postmortem note and certificate issued by<br \/>\n\tDr.Manishkumar Navinbhai Thakkar and the nature of injuries and no<br \/>\n\tmark of injuries noticed and there is no dispute about the serious<br \/>\n\till-ailments of fever and weakness of the victim, which was taken<br \/>\n\tcare by her in-laws and being treated in the hospital since year. It<br \/>\n\tis submitted that by imposing suitable conditions, the applicant can<br \/>\n\tbe enlarged on bail.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered at C.R.No.I &#8211; 70 of<br \/>\n\t2010 with Dhanera Police Station, on executing bond of Rs.10,000\/-<br \/>\n\t[Rupees Ten Thousand Only] with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\the shall;\n<\/p>\n<p>\t(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender his<br \/>\npassport, if any, to the lower Court within a week;\n<\/p>\n<p>(d)\tnot leave the State<br \/>\nof Gujarat without prior permission of the Sessions Judge concerned;\n<\/p>\n<p>(e)\tmark his presence at<br \/>\nthe concerned Police Station on the first Sunday of every month<br \/>\nbetween 10.00 a.m and 3.00 p.m for three months only;\n<\/p>\n<p>(f)\tfurnish the present<br \/>\naddress of residence to the Investigating Officer and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant  only of he is  not required<br \/>\n\tin connection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extend.
