M. SAHAI)<\/p>\n<p>Learned<\/a><br \/>\n\tcounsel for the appellant has urged that the respondent was<br \/>\n\tappointed on contract basis and the appointment letters were filed<br \/>\n\tbefore the Labour Court. But they have not been considered in true<br \/>\n\tperspective. The case was covered by the provisions of Section 2<br \/>\n\t(oo) (bb) of the Industrial Disputes Act, 1947.  The Learned Single<br \/>\n\tJudge has not assigned any reason or dealt with the arguments of<br \/>\n\tlearned counsel of the appellant and has only said that he is<br \/>\n\tagreeing with the reasoning given by the Labour Court.\n<\/p>\n<p>In<br \/>\n\tview of these facts, since the respondent was appointed on contract<br \/>\n\tbasis, the appellant is entitled for interim order.  Hence, ADMIT.\n<\/p>\n<p> ORDER<br \/>\n\tIN CIVIL APPLICATION NO.6136 of 2011<\/p>\n<p>Until<br \/>\n\tfurther orders, the effect and operation of the judgment dated<br \/>\n\t27.08.2010 passed by the Learned Single Judge in Special Civil<br \/>\n\tApplication No.10143 of 2010 and the award dated 20.11.2009 of the<br \/>\n\tLabour Court, Bhuj &#8211; Kachchh in Reference (LCB) No.27 of 2004<br \/>\n\tshall remain stayed.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[V.
