Nos. 65 &amp; 142 OF 1998\n                   = = = = = = = = = = = = = = =\n              Dated this the 24th day of May 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>        Both these appeals are preferred against the<\/p>\n<p>judgment and decree passed by the Subordinate Judge,<\/p>\n<p>Hosdrug in O.S.42\/96. The suit is one for recovery of<\/p>\n<p>possession of 30 cents of property. The court below<\/p>\n<p>granted a decree for recovery of possession of the<\/p>\n<p>property and permitted the plaintiff to realize mesne<\/p>\n<p>profits but ordered value of improvements to be paid to<\/p>\n<p>the defendant.      Against the decree for recovery of<\/p>\n<p>possession and the mesne profits the defendant has<\/p>\n<p>come up in appeal as A.S.65\/98 and against the order to<\/p>\n<p>grant value of improvements the plaintiff has come up in<\/p>\n<p>appeal as A.S.142\/98. The brief facts necessary for the<\/p>\n<p>disposal are as follows.\n<\/p>\n<p>.A.S. Nos. 65 &amp; 142 OF 1998<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>         2.     The plaintiff is the Plantation Corporation<\/p>\n<p>of Kerala. By virtue of an order, Ext.A1 the Government of<\/p>\n<p>Kerala had sanctioned to accord lease of 1192.718<\/p>\n<p>hectres of forest land in Panathady village Kasaragod<\/p>\n<p>Range comprised in Survey No.317 of that village along<\/p>\n<p>with some other properties. As per clause No.V of Ext.A1,<\/p>\n<p>&#8220;an agreement shall be executed by the lessee<\/p>\n<p>incorporating the above terms and conditions of lease<\/p>\n<p>and also any other conditions that may be insisted on.&#8221;<\/p>\n<p>So Ext.A1 only evidences a transaction whereby the<\/p>\n<p>Government have accorded sanction for the lease of the<\/p>\n<p>property.    I am informed that on the strength of Ext.A1,<\/p>\n<p>subsequently lease document has been executed. When<\/p>\n<p>a Government property is leased, it is certain that there<\/p>\n<p>will be a sketch accompanying the lease deed. Now the<\/p>\n<p>plaintiffs claim recovery of possession of the property<\/p>\n<p>comprised in survey No. 317 on the strength of title. The<\/p>\n<p>defendant on the other hand would contend that he has<\/p>\n<p>.A.S. Nos. 65 &amp; 142 OF 1998<br \/>\n<span class=\"hidden_text\">                                -3-<\/span><\/p>\n<p>got property in survey Nos. 370\/01 and 370\/02 and along<\/p>\n<p>with the same she is in possession of the property<\/p>\n<p>described in the plaint schedule and therefore the<\/p>\n<p>plaintiff does not have title to the plaint schedule<\/p>\n<p>property. So in order to succeed in a suit of this nature<\/p>\n<p>the plaintiff has to prove by production of title deed that<\/p>\n<p>the property described in the plaint schedule property<\/p>\n<p>forms part and parcel of the property leased in favour of<\/p>\n<p>the plaintiff. If it is established then only the question of<\/p>\n<p>adverse possession or limitation that may have to be<\/p>\n<p>considered.     If the property described in the plaint<\/p>\n<p>schedule property is not taken in by the lease deed then<\/p>\n<p>most probably the Government alone may have a right<\/p>\n<p>over the property which is to be decided separately by an<\/p>\n<p>independent suit.\n<\/p>\n<p>         3.     Now so far as this suit is concerned the<\/p>\n<p>question to be resolved is whether the plaint schedule<\/p>\n<p>property is taken in by the lease granted in favour of the<\/p>\n<p>.A.S. Nos. 65 &amp; 142 OF 1998<br \/>\n<span class=\"hidden_text\">                              -4-<\/span><\/p>\n<p>plaintiff or not. If the answer is in positive then unless it<\/p>\n<p>is barred by adverse possession, the plaintiff will be<\/p>\n<p>entitled to get recovery of possession of the property.<\/p>\n<p>Therefore the matter requires consideration at that angle.<\/p>\n<p>         4.      So far as the decree in A.S.142\/98 is<\/p>\n<p>concerned if it is found that the plaintiff has got title to<\/p>\n<p>the property and the defendant is a trespasser of the<\/p>\n<p>property then by no stretch of imagination a trespasser is<\/p>\n<p>entitled to claim value of improvements over the<\/p>\n<p>property. It all depends upon the question of title of the<\/p>\n<p>plaintiff to get a decree in his favour.      Therefore the<\/p>\n<p>matter requires reconsideration.\n<\/p>\n<p>         5.      Hence the judgment and decree of the<\/p>\n<p>trial court is set aside and an opportunity is given to the<\/p>\n<p>plaintiff as well as the defendant to produce both<\/p>\n<p>documentary as well as oral evidence in support of their<\/p>\n<p>respective contentions and let the property be identified<\/p>\n<p>in accordance with the title deeds and the matter be<\/p>\n<p>.A.S.
