Justice R.BASANT\n\n Dated :19\/02\/2007\n\n O R D E R\n                                  R.BASANT, J\n\n                               ----------------------\n\n                           Crl.M.C.No.4040 of 2006\n\n                          &amp; Tr.P.(Crl).No.30 of 2007\n\n                         ----------------------------------------\n\n               Dated this the  19th day of February  2007\n\n\n\n\n                                    O R D E R\n<\/pre>\n<p>       These   petitions   are   filed   by   the   complainant<\/p>\n<p>(Tr.P.Crl.No.30\/2007)   and   the   accused   (Crl.M.C.No.4040   of<\/p>\n<p>2006)   respectively   in   C.C.No.798\/2002   pending   before   the<\/p>\n<p>Judicial   First   Class   Magistrate   Court,   Pala.     The   accused<\/p>\n<p>complains   that   the   court   at   Pala   has   no   territorial   jurisdiction<\/p>\n<p>and   it   is   the   court   at   Calicut   which   has   jurisdiction   to   try   the<\/p>\n<p>cases.   The complainant who had filed the complaint before the<\/p>\n<p>court at Pala now prays that the case may be transferred to the<\/p>\n<p>Court at Calicut.\n<\/p>\n<p>       2.     Both the complainant and the accused have now made<\/p>\n<p>a joint prayer that the case may be transferred from the court at<\/p>\n<p>Pala to the court at Calicut.   I am satisfied that the said request<\/p>\n<p>made   separately   by   the   complainant   and   the   accused   can   be<\/p>\n<p>accepted and transfer can be directed, as prayed for.\n<\/p>\n<p>       3.     There is, of course,  a prayer by the petitioner\/accused<\/p>\n<p>in Crl.M.C.No.4040\/2006 that the proceedings may be quashed. I<\/p>\n<p>Crl.M.C.No.4040\/2006 &amp;<\/p>\n<p><span class=\"hidden_text\">Tr.P.Crl.No.30\/2007                    2<\/span><\/p>\n<p>find absolutely no reason to justify the said prayer for quashing<\/p>\n<p>of proceedings.   No grounds have been urged in support of that<\/p>\n<p>prayer   and   the   alternative   prayer   cannot   be   accepted.     The<\/p>\n<p>prayer   that the case may be transferred to the court at Calicut<\/p>\n<p>can be accepted.\n<\/p>\n<p>       4.    In   the   result,   these   petitions   are   allowed.\n<\/p>\n<p>C.C.No.798\/2002   pending   before   the   Judicial   First   Class<\/p>\n<p>Magistrate   Court,   Pala   is  transferred   to   the  Judicial  First   Class<\/p>\n<p>Magistrate   Court-I,   Calicut.     Parties   shall   appear   before   the<\/p>\n<p>learned Magistrate at Calicut on 26\/03\/2007 without waiting for<\/p>\n<p>any further directions.
