Heard the learned counsel for the parties.\n<\/p>\n
Being
\naggrieved\u00a0 and dissatisfied by the judgement and order dated 18.4.2006
\npassed\u00a0 in Complaint No.80 of 2001 by the State Consumer Disputes
\nRedressal Commission Gujarat State,\u00a0 at\u00a0 Ahmedabad,
\nthe complainant has preferred this appeal.\u00a0\n<\/p>\n
\u00a0Undisputedly,
\nby an Agreement dated 31.12.1996 the complainant has agreed to purchase a flat
\nfor a\u00a0 consideration of
\nRs.9,10,000\/-.\u00a0\u00a0 It was also agreed that possession of the said flat
\nwas to be delivered to the complainant on or before 31.12.1998.\n<\/p>\n
It is the say of
\nthe complainant that the complainant paid a sum of Rs.30,000\/- on
\n6.9.1996,\u00a0 Rs.7,20,000\/- on 28.2.1997\u00a0 and Rs.1,60,000\/- on 1.1.1997
\ni.e. in all Rs.9,10,000\/- to the respondents.\u00a0 There is no dispute between
\nthe parties with regard to payment of the above stated amounts.\u00a0\n<\/p>\n
She further
\ncontends that\u00a0 in addition to the aforesaid
\namounts,\u00a0 she had\u00a0 paid\u00a0 an amount of Rs.\n<\/p>\n
3,60,000\/-\u00a0 in cash on 26.12.1996 to the Opp.
\nParties-Builders.\u00a0 In support of this contention,\u00a0
\nreliance is placed upon the\u00a0 Pass Book\u00a0 of Bharat
\nOverseas Bank\u00a0 which shows that the said amount\u00a0 of Rs.3,60,000\/- was
\nwithdrawn by the complainant\u00a0 on the said date.\n<\/p>\n
\u00a0 She has
\nalso relied\u00a0 on the cheque\u00a0
\ngiven to Ms. Bhadresh K. Shah for 1501 Pounds encashable at National Westminister
\nBank,   London.\u00a0 Similarly,
\nanother\u00a0 cheque was
\nissued for 1501 Pounds\u00a0 in favour of Jayshree B. Shah and a third cheque
\nwas issued in favour of Kalpana\u00a0
\nS. Shah on\u00a0 the same Bank.\u00a0 All the cheques
\nwere issued on 29.12.1996.\u00a0 The total\u00a0 comes
\nto 4603 Pounds   Sterling.\u00a0\u00a0\n<\/p>\n
On that basis, the Complainant has calculated\u00a0 the
\nequivalent value in Indian Ruppee at\u00a0
\nRs.2,90,000\/-.\u00a0 The Complainant has pointed out that the cheques were issued at the instance of one of the partners
\nof the builder, namely, Mr. Badresh K.\n<\/p>\n
Shah.\u00a0\u00a0 Mrs. Jayshree B. Shah\u00a0\u00a0
\nis the wife of Badresh K. Shah. The said cheques were\u00a0 credited in favour of respective persons, who are the relatives of the
\npartners of builders.\n<\/p>\n
Thereafter, as
\nthe possession of the flat was not delivered, as agreed, the complainant was
\nrequired to approach the State Commission by filing Complaint on 4.5.2001 with
\na prayer to direct the Builders\u00a0 to complete the
\nentire work of the flat as per the specification shown in the advertisement and
\nto pay a sum of Rs.19,99,950\/- with interest @ 13.5% per annum from the date of
\napplication till realization.\u00a0 The amount of Rs.19,99,950\/-
\nwas calculated on various counts,\u00a0 as mentioned in paragraph 23 of the
\ncomplaint.\u00a0\n<\/p>\n
After
\nconsidering the facts,\u00a0 the complaint was partly allowed by the State
\nCommission and the Builders were directed to carry out the remaining work as
\nper the brochure,\u00a0 within one months\u00a0 time after mutually adjusting
\nthe dates, failing which builders were directed to pay a sum of Rs.1,27,650\/-
\nwith costs of Rs.2500\/-.\n<\/p>\n
 Findings:\n<\/p>\n
Learned counsel
\nappearing on behalf of the appellant submitted that the State Commission
\nmaterially erred in not considering the payment of the extra amount\u00a0 by
\nthe complainant to the\u00a0\u00a0 Builders,\u00a0\u00a0\u00a0\u00a0 by merely
\nobserving that\u00a0 as there was a denial by the builders with regard to the
\nreceipt of the three cheques on the names of the
\nrelatives of Opp. Party(s) in pound sterling because
\nsuch\u00a0 transactions on the\u00a0 face of it may raise ugly question
\nunrelated to this complaint and will not contribute to solve or help to solve
\nthe complaint.\n<\/p>\n
In our view, the
\napproach of the State Commission is totally unjustified because there is no
\ndenial on the part of Mr. Badresh K. Shah with regard
\nto the said cheques.\u00a0 Further,\u00a0
\nthe complainant has issued the three cheques
\non the same day i.e. 29.12.1996 in favour of
\nrelatives of partners of the builders. There is no other reason\u00a0 mentioned by the Builder to contend that the\u00a0
\ncomplainant was required to issue the cheques in the
\nname of said three ladies in   London
\nwho are not related to complainant.\u00a0\n<\/p>\n
Further, in the
\nevidence, which was recorded by the State Commission, Mr.Badresh
\nK. Shah has admitted that Mrs. Jayshree B. Shah is
\nhis wife and that\u00a0 he does not remember whether
\nthe cheque was drawn on the Nat West
\nBank.\u00a0\u00a0 He has not denied the issuance of the said cheques or receipt of the said amount.\n<\/p>\n
Hence,\u00a0 the receipt\u00a0 of the said amount cannot be
\ndisputed as\u00a0 the same was paid by cheques and
\nthe cheques were\u00a0 also encashed
\nby the relatives of one of the partners.\u00a0 That\u00a0
\namount comes to Rs.2,90,000\/-. Considering this aspect, respondents are
\nrequired to refund the amount of Rs.2,90,000\/- .\u00a0\n<\/p>\n
Secondly, it is
\ncontended by the complainant that she paid Rs.3,60,000\/-
\nin cash on 26.12.1996 to the builders as demanded by them.\u00a0 For this
\npurpose, she has relied upon the Bank entry whereby she has withdrawn Rs.3,60,000\/- in cash on 26.12.1996.\u00a0 In our view, it would
\nbe difficult for us to accept\u00a0 the said
\ncontention as there is no other evidence in support of the say of the
\ncomplainant that she was compelled to pay the said amount in cash to the
\nbuilders.\u00a0 We cannot presume that the said amount was paid to the
\nbuilders.\n<\/p>\n
Further, apart
\nfrom the aforesaid payments, it is apparent that the flat remained incomplete
\nfor years together and it was finally completed after the direction issued by
\nthis Commission.\u00a0 As against this, learned counsel for the Opp. Party pointed out that even before the State
\nCommission, Builders were prepared to complete the construction work as per
\nrequirement of the brochure but the complainant was not permitting them to
\ncomplete the said work and she was regularly visiting the UK.\n<\/p>\n
Learned counsel
\nMr. Mehta also\u00a0 submitted that the complainant
\nwas required to pay maintenance charges as well as car parking and development
\ncharges which according to Mr. Mehta comes to Rs. 2 lacs which she has not paid uptil
\nnow despite taking possession. Therefore, the builders were not at fault in
\ncompleting the construction work.\n<\/p>\n
It appears that
\npossession of the flat was given to the complainant by the intervention of
\nPolice help on 11.11.2000.\u00a0 No doubt, it was an incompleted\u00a0 flat. As the dispute persisted, as per direction
\ngiven by the State Commission, registered documents were executed in favour of the complainant with regard to the said
\nflat.\u00a0\u00a0 It is to be stated that on the basis of our direction Punchnama with regard to the construction of the flat was
\nprepared.\u00a0 As per the Punchnama\u00a0 the flat was fully constructed as per the
\nbrochure.\u00a0 No doubt, there is an endorsement made in the Punchnama by the complainant that it was not to her
\nsatisfaction.\n<\/p>\n
Further,
\nthe\u00a0 complainant has pointed out that as per the payment schedule which
\nhas been given by the Opp. Parties, covered car
\nparking charges was for a sum of Rs.50,000\/- and for life time maintenance
\ncharges and development charges\u00a0 were required to be paid\u00a0 i.e. Rs.40,000\/-
\nand\u00a0 Rs.25,000\/- respectively.\u00a0 The total comes to Rs.1,15,000\/-.\u00a0\n<\/p>\n
Considering the
\naforesaid aspect, in our view, it would be just and proper to direct the
\nrespondents\u00a0 to refund the amount of Rs.2,90,000\/- by deducting\u00a0
\nRs.1,15,000\/- which comes to Rs.1,75,000\/- and also pay interest @ 10% p.a. on
\nRs.9,10,000\/- for 1 year and 10 months\u00a0 delay in delivering the
\npossession, which comes to approximately Rs.1,66,833\/- and cost of litigation
\ni.e. in all Rs.50,000\/-.\u00a0 Respondents, in all,\u00a0
\nshall pay a sum of\u00a0\u00a0 Rs.3,91,833\/-\u00a0 ( Rs.1,75,000 +
\nRs.166,833\/- + Rs.50,000\/-) within a period of 6 weeks from today.\u00a0 The
\nAppeal stands disposed of accordingly.\n<\/p>\n
