(J)\n\nCITATION:\n JT 1996 (3)   678\t  1996 SCALE  (3)189\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Intervention is allowed.\n<\/p>\n<p>     Leave granted.  We have  heard learned  counsel on both<br \/>\nsides.\n<\/p>\n<p>     Notification  under   Section  4\t[1]  of\t  the\tLand<br \/>\nAcquisition Act, 1894 [for short, the &#8216;Act&#8217;] acquiring large<br \/>\nextent of  land for  National Thermal Power Corporation, was<br \/>\npublished  on  September  22,  1979.  The  Land\t Acquisition<br \/>\nOfficer determined  compensation 8  Rs.3,000\/- per  acre. On<br \/>\nreference, the\tlearned sub-Judge  enhanced the compensation<br \/>\nto Rs.6,500\/-  per acre. On appeal, the High Court of Andhra<br \/>\nPradesh confirmed the order passed by the learned sub-Judge.<br \/>\nThus this appeal by special leave.\n<\/p>\n<p>     It is  not in  dispute that  when for  the same purpose<br \/>\nanother land  was acquired  from Maidpalli  village to which<br \/>\nLingapur is  a hamlet,\tthe  Corporation  itself  had  taken<br \/>\ndecision to  withdraw the appeals since the compensation was<br \/>\nless  than   Rs.8,000\/-.  On  that  basis,  the\t High  Court<br \/>\nconfirmed the  market value at Rs.8,400\/- per acre in Appeal<br \/>\nNos.869 and  871 of  1985. In  view of\tthe  fact  that\t the<br \/>\nCorporation itself  had taken  a policy decision to withdraw<br \/>\nthe appeals  where the\tvalue of  the land was determined at<br \/>\nthe rate  of Rs.8,000\/-\t per acre  and less,  and since\t the<br \/>\nlands are  situated  in\t the  hamlet  of  the  main  village<br \/>\nNaidpalli which\t are contiguous blocks, the determination of<br \/>\nthe compensation  in respect of these lands also would be at<br \/>\nthe rate of Rs.8,000\/- per acre.\n<\/p>\n<p>     The appeal\t is accordingly allowed to the above extent.<br \/>\nThe appellant  is entitled  to solatium\t and interest on the<br \/>\nenhanced compensation  at the  rates prevailing prior to the<br \/>\nAmendment Act 68 of 1984.
