No.MX 0200064 in Claim No.O\/A\/0300151<br \/>\n\twhereby the Tribunal has dismissed both the claim applications with<br \/>\n\tcost of Rs.10,000\/- payable to the respondent Union of India.\n<\/p>\n<p>The<br \/>\n\tshort facts of the case are as under:-\n<\/p>\n<p>\t\t On account of<br \/>\n\t\taccident 12.7.2001, the appellant No.1 lost his husband Shri<br \/>\n\t\tShankarbhai Purshottam Patel as he fell down from the passengers<br \/>\n\t\ttrain travelling from Surat to Udhna. The appellant No.1 is widow<br \/>\n\t\tand the appellant nos.2 and 3 are minor children of deceased<br \/>\n\t\tShankarbhai Patel.\n<\/p>\n<p>\t\tThe appellant<br \/>\n\t\tpreferred claim application praying for compensation of Rs.4 lacs<br \/>\n\t\tagainst the Union of India under the provisions of section 125 of<br \/>\n\t\tthe Railways Act, 1989 for which she engaged advocate Shri Manhar<br \/>\n\t\tR.Patel.\n<\/p>\n<p>\t\t  During the pendency<br \/>\n\t\tof the application, one another Advocate Mr.S.A.Jadhav approached<br \/>\n\t\tthe appellant no.1 and obtained her signatures on the papers<br \/>\n\t\tintroducing himself to have been sent by Shri Manhar Patel,<br \/>\n\t\tAdvocate engaged by the appellant No.1 and he filed another claim<br \/>\n\t\tapplication for the same cause of action.\n<\/p>\n<p>\t\t  On 21.2.2005 both<br \/>\n\t\tthe claim applications were notified for hearing. The learned<br \/>\n\t\tAdvocate for the Railways Department raised an objection in respect<br \/>\n\t\tof the application. However, though Mr.Manhar Patel requested the<br \/>\n\t\tCourt to grant appearance of Mr.Neville Debu on his behalf and<br \/>\n\t\tMr.Neville Debu, learned Advocate has filed his appearance through<br \/>\n\t\tapplication on the same day and though Mr.Debu, learned Advocate<br \/>\n\t\thad explained in detail about the filing of two claim applications<br \/>\n\t\tfor same cause of action, the Tribunal not only rejected both the<br \/>\n\t\tapplications but had also made observations that no one appeared on<br \/>\n\t\tbehalf of appellants with cost of Rs.10,000\/-.\n<\/p>\n<p>\t\t Being aggrieved by<br \/>\n\t\tthe order passed by the Railway Tribunal, the appellants herein<br \/>\n\t\thave approached this Court by way of filing this appeal.\n<\/p>\n<p>\tLearned Advocate for<br \/>\n\tthe appellants submitted that the Tribunal has erred in dismissing<br \/>\n\tboth the claim applications of the appellants as it has no authority<br \/>\n\tand jurisdiction to dismiss the first claim application without<br \/>\n\tdeciding it on merits only on the ground that the applicants,-<br \/>\n\tappellants herein have played fraud upon the Tribunal by seeking<br \/>\n\tcompensation twice. The learned advocate further submitted that the<br \/>\n\tTribunal is duty bound to decide the claim applications on merits<br \/>\n\tand cannot dismiss the application on the ground of exercise of<br \/>\n\tdiscretion for grant of relief on the basis of the conduct of the<br \/>\n\tapplicants.\n<\/p>\n<p>The<br \/>\n\tlearned advocate for the appellants also submitted that appellants<br \/>\n\thad not played any fraud upon the Tribunal. The appellant no.1 is an<br \/>\n\tilliterate lady and does not know English. Another Advocate<br \/>\n\tMr.Jadhav approached her representing himself to be sent by her<br \/>\n\tfirst Advocate Mr.Manhar Patel, and, therefore, she had signed the<br \/>\n\tdocuments which were later on misused claiming second claim<br \/>\n\tapplication before the Tribunal.\n<\/p>\n<p>I<br \/>\n\thave heard learned Advocates for the parties.  I have also gone<br \/>\n\tthrough the order passed by the Railway Claim Tribunal more<br \/>\n\tparticularly paras:5, 6 and 7 of the order which read as under:\n<\/p>\n<p>\u00fdS\n<\/p>\n<p>\t\t\t5. P.O. for the<br \/>\n\t\t\tRespondent Railway submitted that the Applicants have very<br \/>\n\t\t\tconveniently suppressed the material fact about their having<br \/>\n\t\t\tearlier filed Claim Application No.OA 0200093 for the same<br \/>\n\t\t\tdeceased, for the same cause of action and by the same Applicants,<br \/>\n\t\t\tas a result, they have played fraud on this Hon&#8217;ble Tribunal as<br \/>\n\t\t\talso the Applicants are fraudulently seeking compensation twice,<br \/>\n\t\t\twhich law does not permit and thus, the Applicants have to be<br \/>\n\t\t\tdealt with as per law.\n<\/p>\n<p>6.<br \/>\n\t\t\t  We have gone through the said Claim Applications along with the<br \/>\n\t\t\tApplication dated 07-12-2002 for condonation of delay and we find<br \/>\n\t\t\tthat in both the claim applications, as also in the Application<br \/>\n\t\t\tfor condonation of delay, the name of the deceased is \u00fdSShankerbhai<br \/>\n\t\t\tPursottam Patel\u00fd\u00fd and that the Applicants too being the same are<br \/>\n\t\t\tseeking compensation twice for the same deceased and for the same<br \/>\n\t\t\tcause of action, which is not permissible under the law, on the<br \/>\n\t\t\tcontrary, the Applicants have played fraud on this Tribunal and<br \/>\n\t\t\tmoreso, have suppressed material fact about their having filed<br \/>\n\t\t\tearlier Claim Application No.OA 0200093 and thus, the Applicants<br \/>\n\t\t\thave not approached with clean hands.\n<\/p>\n<p>7.<br \/>\n\t\t\t Since none are present for Applicants and moreso, the Applicants<br \/>\n\t\t\talso chose to be absenting themselves from the present cases, this<br \/>\n\t\t\tTribunal cannot sit as a silent spectator when such serious<br \/>\n\t\t\tviolations of law are crystal clear from the Claim Applications as<br \/>\n\t\t\talso from the said Misc.Application dated 07.12.2002 for<br \/>\n\t\t\tcondonation of delay and therefore, this Tribunal has to pass<br \/>\n\t\t\tappropriate directions and\/or order, which are as follows:-\n<\/p>\n<p>\t\t\t\t\t\t\t\t\t\t O R D E<br \/>\n\t\t\t\t\t\t\t\t\t\tR<\/p>\n<p>\t(a) Misc.Application<br \/>\nNo.MX 0200064 filed alongwith the Main Claim Application No.OA<br \/>\n0300151 DATED 07-12-2002 as also Claim Application No.OA 2000\/93 are<br \/>\ndismissed with costs of Rs.10,000\/- (Rupees Ten Thousand) to be paid<br \/>\nby the Applicants to the Respondent Railway.\n<\/p>\n<p>\t(b) The Respondent<br \/>\nRailway through General Manager, Western Railway, Mumbai, are<br \/>\ndirected to launch criminal prosecution against the Applicants as<br \/>\nalso against those persons who have abetted and harboured such<br \/>\ncriminal acts by offending the Law. The General Manager, Western<br \/>\nRailway, Mumbai, shall ensure filing of criminal prosecution<br \/>\nimmediately.\n<\/p>\n<p>\t(c)  The Additional<br \/>\nRegistrar of this Bench to send copy of this order to the Secretary,<br \/>\nBar Council of Gujarat at Ahmedabad, Opp.High Court of Gujarat, Sola<br \/>\nRoad, Ahmedabad, alongwith xerox copies of Vakalatnama of both the<br \/>\nAdvocates in the said two Main Claim Applications, who shall initiate<br \/>\ndisciplinary action against the said Advocate i.e. Shri Manhar Patel,<br \/>\nKotiwad, Post Kaliawadi, Navsari-396427 and Shri S.A. Jadav,<br \/>\nHarikrishna Apartment, K-207, Chhani Jakat Naka Circuit, Vadodara-2,<br \/>\nas per law.\n<\/p>\n<p>Perusal<br \/>\n\tof the record shows that the appellant has suppressed material facts<br \/>\n\tfrom the Tribunal. It cannot be said that the appellants were not<br \/>\n\taware of the proceedings. There is nothing on record to show that<br \/>\n\tthe second application was filed without their knowledge. It is also<br \/>\n\trequired to be noted that the applicants chose to remain absent in<br \/>\n\tthe matter. I am of the opinion that when two applications have been<br \/>\n\tfiled in respect of same cause of action and when the appellants<br \/>\n\tplayed fraud with the Court, the Tribunal was justified in passing<br \/>\n\tthe impugned order.\n<\/p>\n<p>As<br \/>\n\tregards order of the Railway Tribunal directing General Manager,<br \/>\n\tWestern Railway, Mumbai to initiate criminal prosecution  against<br \/>\n\tthe applicants and the persons involved with them in playing role of<br \/>\n\tfraud with the Tribunal, it will be open for the applicants to move<br \/>\n\tfor revival of their first claim application preferred before the<br \/>\n\tRailway Tribunal for its consideration on merits.
