\u00a0Learned\u00a0counsel\u00a0appearing\u00a0for\u00a0the\u00a0petitioner\u00a0mainly\u00a0submitted\u00a0that\u00a0no\u00a0<br \/>\nadequate \u00a0 notice \u00a0 is \u00a0 given \u00a0 to \u00a0 the \u00a0 petitioner \u00a0 before \u00a0 passing \u00a0 the \u00a0 impugned\u00a0<br \/>\norder.\u00a0It\u00a0is\u00a0an\u00a0admitted\u00a0fact,\u00a0even\u00a0as\u00a0per\u00a0paragraph\u00a05\u00a0of\u00a0the\u00a0counter\u00a0affidavit\u00a0<br \/>\nthat\u00a0only\u00a0two\u00a0days&#8217;\u00a0time\u00a0was\u00a0given\u00a0to\u00a0give\u00a0reply\u00a0of\u00a0the\u00a0show\u00a0cause\u00a0notice,\u00a0<br \/>\nissued\u00a0by\u00a0the\u00a0respondents\u00a0and\u00a0in\u00a0fact,\u00a0the\u00a0petitioner\u00a0has\u00a0given\u00a0a\u00a0reply,\u00a0it\u00a0has\u00a0<br \/>\nprinciple\u00a0of\u00a0natural\u00a0justice.\u00a0Moreover,\u00a0several\u00a0documents\u00a0have\u00a0been\u00a0relied\u00a0<br \/>\nupon\u00a0while\u00a0passing\u00a0the\u00a0impugned\u00a0order\u00a0by\u00a0the\u00a0Sub\u00a0Divisional\u00a0Officer,\u00a0Pakur,\u00a0<br \/>\nbut,\u00a0not\u00a0a\u00a0single\u00a0document\u00a0has\u00a0been\u00a0given\u00a0to\u00a0the\u00a0petitioner\u00a0and,\u00a0therefore\u00a0<br \/>\nalso,\u00a0there\u00a0is\u00a0violation\u00a0of\u00a0principle\u00a0of\u00a0natural\u00a0justice.\u00a0Some\u00a0report\u00a0has\u00a0been\u00a0<br \/>\ncalled\u00a0for\u00a0by\u00a0the\u00a0Sub\u00a0Divisional\u00a0Officer,\u00a0Pakur\u00a0and\u00a0the\u00a0same\u00a0has\u00a0never\u00a0been\u00a0<br \/>\ngiven \u00a0 to \u00a0 the \u00a0 petitioner \u00a0 and \u00a0 it \u00a0 has \u00a0 been \u00a0 relied \u00a0 upon \u00a0 while \u00a0 passing \u00a0 the\u00a0<br \/>\nimpugned \u00a0 order. \u00a0 Similarly, \u00a0 some \u00a0 statements \u00a0 of \u00a0 the \u00a0 alleged \u00a0 ration \u00a0 card\u00a0<br \/>\nholders\u00a0have\u00a0been\u00a0recorded,\u00a0but,\u00a0none\u00a0of\u00a0the\u00a0statements\u00a0have\u00a0been\u00a0supplied\u00a0<br \/>\nto\u00a0the\u00a0petitioner,\u00a0therefore,\u00a0the\u00a0petitioner\u00a0is\u00a0entitled\u00a0to\u00a0defend\u00a0its\u00a0case\u00a0and,\u00a0<br \/>\ntherefore,\u00a0the\u00a0impugned\u00a0order\u00a0deserves\u00a0to\u00a0be\u00a0quashed\u00a0and\u00a0set\u00a0aside\u00a0and\u00a0the\u00a0<br \/>\nmatter\u00a0may\u00a0be\u00a0remanded\u00a0to\u00a0the\u00a0concerned\u00a0appellate\u00a0authority\u00a0so\u00a0as\u00a0to\u00a0give\u00a0<br \/>\nadequate\u00a0opportunity\u00a0to\u00a0the\u00a0petitioner\u00a0to\u00a0represent\u00a0its\u00a0case.\n<\/p>\n<p>3.\u00a0 \u00a0I\u00a0have\u00a0heard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0respondents,\u00a0who\u00a0has\u00a0submitted\u00a0<br \/>\nthat\u00a0notice\u00a0was\u00a0given\u00a0to\u00a0the\u00a0petitioner,\u00a0as\u00a0stated\u00a0in\u00a0the\u00a0counter\u00a0affidavit,\u00a0<br \/>\nbefore\u00a0passing\u00a0the\u00a0impugned\u00a0order.\u00a0\u00a0The\u00a0reply\u00a0was\u00a0given\u00a0after\u00a0the\u00a0time\u00a0limit\u00a0<br \/>\n                                       \u00a0\u00a0\u00a0\u00a0\u00a0\u00ad2\u00ad<br \/>\nis\u00a0over\u00a0and,\u00a0therefore,\u00a0the\u00a0same\u00a0has\u00a0not\u00a0been\u00a0considered\u00a0by\u00a0the\u00a0respondents\u00a0<br \/>\nIt \u00a0 is \u00a0 fairly \u00a0 submitted \u00a0 by \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 respondents \u00a0 that \u00a0 the\u00a0<br \/>\ndocuments,\u00a0relied\u00a0upon\u00a0by\u00a0the\u00a0Sub\u00a0Divisional\u00a0Officer,\u00a0Pakur\u00a0while\u00a0passing\u00a0<br \/>\nthe\u00a0impugned\u00a0order,\u00a0have\u00a0not\u00a0been\u00a0supplied\u00a0to\u00a0the\u00a0petitioner.\u00a0Nonetheless,\u00a0<br \/>\nthe \u00a0 appeal \u00a0 is \u00a0 provided \u00a0 against \u00a0 the \u00a0 impugned \u00a0 order \u00a0 and, \u00a0 therefore, \u00a0 the\u00a0<br \/>\npetition\u00a0may\u00a0not\u00a0be\u00a0entertained\u00a0by\u00a0this\u00a0Court,\u00a0at\u00a0this\u00a0stage.\n<\/p>\n<p>4.\u00a0\u00a0\u00a0Having\u00a0heard\u00a0learned\u00a0counsel\u00a0for\u00a0both\u00a0the\u00a0sides\u00a0and\u00a0looking\u00a0to\u00a0the\u00a0facts\u00a0<br \/>\nand \u00a0 circumstances \u00a0 of \u00a0 the \u00a0 case, \u00a0 I \u00a0 hereby \u00a0 quash \u00a0 and \u00a0 set \u00a0 aside \u00a0 the \u00a0 order\u00a0<br \/>\npassed \u00a0 by \u00a0 the \u00a0 Sub \u00a0 Divisional \u00a0 Officer, \u00a0 Pakur \u00a0 dated \u00a0 6th\u00a0 June, \u00a0 2011 \u00a0 at\u00a0<br \/>\nAnnexure\u00ad3\u00a0mainly\u00a0for\u00a0the\u00a0following\u00a0facts\u00a0and\u00a0reasons:\n<\/p>\n<blockquote><p>    (i)\u00a0The\u00a0petitioner\u00a0was\u00a0given\u00a0license\u00a0in\u00a0the\u00a0year\u00a02009\u00a0to\u00a0run\u00a0the\u00a0fair\u00a0price\u00a0<br \/>\n    shop. \u00a0 Thereafter, \u00a0 the \u00a0 petitioner \u00a0 continued \u00a0 with \u00a0 fair \u00a0 price \u00a0 shop, \u00a0 in\u00a0<br \/>\n    question,\u00a0for\u00a0several\u00a0months.\u00a0Not\u00a0on\u00a0a\u00a0single\u00a0occasion,\u00a0any\u00a0breach\u00a0of\u00a0<br \/>\n    any \u00a0 of \u00a0 the \u00a0 conditions \u00a0 of \u00a0 the \u00a0 license \u00a0 have \u00a0 been \u00a0 found \u00a0 out \u00a0 by \u00a0 the\u00a0<br \/>\n    respondents.\u00a0Thus,\u00a0the\u00a0petitioner\u00a0was\u00a0working\u00a0in\u00a0accordance\u00a0with\u00a0law.\u00a0\n<\/p><\/blockquote>\n<blockquote><p>    (ii)\u00a0It\u00a0appears\u00a0that\u00a0suddenly\u00a0a\u00a0notice\u00a0was\u00a0given\u00a0by\u00a0pointing\u00a0out\u00a0several\u00a0<br \/>\n    irregularities\u00a0in\u00a0running\u00a0the\u00a0fair\u00a0price\u00a0shop\u00a0and\u00a0only\u00a0two\u00a0days&#8217;\u00a0time\u00a0was\u00a0<br \/>\n    given\u00a0to\u00a0give\u00a0reply\u00a0of\u00a0the\u00a0said\u00a0show\u00a0cause\u00a0notice.\u00a0\n<\/p><\/blockquote>\n<blockquote><p>    (iii)\u00a0It\u00a0also\u00a0appears\u00a0from\u00a0the\u00a0facts\u00a0of\u00a0the\u00a0case\u00a0that\u00a0the\u00a0reply\u00a0of\u00a0the\u00a0show\u00a0<br \/>\n    cause\u00a0notice\u00a0was\u00a0given\u00a0by\u00a0the\u00a0petitioner\u00a0after\u00a0the\u00a0time\u00a0limit,\u00a0given\u00a0by\u00a0<br \/>\n    the \u00a0 respondents \u00a0 i.e.\u00a0 after \u00a0two\u00a0 days \u00a0 of \u00a0 the \u00a0 receipt \u00a0of \u00a0 the \u00a0 copy\u00a0 of \u00a0the\u00a0<br \/>\n    notice.\u00a0Looking\u00a0to\u00a0these\u00a0facts,\u00a0it\u00a0appears\u00a0that\u00a0the\u00a0concerned\u00a0respondent\u00a0<br \/>\n    authority,\u00a0who\u00a0has\u00a0given\u00a0notice,\u00a0has\u00a0lost\u00a0sight\u00a0of\u00a0the\u00a0fact\u00a0that\u00a0such\u00a0a\u00a0<br \/>\n    short\u00a0time\u00a0ought\u00a0not\u00a0to\u00a0have\u00a0been\u00a0given\u00a0to\u00a0the\u00a0petitioner.\u00a0Looking\u00a0to\u00a0the\u00a0<br \/>\n    nature \u00a0 of \u00a0 allegation \u00a0 labelled \u00a0 against \u00a0 the \u00a0 petitioner, \u00a0 at \u00a0 least \u00a0 ten \u00a0 days&#8217;\u00a0<br \/>\n    time\u00a0ought\u00a0to\u00a0have\u00a0been\u00a0given\u00a0to\u00a0the\u00a0petitioner\u00a0so\u00a0that\u00a0the\u00a0petitioner\u00a0<br \/>\n    can \u00a0 adequately \u00a0 represent \u00a0 its \u00a0 case \u00a0 before \u00a0 the \u00a0 concerned \u00a0 respondent\u00a0<br \/>\n    authorities. \u00a0 Too \u00a0 short \u00a0 time \u00a0 to \u00a0 give \u00a0 a \u00a0 reply \u00a0 of \u00a0 the \u00a0 show \u00a0 cause \u00a0 notice\u00a0<br \/>\n    tantamounts\u00a0to\u00a0violation\u00a0of\u00a0principle\u00a0of\u00a0natural\u00a0justice.\n<\/p><\/blockquote>\n<blockquote><p>    (iv)\u00a0It\u00a0further\u00a0appears\u00a0from\u00a0the\u00a0facts\u00a0of\u00a0the\u00a0case\u00a0that\u00a0while\u00a0passing\u00a0the\u00a0<br \/>\n    impugned\u00a0order,\u00a0the\u00a0Sub\u00a0Divisional\u00a0Officer,\u00a0Pakur\u00a0has\u00a0relied\u00a0upon\u00a0some\u00a0<br \/>\n    report\u00a0privately\u00a0called\u00a0for\u00a0by\u00a0him.\u00a0Neither\u00a0the\u00a0copy\u00a0nor\u00a0the\u00a0gist\u00a0of\u00a0the\u00a0<br \/>\n    report\u00a0has\u00a0been\u00a0supplied\u00a0to\u00a0the\u00a0petitioner.\u00a0Whenever,\u00a0the\u00a0respondents\u00a0<br \/>\n    are\u00a0relying\u00a0upon\u00a0any\u00a0document\u00a0while\u00a0passing \u00a0the\u00a0impugned\u00a0order,\u00a0a\u00a0<br \/>\n    copy\u00a0whereof\u00a0or\u00a0summary\u00a0thereof\u00a0ought\u00a0to\u00a0have\u00a0been\u00a0supplied\u00a0to\u00a0the\u00a0<br \/>\n    petitioner.\u00a0\u00a0Likewise,\u00a0several\u00a0\u00a0statements\u00a0of\u00a0the\u00a0\u00a0ration\u00a0card\u00a0holders\u00a0have<br \/>\n                                             \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00ad3\u00ad<br \/>\n           been\u00a0relied\u00a0upon.\u00a0Nobody\u00a0knows\u00a0who\u00a0says\u00a0what\u00a0about\u00a0the\u00a0petitioner\u00a0<br \/>\n           and\u00a0nobody\u00a0knows\u00a0whether\u00a0they\u00a0are\u00a0really\u00a0ration\u00a0card\u00a0holders\u00a0or\u00a0not.\u00a0If\u00a0<br \/>\n           the \u00a0 Sub \u00a0 Divisional \u00a0 Officer, \u00a0 Pakur \u00a0 is \u00a0 relying \u00a0 upon \u00a0 this \u00a0 statement \u00a0 for\u00a0<br \/>\n           cancelling\u00a0the\u00a0fair\u00a0price\u00a0shop\u00a0license\u00a0then\u00a0these\u00a0statements\u00a0or\u00a0summary\u00a0<br \/>\n           thereof\u00a0ought\u00a0to\u00a0have\u00a0been\u00a0supplied\u00a0to\u00a0the\u00a0petitioner.\u00a0In\u00a0the\u00a0facts\u00a0of\u00a0the\u00a0<br \/>\n           present\u00a0case,\u00a0no\u00a0such\u00a0statement\u00a0or\u00a0summary\u00a0thereof\u00a0has\u00a0been\u00a0supplied\u00a0<br \/>\n           to\u00a0the\u00a0petitioner.\n<\/p><\/blockquote>\n<blockquote><p>       5.\u00a0 \u00a0In\u00a0view\u00a0of\u00a0the\u00a0aforesaid\u00a0facts\u00a0and\u00a0reasons,\u00a0there\u00a0is\u00a0gross\u00a0violation\u00a0of\u00a0<br \/>\n
