DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned APP, waives service of notice of Rule for respondent &#8211;<br \/>\n\tState.\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 438 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 273 of 2010 with Mehsana City Police Station for the<br \/>\n\toffences punishable under Sections 406, 465, 467, 468, 471 etc. of<br \/>\n\tthe Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the applicant submits that allegations against the<br \/>\n\tapplicant are to the extent that he has produced a wrong certificate<br \/>\n\tabout his disability for getting public employment as Vidhya Sahayak<br \/>\n\tand upon scrutiny the competent authority has terminated his<br \/>\n\tservices.  He further submitted that his disability to the extent of<br \/>\n\t35% is found to be correct by the Chief District Medical<br \/>\n\tOfficer-cum-Civil Surgeon, General Hospital, Gandhinagar.  He<br \/>\n\tfurther submitted that by and large investigation is over and<br \/>\n\tconsidering the overall facts and circumstances of the case, the<br \/>\n\tapplicant deserves to be granted anticipatory bail.\n<\/p>\n<p>Heard<br \/>\n\tLearned APP for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and considering the fact that the disability of the applicant<br \/>\n\tto the extent of 35% is found to be correct by the Chief District<br \/>\n\tMedical Officer-cum-Civil Surgeon, General Hospital, Gandhinagar, I<br \/>\n\tam inclined to grant anticipatory bail to the applicant.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe result, this application is allowed by directing that in the<br \/>\n\tevent of the applicant herein being arrested pursuant to FIR being<br \/>\n\tCR No. I 273 of 2010 with Mehsana City Police Station,  the<br \/>\n\tapplicant shall be released on bail on furnishing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand only) with one surety of like<br \/>\n\tamount on following conditions :-\n<\/p>\n<p>shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p>shall<br \/>\n\tremain present at the concerned Police Station on 25.11.2010 at<br \/>\n\t11.00 a.m.;\n<\/p>\n<p>shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p>at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p>will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p>it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p>this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p>within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p>With<br \/>\n\tthese directions, this Criminal Misc.
