This petition is filed under Section
\nrequesting for grant of anticipatory pg bail; japprevhending
\narrest in Crime No.182\/i:2._(gEO9 i.itlie_Vi..oiffencev”punishable
\nunder Sections 20 (a) (b)    the Narcotic
\nDrugs 8:   (hereinafter<\/p>\n
called as ‘the  ‘by  Ripponpete Police<\/p>\n
Station. V\n<\/p>\n
2. Theiifacts rielevanatifor the purpose of this petition
\n‘  Ripponpete Police Station had credible<\/p>\n
inforinationiiiahotiht’growing ganja plants in S.No.28 of Vada<\/p>\n
 hosahalii Village and in the circumstances. he alongwith<\/p>\n
 ” the “staff vtrent in a jeep to the Village, secured the attesting<\/p>\n
..Witi3.gesses and went to the land bearing S.No.28 said to<\/p>\n
” –. have been in possession of the petitioner. There he found<\/p>\n

\nthat 39 ganja and chilly plants were grown within the said
\nland at different places. The said plants were cutp””apnd
\nseized and they weighed 39 kgs. and were worth , V.\n<\/p>\n
00. In the circumstances. when he made an
\nthe accused, he found that they were
\nseizure, registered the crime on theiiiibasisii of
\ncomplaint for the abovesaid offeirices. .”‘l’he  still

\ncircumstances that   an
\napplication to  anticipatory
\nbail and as the rejected, they have
\napproachediitiiisiivf\ufb01oiuijt’for_grant._”of bail under Section 438<\/p>\n

 i Itupis the cointention of the learned counsel for the<\/p>\n
in’V.petitionersTthiatthe petitioners are innocent and have not<\/p>\n
co’mrri_i_ttevd4:”‘–an3{‘V-nifence. He also submits that the land<\/p>\n
 bearing S.,i’\\To.\ufb01’8i is not owned by the petitioners and that<\/p>\n
xpyetitioners have no nexus with the crime said to have<\/p>\n
 been*coinrnitted. He has also produced the property extract<\/p>\n
 ‘of._S;.No.28 which that it is a Government land and in the<\/p>\n
“circumstances, he submits that the petitioners have no<\/p>\n

plants in the said land. So also, it is his contentionjthat<\/p>\n

bail. On these grounds, they have slought forthe <\/p>\n

4. The learned Go\\(ernrnepntV’:Pl_ea.der has Voppvvosed the<\/p>\n
petition and has madgk, iv statement of the<\/p>\n
witnesses recorded’during’the:’investigat.ion,;’ ‘<\/p>\n
5.  ‘iiaif\ufb01  counsel for the
\npetitioners. and  Pleader. The point
\nthat arise for is:\n<\/p>\n
  petitioners are entitled to<\/p>\n
V  iihtheivadnticipiatpory bail sought for ?”<\/p>\n
A  Svodfa\ufb01r as the offence under the Act is concerned,<\/p>\n
T3″-e._they ar’\u00a3__Asocial crimes wherein the growing Qaf ganja<\/p>\n
  afVi’ects”A_\u00abthe society as well. In these circumstances, the<\/p>\n
V”‘r,.__\ufb02prow?;isions of the Act are strictly implemented and the<\/p>\n
 . “punishment provided for such offences i.e., even for<\/p>\n

\ngrowing the ganja plants extend to about ten years. So far<\/p>\n
as the contention of the learned counsel for the petitioners<\/p>\n
that the land bearing S.No.28 does not belong_'t:oV':ithe'-.V<\/p>\n
petitioners is accepted, the statement of  '<\/p>\n
prima facie reveal that the saidfliand. 'W",2'1S '–thex"g<\/p>\n
cultivation of the petitioners. Apart\ufb02frcrlnl thi's,._.the\u00ab.<\/p>\n
like ginger and chilly were grownn.__a'1:d if w.as.Va:'foVrest'iand,
\nthere could have been no…guesti'onlVg_:ofu"raising"such crops.
\nFurthermore, the questionas 'tog petitioners
\nwere in actual possesvsion:   niatter which will
\nhave to be  stageeoti  and prima facie
\nlooking into"    witnesses and the
\nallegationsqand Jrehcorded by the Police suo-<\/p>\n
motu, it appears that__the: petitioners were in possession of<\/p>\n
"this  flihepre wiereasvmany as 47 ganja plants weighing<\/p>\n
labout"  Rs.39,000-00 were raised and<\/p>\n
  considering thelpirintention of the Legislature and the fact<\/p>\n
 ' that the offences are social crimes, I do not think that it is<\/p>\n
   case 'Where anticipatory bail under Section 438 Cr.P.C.<\/p>\n
 I  granted.\n<\/p>\n

7. It is well established principle of law that the<\/p>\n
discretion vested with the Court under Section 438 Cr’.’P.C.<\/p>\n
has to be sparingly used only in exceptional circnmistanices-\u00abV<\/p>\n
wherein an innocent person has been implicat_edfinV”t:he.’_f<\/p>\n
crime. But the perusal of the materialplacegii \u00a7mjr\u00a2c\u00a2.rd”–,<\/p>\n
reveals prima facie the commission ofaiz offence unciei:_the’q<\/p>\n
provisions of the Act.\n<\/p>\n
8. As the Petitioner No.5 ”  ‘granted bail<\/p>\n
under Section 439 Cr.P.C.    be appropriate
\nfor the first petitioner ::to  Court by filing
\nregular app1i\u00a2iati:on:.’V’fo’r  learned Judge shall<\/p>\n
consider 7.the_ same~a_s*eXpediti–onsly as possible and grant<\/p>\n
the relief depending  facts and circumstances in<\/p>\n
