No.279 of 2011\n            ====================================\n          Dated this the 27th     day of January,   2011\n\n\n                             O R D E R\n<\/pre>\n<p>      Petitioner suffered an ex parte order (Annexure-R) dated<\/p>\n<p>October 9, 2009 in C.M.P. No.3729 of 2009 of the court of learned<\/p>\n<p>Judicial First Class Magistrate, Varkala under Section 12 of the<\/p>\n<p>Protection of Women from Domestic Violence Act, 2005. As per the<\/p>\n<p>impugned order petitioner is directed to pay Rs.5,000\/- per month<\/p>\n<p>towards maintenance of respondent and children from 23.06.2009<\/p>\n<p>(date of petition) till date of order and at the same rate thereafter.<\/p>\n<p>There is also a direction to pay Rs.4,50,000\/- to the respondent<\/p>\n<p>being the value of gold ornaments and Rs.6,50,000\/- for<\/p>\n<p>construction of building. Petitioner filed C.M.P. No.3659 of 2010 to<\/p>\n<p>set aside the ex parte order. Leaned counsel submitted that the<\/p>\n<p>said petition is pending consideration and the case is posted on<\/p>\n<p>26.02.2011.    In the meantime petitioner challenged Annexure-R,<\/p>\n<p>order on C.M.P. No.3729 of 2009 in the court of learned Sessions<\/p>\n<p>Judge, Thiruvananthapuram           in Crl. Appeal No.357 of 2010.<\/p>\n<p>Learned Sessions Judge has dismissed that appeal. Pursuant to<\/p>\n<p>that, respondent has filed application to execute Annexure-R,<\/p>\n<p>CRL.M.C. No.279 of 2011<br \/>\n<span class=\"hidden_text\">                                 -: 2 :-<\/span><\/p>\n<p>order. Petitioner states that though applied for he has not been<\/p>\n<p>served with a copy of judgment in Crl. Appeal No.357 of 2010.<\/p>\n<p>Hence this petition requesting to quash Annexure-R, order (in<\/p>\n<p>C.M.P. No.3729 of 2009) under       Section 482 of the Code of<\/p>\n<p>Criminal Procedure (for short, &#8220;the Code&#8221;) as remedy of appeal is<\/p>\n<p>exhausted by dismissal of Crl. Appeal No.357of 2010. Learned<\/p>\n<p>counsel submitted that pursuant to the dismissal of the appeal<\/p>\n<p>respondent has initiated execution proceedings and the matter is<\/p>\n<p>posted on 05.02.2011.\n<\/p>\n<p>      2.   If Crl. Appeal No.357 of 2010 is dismissed for whatever<\/p>\n<p>reason it be, I am not persuaded to think that petitioner is without<\/p>\n<p>any remedy.      It is open to the petitioner to challenge that<\/p>\n<p>judgment under Sec.397 of the Code if circumstances warranted<\/p>\n<p>that. In such a situation there is no reason why this Court should<\/p>\n<p>interfere under Sec.482 of the Code. But to invoke the statutory<\/p>\n<p>remedy     against    judgment in Crl. Appeal No.357 of 2010<\/p>\n<p>petitioner has to get a copy of the judgment. If in the meantime<\/p>\n<p>Annexure-R, order is executed petitioner will be put to difficulties<\/p>\n<p>and inconvenience. In the circumstances I am inclined to grant<\/p>\n<p>some relief to the petitioner but ensuring that respondent is not<\/p>\n<p>put to inconvenience on account of that.\n<\/p>\n<p>CRL.M.C. No.279 of 2011<br \/>\n<span class=\"hidden_text\">                                  -: 3 :-<\/span><\/p>\n<p>      Resultantly, Criminal Miscellaneous Case is disposed of in<\/p>\n<p>the following lines:\n<\/p>\n<\/p>\n<p>             (i)    Leaned            Sessions             Judge,<\/p>\n<p>      Thiruvananthapuram is directed to issue certified copy<\/p>\n<p>      of judgment in Crl. Appeal No.357 of 2010 of that court,<\/p>\n<p>      if it is applied for as early as possible and at any rate<\/p>\n<p>      within one month from the date of receipt of a copy of<\/p>\n<p>      this order.\n<\/p>\n<\/p>\n<p>             (ii)   Execution   of  Annexure-R,    order    dated<\/p>\n<p>      October 09, 2009 is stayed for a period of forty (40)<\/p>\n<p>      days from this day or till appropriate order is passed by<\/p>\n<p>      the revisional court, whichever is earlier subject to the<\/p>\n<p>      following conditions:\n<\/p>\n<\/p>\n<blockquote><p>                    (a)  Petitioner shall deposit in the trial<\/p>\n<p>             court   for  payment    to    the  respondent<\/p>\n<p>             `.30,000\/- (Rupees Thirty thousand only)<\/p>\n<p>             (being    a   portion   of   the   arrears    of<\/p>\n<p>             maintenance     ordered     by   the    learned<\/p>\n<p>CRL.M.C. No.279 of 2011<br \/>\n<span class=\"hidden_text\">                                -: 4 :-<\/span><\/p>\n<p>           Magistrate vide Annexure-R, order) within two<\/p>\n<p>           weeks from this day.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                  (b)  Petitioner  shall    continue    to<\/p>\n<p>           deposit in the trial court for payment to the<\/p>\n<p>           respondent maintenance allowance payable<\/p>\n<p>           from October 09, 2010 during the said period<\/p>\n<p>           of forty (40) days.
