The<\/p>\n<p>question raised is as to whether the respondent,<\/p>\n<p>who was the applicant before the Tribunal, was<\/p>\n<p>eligible for first ACP of 9.8.1999 and the second<\/p>\n<p>ACP on completion of 24 years of service. It is<\/p>\n<p>not in dispute that on completion of 24 years, he<\/p>\n<p>was eligible for the second ACP. The issue is<\/p>\n<p>whether the denial of the first ACP on ground<\/p>\n<p>that he was not found to have acquired the bench-<\/p>\n<p>mark stands. We find that all that the Tribunal<\/p>\n<p>has  done  is  to  direct  the  establishment  to<\/p>\n<p><span class=\"hidden_text\">WPC25725\/10            -: 2 :-<\/span><\/p>\n<p> consider the case of the applicant since no entry<\/p>\n<p> adverse to his interest was put to him and going<\/p>\n<p> by the ratio of the Apex Court in        <a href=\"\/doc\/801705\/\">Dev Dutt v.<\/p>\n<p> Union of India,<\/a> (2008) 8 SCC 725, an entry in the<\/p>\n<p> service records which discloses adverse remark<\/p>\n<p> for any purpose should not be utilized against an<\/p>\n<p> officer unless appropriately communicated since<\/p>\n<p> the   incumbent  should     have  an  opportunity to<\/p>\n<p> challenge    such  entry     which would   ultimately<\/p>\n<p> result in adverse consequences. Therefore, the<\/p>\n<p> law is that every entry which may tend to operate<\/p>\n<p> as adverse should be put to an officer.<\/p>\n<p> What     exactly is   the     bench-mark  which  the<\/p>\n<p> Screening Committee had adopted was not produced<\/p>\n<p> before the Tribunal. All that the Tribunal has<\/p>\n<p> done is to direct the establishment to consider<\/p>\n<p> the    representation of     the  applicant  and  to<\/p>\n<p> provide him an opportunity of hearing, if the<\/p>\n<p> decision    were  adverse     to  him.   Under   such<\/p>\n<p> circumstances, we find no error of jurisdiction<\/p>\n<p> or   illegality   on  the    face  of   the  impugned<\/p>\n<p><span class=\"hidden_text\">WPC25725\/10           -: 3 :-<\/span><\/p>\n<p> decision   of the  Tribunal.   The  writ  petition<\/p>\n<p> fails.
