Much thereafter in<br \/>\n\tthe month of January, 2008, this matter has been placed in this<br \/>\n\tCourt for disposal on merits.\n<\/p>\n<p>On<br \/>\n\tverifying the averments made in the petition and other aspects of<br \/>\n\tthe matter, this Court felt that the complainant is a necessary<br \/>\n\tparty and, therefore, before hearing the matter on merits, the<br \/>\n\tcomplainant should be joined as the party in this petition also and<br \/>\n\tprocess be served upon him also.\n<\/p>\n<p>This<br \/>\n\tCourt issued process to that effect. However, when it was tried to<br \/>\n\tbe served upon the original complainant, it was found that original<br \/>\n\tcomplainant-Ishwarbhai Bechardas Patel died on 20th May,<br \/>\n\t1998 at Red Laxmipura, Tal. Kheralu, District Mehsana. In support of<br \/>\n\tthat, the petitioners have produced true copy of the death<br \/>\n\tcertificate today, which is ordered to be taken on record, and which<br \/>\n\tsupport the say of the petitioners. This shows that the complainant<br \/>\n\tdied on 20th May, 1998 and said death has been registered<br \/>\n\twith the competent authority on 22-5-1998.\n<\/p>\n<p>From<br \/>\n\tthe above, it shows that though the complainant died in the year<br \/>\n\t1998, matter has not been taken further either by the heirs of the<br \/>\n\tcomplainant or by any other person claiming to be interested in the<br \/>\n\tmatter and in the said circumstances, the complaint may not survive.\n<\/p>\n<p>However,<br \/>\n\tI am not passing any order qua quashing of the complaint. I direct<br \/>\n\tthe   office to send copy of this order to the concerned Magistrate<br \/>\n\tfor passing further appropriate order in the complaint in question.<br \/>\n\tWith the above observation and direction, this petition stands<br \/>\n\tdisposed of. Rule is discharged.
