DEPUTY SECRETARY, BIHAR PUBLIC SERVICE COMMISSION, 15\n         JAWAHARLAL NEHRU MARG, BAILEY ROAD, PATNA.\n------------------------------------------------------------------------------------------------ RESPONDENTS\n\nFor the petitioner       :-      Mr. Shivendra Kishore, Advocate\nFor the State            :-      Mr. Shankar Kumar, A.C. to A.A.G. 15\nFor the B.P.S.C.         :-      Mr. Nadim Seraj, Advocate\n                                              ********\n<\/pre>\n<p>6        2.2.2011                             The petitioner is aggrieved by the<\/p>\n<p>                                fact that the Health Department through the<\/p>\n<p>                                B.P.S.C. has been issuing advertisements for<\/p>\n<p>                                appointment              to      the        post        of       Senior<\/p>\n<p>                                Resident\/Tutor.               The first advertisement was<\/p>\n<p>                                issued        in     the      year      2001.          One      of     the<\/p>\n<p>                                conditions          in     the     said      advertisement             was<\/p>\n<p>                                that there would be no age bar for Medical<\/p>\n<p>                                Officers who are already in service of the<\/p>\n<p>                                State of Bihar.                 This advertisement of the<\/p>\n<p>                                year 2001 was withdrawn.                      Subsequently,             in<\/p>\n<p>                                the      year      2005,      another        advertisement             was<\/p>\n<p>                                issued in which one of the conditions was<\/p>\n<p>                                prescribing the age limit for applying for<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>the     post.            This    advertisement           was     also<\/p>\n<p>withdrawn.\n<\/p>\n<p>             Learned       counsel      for      the     petitioner<\/p>\n<p>submits that when the State Government is<\/p>\n<p>advertising for a particular post after gap<\/p>\n<p>of long period, there should not be any age<\/p>\n<p>bar, as it is detrimental for those persons<\/p>\n<p>who are eligible to apply for the post had<\/p>\n<p>there        been        regular           appointments          made<\/p>\n<p>periodically for the post advertised.<\/p>\n<p>             These       aspects      of    the    matter      would<\/p>\n<p>obviously       be       considered         if     and    when     an<\/p>\n<p>advertisement is issued.                    This court cannot<\/p>\n<p>pass any positive order in view of the fact<\/p>\n<p>that the advertisement of the year 2005 by<\/p>\n<p>which        the         petitioner           was        aggrieved<\/p>\n<p>prescribing         the     age       bar    for    the     Medical<\/p>\n<p>Officers for applying for the post of Senior<\/p>\n<p>Resident\/Tutor has been cancelled\/withdrawn<\/p>\n<p>by letter datedf 2.8.2006.\n<\/p>\n<p>              One ground raised on behalf of the<\/p>\n<p>petitioner which in my opinion is justified<\/p>\n<p>is    that    the        State    Government        is     inviting<\/p>\n<p>persons         for         the        post         of         Senior<\/p>\n<p>Resident\/Tutor                  and         after           issuing<\/p>\n<p>advertisement withdraws it for one reason or<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>         the other, or        without assigning any reason.<\/p>\n<p>         I   do   not   think    that    the       conduct    of      the<\/p>\n<p>         Department      concerned       is        fair    and     some<\/p>\n<p>         remedial steps should be taken by the Health<\/p>\n<p>         Department on this issue.                 Counsel for the<\/p>\n<p>         petitioner would be at liberty to bring this<\/p>\n<p>         order    to    the     notice        of     the   Principal<\/p>\n<p>         Secretary,     Health        Department.
