Advocate for the respondent\/State.\n\n\n                           ORDER\n<\/pre>\n<p>                           (06.05.2010)<\/p>\n<p>            Applicants have preferred this revision against the<br \/>\nappellate judgment dated 08.05.1998, passed by First Additional<br \/>\nSessions Judge, Tikamgarh in Criminal Appeal No.31\/97,<br \/>\nwhereby    the conviction of the applicants under Section 326,<br \/>\n326\/34 and 323 of I.P.C. recorded by Judicial Magistrate First<br \/>\nClass, Tikamgarh and sentences passed on them are affirmed.\n<\/p>\n<p>2.          As per prosecution allegations, on 09.05.1994,<br \/>\nabout 9.30 P.M., at village Jaruva Khirak, when complainant<br \/>\nMathuraprasad was lying on a cot in his house, applicants<br \/>\nKhadia, Kallu @ Pooran and Gumman came there and began<br \/>\nhurling abuses, applicant Khadia gave a spear blow to the<br \/>\ncomplainant on his left upper arm causing injury and fracture on<br \/>\nhis left humerus bone. Applicant Kallu @ Pooran also gave him<br \/>\na lathi blow, causing injury and bleeding from his nose. Upon<br \/>\nhue and cry, Jagdish, Birju and other people of the village came<br \/>\nto his rescue, then the applicants fled away.              Injured<br \/>\nMathuraprasad was rushed to the hospital, where he lodged the<br \/>\nreport of the incident, on the basis of which, FIR in the form of<br \/>\nDehati Nalishi was recorded and offence was registered against<br \/>\nthe applicants at P.S. Kotwali, Tikamgarh and was investigated.<br \/>\nUpon medical and x-Ray examination of injured Mathuraprasad,<br \/>\nan incised wound on the upper third of       left arm   alongwith<br \/>\nfracture of left humerus bone, besides other simple injuries, were<br \/>\ndetected. During investigation, spear used in the commission of<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>the offence was recovered at the instance of applicant Khadia,<br \/>\nwhile lathi was seized at the instance of applicant Kallu @<br \/>\nPooran. After due investigation, applicants were prosecuted and<br \/>\nwere put to trial. Applicant Khadia was charged under Section<br \/>\n326 of I.P.C.,while the other applicants Kallu @ Pooran and<br \/>\nGumman were charged under Section 326\/34 of I.P.C. Applicant<br \/>\nKallu @ Pooran was also charged under Section 323 of I.P.C.\n<\/p>\n<p>3.           After trial, learned Judicial Magistrate First Class,<br \/>\nTikamgarh found applicant Khadia guilty under Section 326 of<br \/>\nI.P.C., while other applicants Kallu @ Pooran and Gumman were<br \/>\nfound guilty under Section 326\/34 of I.P.C. for causing grievous<br \/>\nhurt to complainant by means of spear.         Applicant Kallu @<br \/>\nPooran was also found guilty under Section 323 of I.P.C.<br \/>\nLearned Judicial Magistrate First Class, Tikamgarh sentenced<br \/>\napplicant Khadia to rigorous imprisonment for three years with<br \/>\nfine of Rs.500\/- under Section 326 of I.P.C., whereas sentenced<br \/>\nother applicant Kallu @ Pooran to rigorous imprisonment for a<br \/>\nperiod of one year with fine of Rs.300\/- for the offence under<br \/>\nSection 326\/34 of I.P.C. and to rigorous imprisonment for a<br \/>\nperiod of six moths with fine of Rs.300\/- under Section 323 of<br \/>\nI.P.C.,   also   sentenced   applicant   Gumman       to   rigorous<br \/>\nimprisonment for a period of one year with a fine of Rs.500\/-<br \/>\nunder section 326\/34 of I.P.C. vide judgment dated 21.03.1997<br \/>\npassed in criminal case No. 606\/94 The sentences of applicant<br \/>\nKallu @ Pooran were directed to run concurrently.\n<\/p>\n<p>4.           In criminal appeal preferred by the applicants against<br \/>\nthe aforesaid order of their conviction and sentence passed by<br \/>\nJudicial Magistrate First Class, Tikamgarh, the appellate court<br \/>\nafter considering the evidence on record, affirmed the conviction<br \/>\nand sentence imposed on the applicants and dismissed their<br \/>\nappeal by the impugned judgment, which has been challenged in<br \/>\nthis revision.\n<\/p>\n<p>5.           Learned counsel for the applicants submitted that<br \/>\nthe two courts below gravely erred in law and facts in convicting<br \/>\nand sentencing the applicant. He also submitted that the<br \/>\nsentence imposed on the applicants was too harsh.\n<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>6.            Learned counsel for the State, on the other hand,<br \/>\njustified the conviction and supported the findings recorded by<br \/>\nthe courts below.\n<\/p>\n<p>7.            Impugned judgment and records of the lower courts<br \/>\nperused.\n<\/p>\n<p>8.            Now so far as conviction of applicant Khadia under<br \/>\nSection 326 of I.P.C. is concerned, there is a concurrent finding<br \/>\nof fact of the two courts below that the applicant caused grievous<br \/>\nhurt to complainant Mathuraprasad by means of a spear, a sharp<br \/>\nand pointed object in the left upper arm with fracture of humerus<br \/>\nbone.      The aforesaid finding of fact does not suffer from any<br \/>\ninfirmity in view of the evidence available on record, particularly,<br \/>\nthe evidence of complainant Mathuraprasad (P.W.-1) and the<br \/>\ncorroborative evidence of Kallubai(P.W.-2), Jagdish (P.W.-3),<br \/>\nBirju (P.W.-4) coupled with the medical evidence of Dr. N,.K.<br \/>\nChourasiya (P.W.-6) and Dr. Bharatendu Kaithal (P.W.-7). Dr.<br \/>\nN.K. Chourasiya (P.W.-6) on medical examination of injured<br \/>\nMathuraprasad on 09.05.1994 had found an incised wound of 1 x<br \/>\n\u00bd x \u00bd size on the left upper arm of the complainant and advised<br \/>\nfor X-Ray examination, besides three simple injuries on his<br \/>\nforehead and nose. In the opinion of            Dr. N.K. Chourasiya<br \/>\n(P.W.-6), incised wound was caused by hard and sharp edged<br \/>\nweapon.       Dr. Bharatendu Kaithal (P.W.-7), upon X-Ray<br \/>\nexamination of the left arm of complainant Mathuraprasad also<br \/>\nfound a fracture of his left humerus bone, corresponding to the<br \/>\nincised injury. The findings recorded against applicant Khadia is<br \/>\nbased on sound reasonings and due appreciation of the evidence<br \/>\non record.     Thus, the conviction of       applicant Khadia under<br \/>\nSection 326 of I.P.C. does not suffer from any legal or factual<br \/>\ninfirmity, so as to call for any interference in revision.\n<\/p>\n<p>9.            There is also sufficient evidence on record that other<br \/>\ntwo applicants came alongwith applicant Khadia to the place of<br \/>\ncomplainant at night and applicant Khadia gave a spear blow to<br \/>\nthe complainant in presence of other two applicants and applicant<br \/>\nKallu @ Pooran also gave a lathi blow to the complainant. In<br \/>\n<span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>view of the aforesaid facts, the finding recorded by the two courts<br \/>\nbelow that the other two applicants namely, Kallu and Humman<br \/>\nshared common intention with applicant Khadia of causing<br \/>\ngrievous hurt to complainant Mathuraprasad by means of spear.<br \/>\nThus, in view of the evidence available on record, the conviction<br \/>\nof Kallu @ Pooran and Humman under Section 326\/34 of I.P.C.<br \/>\nas well as the conviction of applicant Kallu @ Pooran under<br \/>\nSection 323 of I.P.C. also does not suffer from any legal or<br \/>\nfactual infirmity so as to call for any interference in revision.\n<\/p>\n<p>10.           As regards the sentence, learned counsel for the<br \/>\napplicants submitted that the incident of the case occurred in the<br \/>\nyear 1994 and only a single injury by spear was caused to the<br \/>\ncomplainant     and   applicant    Khadia    has    already    suffered<br \/>\nimprisonment for nearly 3 months and 22 days, while other two<br \/>\napplicants have also suffered imprisonment for two months and<br \/>\nten days, they should not be sent back to jail again after such a<br \/>\nlong lapse of time. Learned counsel for the applicants further<br \/>\nsubmitted that complainant also compounded the offence with<br \/>\nthe applicants out of court and an affidavit was also filed by him<br \/>\nin this behalf in this revision petition, though the application for<br \/>\ncompounding the offence was rejected for technical reasons. He<br \/>\nalso submitted that the factum of compromise should be taken<br \/>\ninto consideration for reducing the sentence of the applicants and<br \/>\nthe sentence of applicants be reduced to the period already<br \/>\nundergone by them.       Reliance was placed in this behalf on the<br \/>\ndecision of the Apex Court in (2002)9 SCC page 561 (Jalaluddin<br \/>\nVs. State of U.P.) and (2005) 1 SCC page 343 (Bankat and<br \/>\nanother Vs. State of Maharashtra).\n<\/p>\n<p>11.           Considering the submissions as advanced and the<br \/>\nfacts and circumstances of the case, including the fact that the<br \/>\nincident of the case occurred about 16 years back and<br \/>\napplicants have already undergone imprisonment for few months,<br \/>\ninterest justice would be subserved, if the impugned sentence of<br \/>\nimprisonment awarded to the applicants under Section 326,<br \/>\n326\/34 of I.P.C. as also the sentence awarded to applicant Kallu<br \/>\n@ Pooran under Section 323 of I.P.C. is modified and reduced to<br \/>\n<span class=\"hidden_text\">                                      5<\/span><\/p>\n<p>     the period already undergone by each of them with an additional<br \/>\n     fine of   Rs.1,000\/- (Rs. One Thousand) each for the offence<br \/>\n     under Section 326 of I.P.C. to be deposited by them within a<br \/>\n     period of two months from today, failing which, they shall suffer<br \/>\n     simple imprisonment for one month.\n<\/p>\n<p>     12.         The additional amount of fine , if realised, shall be<br \/>\n     paid to injured Mathuraprasad as compensation for the injuries<br \/>\n     caused to him.\n<\/p>\n<p>     13.         Revision stands allowed to the extent indicated<br \/>\n     above.\n<\/p>\n<p>                                    (Smt.
