MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/04\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE AKIL KURESHI)<\/p>\n<p><span class=\"hidden_text\">1\t\t<\/span><br \/>\nPresent Appeal is filed by the appellants   original petitioners<br \/>\nof Special Civil Application  No. 18073 of 2007 against the Common<br \/>\nJudgment and order  dated 21.02.2008 passed by the learned Singe<br \/>\nJudge in Special Civil Application No.18073 of 2007 along with<br \/>\nSpecial Civil Application No.14540 of 2007.\n<\/p>\n<p>2\t\tIt<br \/>\nis the case of the appellants that the agricultural land bearing<br \/>\nSurvey No. 445\/1, admeasuring 2 acres  and 3 gunthas  situated in<br \/>\nVillage  Anklav, Taluka   Borsad, belonged to the present<br \/>\nappellants. The respondents, however,  claimed  tenancy rights upon<br \/>\nthe land in question. Learned Mamlatar and ALT,  Deputy Collector<br \/>\nand Gujarat Revenue Tribunal found that the respondents were the<br \/>\ntenants of the disputed land.\n<\/p>\n<p>3\t\tThe<br \/>\nlearned Single Judge  after considering the submissions made on<br \/>\nbehalf of the petitioners  at length, found  no merits in the writ<br \/>\npetitions and dismissed the same.\n<\/p>\n<p>4\t\tHaving<br \/>\nheard learned Advocate for the appellants,  we do not see  any reason<br \/>\nto interfere with the decision of the learned Single Judge which in<br \/>\nturn confirmed the concurrent findings of facts by three authorities<br \/>\nthat the respondents  had successfully  established their   tenancy<br \/>\nrights.  Admittedly, we also found that the  present appellants had<br \/>\nsold away the suit land during the pendency of the proceedings.<br \/>\nConsidering all these aspects of the matter, there is no merit in the<br \/>\nAppeal and the same  stands dismissed.
